Justification for Other Than Full and Open Competition Under 10 U.S.C. 2304 (c)(l)
Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:
1. Agency and Contracting Activity. The United States Coast Guard (USCG), Command, Control, Communications, Computer and Infonnation Technology Service Center (C4ITSC), proposes to enter into a contract on a basis other than full and open competition.
2. Nature and/or Description of the Action being Approved. The USCG has a requirement for telephone system support and replacement. The requirement includes lifecycle support (materials and services) for a large aggregate of legacy Avaya telephone systems. The Brand name portion of the overall requirement is provided:
(a) Type of action: Firm Fixed-Price (FFP) orders under an Indefinite Delivery Indefinite Quantity (IDIQ);
(b) Amount: $3,250,000;
(c) Type of funding: AFC-42 Command, Control, Communications, and Electronics Engineering;
(d) Year of funding: 2017, 2018, 2019, 2020, and 2021; and
( e) The USCG anticipates a competitively awarded single -source Indefinite Delivery/Indefinite Quantity (IDIQ) to a vendor who is an authorized reseller of the proposed replacement /recapitalization equipment and that is a certified Avaya Federal Business Partner in good standing who is authorized co-delivery and service in the nationwide territory or who has a team member with the required certification.
3. Description of Supplies/Services. The Command, Control, Communications, Computer and Information Technology Service Center (C4ITSC) Enterprise Information System Infrastructure Product Line (EISI-PL) requires life-cycle support of all USCG telephone systems. This includes over 400 shore locations that include large and small military bases and over 200 cutters (ships) located throughout the Continental United States, Alaska, Hawaii, and the territories of the United States.
IDIQ Contract HSCG79-11-D-PT2023 was competitively solicited as a 100% small business set-aside (with non-manufacturing rule) and awarded to HMS Technologies Inc.
on 02/10/2011. Contract HSCG79-11-D-PT2023 was developed to streamline and
SOURCE SELECTION INFORMATION SEE FAR PART 2.10 I and 3.104 combine the separate telephone system support contracts managed by the former Pacific and Atlantic Maintenance and Logistics Commands. At that time, the USCG had several different manufacturer phone systems including, but not limited to, eOn Communications, Nortel, Norstar, Comdial, and Mitel. Concurrent to the award to HMS Technologies, who was an Avaya Business Partner, Avaya acquired Nortel's Enterprise Solution Business out of bankruptcy. Over the life of the current IDIQ contract, the contractor has replaced obsolete and end-of-life phone systems with current systems. Avaya (or legacy Nortel) manufactured the majority of existing telephone systems in the USCG inventory. A certified Avaya Federal Business Partner is the only assembly of vendors capable of providing direct parts and software support of all of the phone systems the USCG currently uses, including IP Office, CM-6, and CS 1000 (Including the associated voicemail and contact center systems, which include but are not limited to Avaya Aura Contact Center, Call Management System, and Contact Center Elite.).
Anticipated cost for the brand name materials and services over the five (5) year ordering period for direct parts and software support of current systems is $3,250,000 of the $30M total estimated value of the overarching IDIQ.
Description of Portion Peculiar to One Manufacture
Direct parts and software support of existing telephone systems.
Estimated Cost
$3,250,000
The amount of the brand name portion is based off actual charges incurred from historical data and previous IDIQ contracts (HSCG79-l 1-D-PT2023 and HSCG79-16-D-PT2065).
4. Identification of Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority pennitting other than full and competition is 10 U.S.C. 2304(c)(l) implemented by the FAR 6.302-l(c), "brand name description," specifically FAR 6.302-l(c)(l)(ii)(A)."
