RFP HSHQE2-12-R-00001
Armed Protective Security Officers - NYC Questions and Answers - Contracting
1. Wage Determination (WD) 2005-2375, revision 11 was provided as attachment 5 of the solicitation. WD 2005-2375 has been updated by revision 12, effective 06/13/2012. Will an amendment be issued recognizing the current WD, or should we continue to use the old WD for pricing, and request an equitable adjustment upon contract award?
Answer: See Amendment 00002.
2. On the past performance questionnaire for Solicitation # HSHQE2-12-R-00001, it references the state of Georgia as opposed to NY. The solicitation number is correct on the form (# HSHQE2-12-R-00001) but the content in the first paragraph references Georgia. Can I correct this and still use this past performance questionnaire or will the government send out a new form?
Answer: See Amendment 0002.
3. Section E – Solicitation Provisions - Proposal Submission Requirements – Line Item 3, Page Limitation: This section states the technical proposal is limited to twenty (20) pages in at least 11 pt. font; however, headers, footers and tables are typically exempted from the 11 pt. font restriction. Please advise whether this is the case.
Answer: No.
4. Section E – Solicitation Provisions - Proposal Submission Requirements – Line Item 2: This paragraph states “The second envelope shall contain the pricing submission and all other documents…”
Question: How many copies of the pricing submission are required?
Answer: One copy of the pricing submission is required.
5. Attachment 10 – Proposal Checklist for Offerors – Package One – Technical Proposal, Relevant Past Performance, Item 2: Item 2 states “for each project submitted, send a Past Performance Questionnaire (Attachment 4) to a cognizant representative of the customer organization that purchased the services from your company.”
Question: Since Attachment 4 is listed as a submission requirement to be included in Package One – Technical Proposal, is the Government requiring Offerors to include a copy of the incomplete Past Performance Questionnaires, which have already been sent to the customer’s organization? Or is the Government asking that the customer organization send completed forms both to the Government and back to the offeror for inclusion in the Technical Proposal?
Answer: Past Performance Questionnaires should not be included in the Technical Proposal package. Questionnaires should be sent from the customer directly to the Government. See PSO NYC Clauses and Instructions, Sub-Section E-2, 1.2 – Relevant Past Performance.
6. Attachment 10 – Proposal Checklist for Offerors – Package Two – All Non- Technical Documents, Other Documents to Include in Package Two, Disclosure HSAR 3052.209-70: Offerors are referred to Sub-Section C-2. However, HSAR 3052.209-70 is not included in Sub-Section C-2.
Question: Would the Government please provide HSAR 3052.209-70 for completion and submission with Package Two?
Answer: See Amendment 00002.
7. Attachment 10 – Proposal Checklist for Offerors – Package Two – All Non- Technical Documents, Other Documents to Include in Package Two, Information Regarding Responsibility Matters FAR 52.209-7: Offerors are referred to Sub- Section E-5. However, FAR 52.209-7 is not included in Sub-Section E-5.
Question: Would the Government please provide FAR 52.209-7 for completion and submission with Package Two?
8. Section E – Solicitation Provisions - Proposal Submission Requirements – Line Item 3, Page Limitation: Would the Government clarify if the Table of Contents does not count towards the 20-page limitation?
Answer: The Table of Contents counts towards the 20-page limitation.
9. Attachment 5 – Wage Determination: Will the Government provide the Wage Determination or CBA for posts in Long Island (Nassau and Suffolk Counties)?
10. Page 44 of the Solicitation’s Clauses Section and Attachment 10 indicate that responses should be submitted in two volumes—a technical proposal and pricing/non-technical proposal. During the pre-proposal conference a slide indicated that a third volume would be required for certifications. Please confirm that the solicitation is correct.
Answer: The Solicitation is correct. A revised Pre-proposal conference presentation will be posted to FBO.
11. Attachment 12, PIV Locations: All of the PIV Locations are located in the state of Florida. Will the Government provide the list of permanent PIV Locations in New York?
Answer: See Amendment 00002.
12. Attachment 5 – DOL Wage Determination No. 2005-2375 – Health & Welfare, Page 7: It is our understanding that according to the Department of Labor Agency Memorandum Number 211, as of June 17, 2012, the SCA Health and Welfare benefit has increased to $3.71. As a result, contracting agencies may make pen and ink changes to their current WDs received for contracts beginning on or after June 17, 2012. Will the Government confirm that offerors should use the new H&W rate in their price proposal?
13. Attachment 5 – CBA between WSI and Local One Security Officers Union – Appendix A Wage Schedule: Will the Government confirm that offerors should keep CBA wages stagnant throughout the base and all option periods?
Pricing is at the discretion of the Contractor.
14. Contract Clauses, Subsection E-2, Technical Proposal (Non-price factors), 3 Socio Economic Factor presents a chart that requires the bidder to provide the overall price of the contract as bid.
Question: Since this is a “technical” factor, how does the entry of the price data in the chart reconcile with the prohibition against placing price data in the technical proposal? Does the Government want a dollar value in the first block, or just a percentage value in the subsequent blocks of this chart?
Answer: The proposal submission requirement chart on page 45 of the Contract Clauses has been removed in Amendment 00004.
See Attachment 10 - Offerors shall complete and submit the table as part of Package One the Technical Proposal.
