Human Portable Tripwire Request For Proposal Section 3 – Description/Specifications/Work Statement
RFP No. HSHQDC-14-R-00083
SECTION 3 – DESCRIPTION/SPECIFICATIONS/WORK STATEMENT
INTRODUCTION
3.1 Background
The Domestic Nuclear Detection Office (DNDO) was established within DHS on April 15, 2005, with the President’s signature under National Security Presidential Directive-43/Homeland
Security Presidential Directive-14 (NSPD-43/HSPD-14). DNDO’s mission is to protect the
United States, its people, territory, and its interests against the unauthorized importation, possession, storage, transportation, development, or use of an unauthorized nuclear explosive system, fissile material, or radiological material and protect against attacks using such systems or material.
DNDO is responsible for procuring radiological/nuclear detection systems for all DHS components. Under the authority of the SAFE Port Act of 2006, DNDO is mandated to “serve as the primary entity of the United States Government to further develop, acquire, and support the deployment of an enhanced domestic system to detect and report on attempts to import, possess, store, transport, develop, or use an unauthorized nuclear explosive system, fissile material, or radiological material in the United States.”
3.2 Mission and Objectives
DNDO is interested in procuring “Non-Developmental,” “Commercial” or “Commercially
Available Off-the Shelf (COTS)” system(s) as defined in the Federal Acquisition Regulation
(FAR) Part 2, which meet the requirements identified in the HPT Requirements Traceability
Matrix (RTM) at Attachment 1. Offerors responding to this Solicitation shall provide supporting documentation that their proposed system is a COTS or commercially available system.
HPT systems must be capable of detecting and identifying radiation/nuclear (R/N) threats, storing the identification results, and communicating results in real-time (wired and/or wireless) to ReachBack. In addition, HPT systems designed to be worn by officers and agents must support the need for personal protection from exposure to R/N threats.
The HPT requirements are based on a combination of the American National Standards Institute
(ANSI), American National Standard Performance Requirements for Spectroscopic Personal
Radiation Detectors (SPRDs) for Homeland Security, ANSI 42.48, May 23, 2008 and
Component unique requirements. The DHS Components with the largest potential requirements for HPT systems are the United States Coast Guard (USCG), the United States Customs and
Border Protection (CBP) and the Transportation Security Administration (TSA).
The HPT RTM (Attachment 1) defines threshold and objective requirements, with a subset of the requirements designated as “High Priority.” High priority requirements are equivalent to key performance parameters (KPPs), and deemed essential or critical for an effective system.
Specific HPT requirements are designated as “Maritime Only” in support of the USCG and other maritime users. DHS reserves the right to award more than one ID/IQ contract, potentially procuring a HPT Baseline System and a HPT Maritime System.

4.3 Branding/Marking
The Offeror shall comply with the requirements of any DHS Branding and Marking policies. As a matter of law, Federal criminal statutes prohibit unauthorized uses of the DHS Seal. In addition, DHS policy prohibits granting authorization for certain commercial uses of the Seal. It is permissible to reference DHS in materials if the reference is limited to true, factual statements.
The words DHS and/or Homeland Security should appear in the same color, font, and size as the rest of the text in the document. Moreover, such references shall not imply in any way an endorsement of a product, company, or technology.
Requests to use the DHS seal shall be submitted using DHS Official Seal Usage Approval, available from the COR. The Comments section should be used to describe why use of the seal is being requested, and how it will be used. Completed forms should be sent via e-mail to
Kathleen.McShea@hq.dhs.gov, DHS Director of New Media & Web Communications, and to the CO, with a copy to the COR.