5. Demonstration that the Nature of the Acquisition Require Use of the Authority Cited.
The USCG phone systems support approximately 30,000 end-users using fifty (50) CSIOOO (Nortel) telephone systems, eight (8) Avaya CM-6 telephone systems, and over 200 Avaya IP Office telephone systems. A certified Avaya Fed·eral Business Partner in good standing who is authorized co-delivery and service in the nationwide territory for Avaya systems is required to maintain the existing USCG phone systems. An Avaya Business Partner is required to renew annual original equipment manufacturer (OEM) support contracts that allow the USCG to receive manufacturer support for technical assistance, software patches, bug fixes, and software upgrades. The USCG's existing Avaya phone systems will be unsupportable without support from an Avaya Business Partner as only business partners are authorized by the OEM to perform co-delivery and various services to Avaya systems.
6. Description of Efforts Made to Ensure that Offers are Solicited from as Many Potential Sources as is Practicable. It is intended the USCG will conduct a Total Small Business Set-Aside to Prime vendor who, if not themselves, have a team member who is a certified Avaya Federal Business Partner in good standing who is authorized co-delivery and service in the nationwide territory. The primary products being acquired and serviced under this NAICS Code (334210) are on the Small Business Administration's Nonmanufacturing Rule List of Class Waivers dated 1 January 2015, making this requirement eligible for a set-aside per FAR 19.102(f)(4). In that this acquisition allows the prime to obtain a single team member that will provide the Avaya Federal Business Partners support, multiple small businesses will be able to provide these required services along with their proposed phone replacement solutions. IA W FAR 6.302-l(c)(l)(ii)(C), the justification will be posted with solicitation HSCG79-l 7-R-PT2002.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable. The anticipated costs will be fair and reasonable as the contracting officer fully anticipates competition and in addition there are multiple commercial pricelists available and historical data that can also be used to make the determination.
8. Description of Market Research. Market research has been ongoing since the initial RFI was posted to FedBizOpps on 11/13/2014. The latest market research was completed for contract HSCG79-16-D-PT2065 in July of2016 and shows that there are multiple small businesses that are or could team with an authorized Avaya Business partner. In addition, examination of the existing strategic sourcing vehicles resulted in a determination that they are all IDIQ's or BPA's and the USCG would be unable to award the required overarching single award IDIQ and are therefore deemed out of scope. Given that multiple small businesses have expressed an interest in this acquisition, a small business set-aside is appropriate for this action.
9. Any Other Facts Supporting the Use of Other· Than Full and Open Competition. The USCG anticipates a competitively awarded contract to a Prime vendor that is either a certified Avaya Federal Business Partner in good standing who is authorized co-delivery and service in the nationwide territory or has a member of their team that is certified.
However it is mandatory for the USCG to maintain its existing systems and therefore this "Brand Name" requirement is justified.
10. A Listing of the Sources, if Any That Expressed, in Writing, an Interest in the Acquisition. The following vendors have formally expressed interest in this acquisition: Windstream Communications, Little Rock, AR; Federal Technology Solutions, Corona, CA; Redcom Laboratories, Victor, NY; Microtechnologies, Vienna, VA; Certified Communications Solutions, Elizabethtown, KY; Mission Critical Solutions, (MCS), Tampa, FL; Optivor Technologies, Annapolis Junction, MD; Strategic Products & Services (SPS), AT&T Government Solutions, Vienna, VA; Parsippany, NJ; American Systems, Chantilly, VA; Sunturn Inc., Columbia, MD; Chief Technologies, Leesburg, VA; Communications Products (CPI), Indianapolis, IN; TWD & Associates, McLean, VA; Black Box Network Services, Herndon, VA. In addition, the contracting officer has fielded numerous calls from multiple businesses requesting a status on the solicitation and expressing a continued interest in the acquisition.
11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required. The USCG is currently identifying future goals and objectives for the recapitalization of the USCG phones systems at large. One option is to deploy and transition to an enterprise VoIP solution. An enterprise VoIP would remove barriers to competition. The enterprise VoIP is a strategic decision that is being evaluated and will have a major impact on the future of the USCG telephony systems. Until an enterprise VoIP or other system is implemented, the current USCG Private Branch Exchange (PBX) telephony system will need to be properly maintained and supported. In addition, this acquisition allows for a prime vendor to propose, competitively, any replacement phone system it deems meets the specifications and requirements while supporting the legacy systems.