15. Contract Clauses, Subsection E-2, Proposal Submission Requirements, paragraph 3 Page Limitation provides in relevant part “Excluding the cover page and past performance forms and questionnaires, the technical proposal (covering all non-price factors) is limited to twenty (20) pages…”
Question A: Will the Government consider allowing a Table of Contents for the Technical Proposal that will be exempt from page limitation?
Answer: No.
Question B: Will the Government consider allowing a Cover Letter for the Technical Proposal that will be exempt from page limitation?
Answer: See Contract Clauses page 53 - Cover Page is exempt, Cover Letter is not exempt.
16. Contract Clauses, Subsection E-2, Proposal Submission Requirements, paragraph 4 Page Limitation provides in relevant part “Excluding the cover page and past performance forms and questionnaires, the technical proposal (covering all non-price factors) is limited to twenty (20) pages in at least 11pt font and 1” margins.
With reference to Question C, below, paragraph 7 provides a chart summarizing the Proposal Submission Requirements which indicates that the Attachment 4 Past Performance Questionnaires are to be included in the Technical Proposal, although not counted towards the 20 page technical proposal limit.
Question A: Will the Government consider a smaller font size for tables and graphics as long as it is legible?
Answer: No.
Question B: Will the Government allow a smaller, legible font size for the essential information contained in document headers and footers?
Answer: No.
Question C: Since 1. Relevant Past Performance subparagraph C provides that Past Performance Questionnaires are to be submitted directly to …, please confirm that Past Performance Questionnaires are not required to be submitted as part of the proposal.
Answer: Past Performance Questionnaires should not be included in the Technical Proposal package. Questionnaires should be sent from the customer directly to the Government.
17. Contract clauses, Section 4.B.3, provides "For cost/price factors that are subject to variation, but are not subject to adjustment under the provisions above, contractors may factor in contingency allowances.
"Note: Increases to Supervisor wages and benefits are not subject to contract price adjustment in the subsequent ordering period periods under FAR 52.222-43(d), unless the Supervisory position is expressly covered under a Collective Bargaining Agreement or DOL Wage Determination. For Supervisor positions that are not subject to contract adjustment under FAR 52.222-43(d), the contractor is permitted to include a reasonable escalation in subsequent ordering periods (periods 1-4), based on the labor market in the geographical area that the effort will be performed."
Question: Is it permissible to price Supervisory and overhead in positions at a 5 year average instead of escalating wages each period?
Answer: Pricing is at the discretion of the Contractor.
18. CBA between Local One Security Officers Group and WSI provides wage rates in Appendix “A” through 11/01/11 and Health and Welfare rates in Appendix “C” effective 11/01/2011. Wage Determination WD05-2375 provides Wages and Health and Welfare rates effective 06/13/2011.
Question A: Will the government provide updated CBAs and AWD containing wage rates, health & welfare rates and other related terms and conditions applicable to the Base Year period of performance under this RFP (04/01/2013 – 03/31/2018)?
Answer: The most current CBA is included in the solicitation. Please see Amendment 0002 for the most recent Wage Determination.
Question B: If the government will not provide updated CBAs, are Offerors to use wage, health & welfare rates and any other related fringe benefits effective 11/01/2011 as indicated in CBA between Local One Security Officers Group and WSI for pricing purposes?
Answer: Pricing is at the discretion of the Contractor. Please refer to the Pricing Section of the solicitation.
Question C: If the government will not provide updated AWD are Offerors to use wage, health & welfare rates and any other related fringe benefits effective 06/13/2011 as indicated in AWD for pricing purposes?
Answer: Pricing is at the discretion of the Contractor.
19. CBA between Local One Security Officers Group and WSI, Article 1 Recognition provides that the CBA covers “DHS/FPS locations in Manhattan, the Bronx, and Westchester County.” Wage Determination WD05-2375 covers “New York Counties of Bronx, Kings, New York, Putnam, Queens, Richmond, Rockland, Westchester.” In addition, there is one location (U.S. Courthouse Islip) that is located in Suffolk County that is not covered by either the CBA or the WD.
Question A: Can the government please provide a revised Post Exhibit which specifies the applicable CBA per post in order to avoid confusion and to ensure that Offerors’ price quotes accurately represent the CBA/AWD associated with each post?
Answer: See Amendment 0004.
20. Most of the posts in the Post Exhibit provided incorrectly indicate the total number of days per year and the total number of hours per year. For example, Post ID#1 in building NY0128 is a 24/7 post indicated as “366” days per year and “366” hours per year. In actuality, there are 365 days in the period of performance for the Base Year (04/01/2013 – 03/31/2014), which equates to 8,760 hours per year for a 24/7 post.
Question A: Can the government please provide a revised Post Exhibit indicating the correct number of days per year and the correct number of hours per year for each post?
Answer: See Amendment 0004.
21. Attachment 12, PIV Locations only indicate PIV locations in the state of Florida.
Question A: Are there PIV Locations in the state of New York that are closer in distance to the post locations under this RFP?
Answer: Yes
Question B: If the answer to Question A is “Yes,” will the government provide an updated Attachment 12 indicating PIV locations in the State of New York?
Answer: See Amendment 0002.
22. Please confirm whether the New York City metropolitan commuter transportation mobility tax (MCTMT) applies to contractors providing services under this effort.
Answer: Pricing is at the discretion of the Contractor and the Contractor is responsible for determining which fees are applicable and pricing applicable fees into its pricing.
