12.6

Table The table in Section 12.6 Proposal Format and Submission defines the following tabs for Volume 1:

Tab E Algorithm Replay Tool

Tab F Warranties / Maintenance

Support Plan

Tab G Training Plan

Section 13 defines Tabs E, F, and G as:

Tab E: Warranties / Maintenance

Support Plan

Tab F: Training Plan

Tab G: Algorithm Replay Tool

Please clarify which is correct.

The table in Section 12.6 will be updated as follows:

Tab E: Warranties / Maintenance Support Plan

Tab F: Training Plan

Tab G: Algorithm Replay Tool

Tab H: Past Performance

Section 13 will also be updated as follows:

Tab G: All references to Tab E will be changed to Tab G.

Tab F: Past Performance will be changed to:

Tab H: Past Performance

#2 70 13 Tab F In the instructions for Tab F Past

Performance, Offerors are required to have past performance questionnaires completed by clients and returned to DNDO. If a customer has completed and submitted the questionnaire in the last three months for another proposal, can DNDO use this previously submitted questionnaire? Or does

DNDO want the customer to complete the same questionnaire again?

The questionnaire is specific to this solicitation and must be completed again.

#3 65 12.6

And

Att. 1

2 The RFP states, “Proposals shall be single-sided pages (8-1/2 x 11 with 1” margins on all four sides) typed in no less than 12-point type. Figures and tables will have no less than 8-point font.” For the printed copy of the proposal, To print Attachment 1, Excel reduces the size of the font to fit on 8-1/2

Attachment 1 can be printed on 11 X 17” paper.

x11 paper to much less than 8-point font. Is this acceptable? Or can the RFP be amended to allow 11 x 17” paper be used to print

Attachment 1 in the hardcopy submission?

#4 23 52.204-10 4 Will waivers for Reporting Executive

Compensation be granted for vendors that do not receive 80% of total revenue from

Federal Contracts?

No waiver is necessary. The reporting requirement in 52.204-10(d)(1) only applies if in its preceding fiscal year a Contractor received

80% or more of gross revenues from Federal

Contracts, plus $25M ore more in annual gross revenues from Federal contracts. Unless those conditions are met, there is no reporting requirement.

#5 77 15.2.5 3 The RFP evaluation criteria for Price contain a statement that an evaluation of the Small

Business Subcontract Plan (SBSP) will be performed but not rated. The SBSP requirement states it must cover the production of the system and at the offeror’s discretion include maintenance and training.

If our product is manufactured outside the

US and the only potential subcontract opportunities that exist within the US are training and maintenance will this mean our plan will be deemed Not Acceptable?

A Small Business Subcontract Plan (SBSP) that adequately addresses the production of the system and explains the subcontract provisions relative to manufacturing outside the United

States, will be acceptable. The SBSP is unrated, but used for statistical purposes to measure DHS small business goals with against performance.

#6 5 3.4 CLINs

0002, 0003, and

Please confirm that CLIN 0002 Warranty applies to the devices purchased during the base period, and CLIN 0003 Extended

Warranties applies to units purchased in the

Option Years 1 through 4. After the one-year warranty period maintenance services can be purchased for the devices.

If this is not correct, please explain why a component would choose extended warranty

CLIN 002 Warranty applies to systems during their initial year of service.

CLIN 003 Extended Warranties applies to systems after their initial year of service.

To explain further, during Option Year 1, the government could award CLIN 0001/CLIN 0002 for HPT Systems with an initial one year warranty.

or maintenance, or both.

In response to the second part of this question, during Option year 1, USCG, CBP and/or TSA could decide to continue the warranty for maintaining their HPT Systems deployed during the baseline year. In that case, the government would award CLIN 003 to procure the extended warranty.

#7 5 3.4 CLIN

The RFP states that maintenance support

“…shall augment the organic and depot level maintenance that may be provided by a

Component(s).”

1. Please describe the maintenance capabilities of the components and what maintenance services they will perform.

2. Will all components provide maintenance services?

3. If the components are providing maintenance services, there are no

CLINs in Attachment 4 for the purchase of tools or spare parts.