SECTION 6 – DELIVERABLES OR PERFORMANCE
6.1 Task Order Term
“Task Order” typically refers to a procurement of services, and “Delivery Order” typically refers to a procurement of supplies, however in this Solicitation the term “Task Order” will be used to refer to orders of both supplies and services. Task Orders issued under this contract are not coterminous; that is, they do not all have common start and end dates, but may be issued at various times as needed throughout the contract term.
6.2 Period of Performance
The ID/IQ shall consist of a five (5) year ordering period as shown below.
ID/IQ Period Ordering Period

SECTION 7 – CONTRACT ADMINISTRATION DATA
7.1 Authorized Users
As a Strategic Sourcing Initiative, all DHS Components are authorized to place Task Orders under this contract. In addition, DHS reserves the right to place orders under this contract for the benefit of other Federal agencies as a servicing agency under an interagency agreement or for other agencies and institutions as permitted by law.
7.2 Contracting and Administrative Authority
The following subsections describe the roles and responsibility of individuals who will be the primary points of contact for the Government on matters regarding contract administration. The
Government reserves the right to unilaterally change any of these individual assignments at any time.
7.2.1 Contracting Officer (ID/IQ Level)
The ID/IQ Level Contracting Officer is the only person authorized to approve changes in any of the requirements under this contract. Notwithstanding any clause contained elsewhere in this contract, the said authority remains solely with the Contracting Officer. In the event the Offeror effects any change at the direction of any person other than the Contracting Officer, including any change beyond the scope of authority given to the duly authorized Contracting Officer’s
Representative identified in the contract, the change will be considered to have been made without authority and no adjustment will be made in the contract cost to cover any increase in charges incurred as a result thereof. The Contracting Officer has the authority to perform any and all post-award functions in administering and enforcing this contract in accordance with its terms and conditions.
7.2.2 Contracting Officer’s Representative (ID/IQ-level)
The ID/IQ Contracting Officer’s Representative (COR) is responsible for administering the performance of work under this contract. IN NO EVENT, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms and conditions of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
The COR may give technical direction to the Offeror that fills in details, requires pursuit of certain lines of inquiry, or otherwise serves to facilitate the Offeror’s compliance with the contract. To be valid, technical direction by the COR:
• Must be consistent with the general scope of work set forth in this contract;
• May not constitute new assignment of work nor change the expressed terms, conditions, or specifications of this contract; and
• Shall not constitute a basis for any increase in the contract’s estimated cost, or extension to the contract Task schedule or period of performance.
In the event any Government technical direction is interpreted by the Offeror to fall within the clause of this Contract entitled “CHANGES”, the Offeror shall not implement such direction but shall notify the Contracting Officer in writing of such interpretation within ten (10) working days after the Offeror’s receipt of such direction. Such notice shall:
Include the reasons upon which the Offeror bases its belief that the technical direction falls within the purview of the “CHANGES” clause; and include the Offeror’s best estimate as to the revision of the current cost, fee, performance time, Task schedules or any other contractual provision that would result from implementing the COR’s technical direction.
If, after reviewing the information presented by the Offeror, the Contracting Officer is of the opinion that such direction is within the purview of the “CHANGES” clause and considers such change desirable, a unilateral direction will be issued to the Offeror to proceed pursuant to the authority granted in that clause. If a determination is made that such direction is technical direction authorized by this schedule clause, the Offeror will be directed to proceed with the implementation of such technical direction.
In the event a determination is made that it is necessary to avoid a delay in performance of the
Contract, the Contracting Officer may direct the Offeror to proceed with the implementation of the technical direction pending receipt of the information to be submitted by the Offeror. Should the Contracting Officer later determine that Change direction is appropriate; the written direction issued hereunder shall constitute the required Change direction.
Failure of the Offeror and the Contracting Officer to agree on whether Government direction is technical direction or a Change within the purview of the “CHANGES” clause of this contract shall be a dispute concerning a question of fact within the meaning of the Section I Clause entitled “DISPUTES”.
7.2.3 Task Order Contracting Officer (TO CO)
The Task Order Contracting Officer (TO CO) resides within the ordering activity and will be identified on an individual order. The TO CO is authorized to:
(1) Issue Task Orders.
(2) Complete any and all administrative contractual actions with the Offeror concerning those Task Orders issued by their office.
(3) Terminate Task Orders, issued by their office, for convenience and cause and cancel
Task Orders with no additional cost to the Government.
7.2.4 Task Order Contracting Officer Representative (TO COR)
TO COs may designate CORs for individual Task Orders that will be responsible for the day-to-day coordination of the Task Order.