Should these items be added to

CLIN 0006 in Attachment 4?

CLIN 004 is revised as follows:

CLIN 0004 – Maintenance Support: The Offeror shall provide Original Equipment Manufacturer

(OEM) maintenance support for each Option

Year. The OEM support is required at CONUS and OCONUS locations and include the following two requirements which the Offeror shall separately price:

Help Desk (004A) – Technical support to

Component operational and maintenance organizations including but not limited to assistance in the analysis of systems faults and performance issues with deployed HPT

Systems. Hours and level of support will be up to the offeror to determine.

Technology Refurbish (004B) – Repair and refurbish of an HPT System(s) not under warranty, returned to the Offeror by the

Component operational and/or maintenance organization.

#8 5 3.4 CLINs

0002, Warranty and Maintenance support is required for CONUS and OCONUS

The OCONUS locations are Alaska, Hawaii and

U.S Territories.

0003, and locations. Are the OCONUS locations

Alaska, Hawaii, and U.S. territories? If there are other OCONUS locations, please identify those locations.

#9 77 15.2.3.1 (b)

Maintenan ce Support

In Section 15.2.3.1 Warranties / Maintenance

Support states that the evaluation will consider our approach and methodologies

“that will result in meeting performance requirements and standards associated with system availability.” Where are the performance requirements and standards associated with systems availability defined?

The performance requirements and standards are defined in the HPT RTM the vast majority of which are referenced and traceable to ANSI

42.48.

2 Clarification- What is the quantity of test articles required for Bailment Agreement: the

RFP (p 79) lists seven (7), the bailment agreement clearly states provision of ten

(10)?

Ten (10) systems will be required.

#11 78-79 14.2

Government

Testing

2 If the contractor is proposing products for consideration to support both maritime and baseline requirements is the contractor required to support duplicate quantities of product deliveries for bailment terms?

No, if an offeror is proposing a system to support both maritime and baseline requirements, a total of Ten (10) systems will be required.

#12 78 14.1 Offeror

Demonstratio n

2 If the contractor is proposing products for consideration to support both maritime and baseline requirements is the contractor required to support two demonstrations of capability in terms of section 14.1 of the

RFP?

No, if an offeror is proposing a system to support both maritime and baseline requirements, only one demonstration will be required.

#13 65 and 67 12.6 and 13 For formatting of proposal submission, we have noted discrepancies between Sections

12.6 and 13- clarification is requested on the format required for proposal submission. The following is what the table in Section 12

Please see the response to question #1 above.

shows along with noted discrepancies next to the items in question:

Tab A – Proposal cover/transmittal letter

Tab B – System Description

Tab C – Statement of Requirements

Tab D – Test Reports

Tab E – Algorithm Replay Tool (Section 13 shows Tab E as Warranties/Maintenance)

Tab F – Warranties/Maintenance (Section 13 shows Tab F as Training Plan)

Tab G – Training Plan (Section 13 shows

Tab G to be Algorithm Replay Tool)

Tab H – Past Performance (Section 13 shows this as Tab F Past Performance; I’m guessing this is just a typo)

Refer to being able to transmit using a specific SATPHONE. Are these requirements for ALL (Baseline and Marine) or just Marine?

HPT FR-09-02, 03 and 04 support OR-09, which specifies the Threshold Requirement for the HPT

System to be wired to a SATPHONE (Maritime

Only). In other words, as a threshold requirement, being able to transmit using

SATPHONE is a Maritime only requirement.

09‐04 OR-09 also defines the Objective Requirement is for the HPT System to be wired to a

SATPHONE (Baseline).

Response

Date

We respectfully request a five (5) week extension to the due date of the HPT proposal. Currently we are working on an offering for neutron detection using the

CLYC crystal. However, there have been some challenges with the supplier, which has since been corrected. This has delayed the commercial launch of our product by more than one month. An extension will allow us to submit a compliant bid that meets the requirements of the RFP. This will also provide DNDO with increased competition for the HPT procurement.

The request cannot be accommodated. Systems being proposed must be Non-Developmental, Commercial or Commercially Available Off-the

Shelf (COTS).
