ADDEDNUM TO STANDARD FORM 1449

SCHEDULE OF SUPPLIES/SERVICES

CLIN 0001 - CNC Horizontal Boring and Milling Machine – Contractor shall supply one (1) each CNC horizontal boring and milling machine meeting the MINIMUM functional, performance, and operational characteristics identified in the attached Statement of work, Attachment 1. The price proposed shall include all costs associated with delivering the machine to Baltimore, MD.

CLIN 0002 – Technical Support – Contractor shall provide on-site technical support for delivery and installation of the

CNC horizontal boring and milling machine in accordance with the attached Statement of Work (SOW). The price for this

CLIN shall be the fixed price the Government is obligated to pay for a standard eight (8) hour workday.

CLIN 0003 – Maintenance Manuals and Drawings– Contractor shall supply a standard commercial maintenance manual and electrical, mechanical, and foundation drawings for the CNC horizontal boring and milling machine.

CLIN 0004 – Training – Contractor shall provide on-site operation, maintenance, and troubleshooting training, for up to seven (7) Operators in accordance with the requirements identified in the attached Statement of Work (SOW). The price for this CLIN shall be the fixed price the Government is obligated to pay for a standard eight (8) hour workday.

Training shall not exceed five (5) days.

If travel is required during performance of these CLINs, the Contractor shall, to the maximum extent practicable, minimize overall travel costs by taking advantage of discounted airfare rates available through advance purchase.

Charges associated with itinerary changes and cancellations under nonrefundable airline tickets are reimbursable as long as the changes are driven by work requirement. Travel performed for personal convenience or daily travel to and from the contractor’s normal work site shall not be reimbursable. Cost for transportation, lodging, meals, and incidental expenses incurred, shall be reimbursed in accordance with the FTR and FAR 31.205-46. The USCG shall not reimburse indirect costs such as G&A, burdens, miles on personal car to and from the airport, or labor costs to and from the travel destination. Contractors shall be required to submit all receipts to be reviewed and approved by the Contracting

Officer prior to submitting invoices for reimbursement.

PACKAGING AND MARKING

PRESERVATION, PACKAGING, AND MARKING

The CNC machine to be delivered under this contract shall be individually preserved, packaged, and marked in accordance with standard commercial practices. Shipping containers shall be suitable for handling with a forklift truck or crane. Any loose components intended for use during installation shall be packaged together, labeled for their intended use, and packaged within the equipment unit container.

Each container shall be marked, in legible black lettering, with the following information:

PACKING LIST

All material shipped or delivered to the U.S. Coast Guard Surface Forces Logistics Center under this contract must be accompanied by an itemized packing list that clearly identifies all contents within the container including stock number, item name, part number, contract number, quantity, and unit of issue.

MARKING OF WARRANTED ITEMS

The contactor shall stamp or mark the supplies delivered, or otherwise furnish notice with the supplies, of the existence of the warranty. Markings may be brief but should include (i) a brief statement that a warranty exists; (ii) the substance of the warranty; (iii) its duration; and (iv) whom to notify if the supplies are found to be defective. For commercial items, the contractor’s trade practice in warranty marking is acceptable if sufficient information is presented for supply personnel and users to identify warranted supplies.

NOTE

Failure to prepare for shipment any item, and/or mark all packages, boxes, etc., as indicated herein shall result in rejection of the shipment and return of the shipment at the contractor’s expense.

INSPECTION AND ACCEPTANCE

52.246-16 Responsibility for Supplies APR 1984

U.S. COAST GUARD INSPECTION AND ACCEPTANCE (DESTINATION)

Inspection shall take place at destination and shall be contingent upon verification of no damage in transit, correctness and completeness of the order, and conformance to preservation, packaging, packing, and marking requirements. Final acceptance shall be contingent upon successful installation and operation of the machine.

FAR 52.246-15 CERTIFICATE OF CONFORMANCE (APR 1984)

(a) When authorized in writing by the cognizant Contract Administration Office (CAO), the Contractor shall ship with a

Certificate of Conformance any supplies for which the contract would otherwise require inspection at source. In no case shall the Government’s right to inspect supplies under the inspection provisions of this contract be prejudiced. Shipments of such supplies will not be made under this contract until use of the Certificate of Conformance has been authorized in writing by the CAO, or inspection and acceptance have occurred.

(b) The Contractor’s signed certificate shall be attached to or included on the top copy of the inspection or receiving report distributed to the payment office or attached to the CAO copy when contract administration (Block 10 of the DD

Form 250) is performed by the Defense Contract Administration Services. In addition, a copy of the signed certificate shall also be attached to or entered on copies of the inspection or receiving report accompanying the shipment.

(c) The Government has the right to reject defective supplies or services within a reasonable time after delivery by written notification to the Contractor. The Contractor shall in such event promptly replace, correct, or repair the rejected supplies or services at the Contractor’s expense.

(d) The certificate shall read as follows:

The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The

Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated.

Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the ward through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer may be determined unacceptable and may be rejected.

UNAUTHORIZED INSTRUCTIONS FROM GOVERNMENT PERSONNEL

(a) The Contractor shall not accept any instructions issued by any person employed by the U.S. Government or otherwise other than the Contracting Officer or the Contracting Officer’s Representative acting within the limits of their authority.

A Contracting Officer’s Representative shall be designated in writing to the Contractor and shall set forth the scope of their authority.

(b) No information, other than that which may be contained in an authorized amendment to this purchase instrument duly issued by the Contracting Officer, which may be received from any person employed by the Government or otherwise will be considered as grounds for deviation from any stipulations of the purchase instruments or referenced drawings and/or specifications contained herein.

REQUIRED STANDARD OF WORKMANSHIP

Unless otherwise specifically provided in this contract, the quality of all supplies and services rendered hereunder shall conform to the highest standards in the relevant profession, trade, or field of endeavor. All supplies and services shall be rendered or supervised directly by individuals fully qualified in the relevant profession, trade, or field, and holding any licenses required by law.

CONTRACTOR PERFORMANCE EVALUATION

The U.S. Coast Guard Surface Forces Logistic Center (SFLC) will monitor and evaluate the successful offerors past performance of this contract and prepare a Contractor Performance Assessment Report (CPAR) in accordance with FAR

Part 42.1502. All information contained in this assessment may be used, within the limitations of FAR 42.1502, by the government for future source selections and in accordance with FAR 15.304, when past performance is an evaluation factor for award.

CONTRACTOR PERFORMANCE EVALUATION

(a) GENERAL: The U.S. Coast Guard Surface Forces Logistic Center (SFLC) will monitor and evaluate the successful offerors past performance of this contract and prepare a Contractor Performance Assessment Report (CPAR) in accordance with FAR Part 42.1502. All information contained in this assessment may be used, within the limitations of

FAR 42.1502, by the government for future source selections and in accordance with FAR 15.304, when past performance is an evaluation factor for award.

(b) NOTIFICATION: Upon completion of the contract, the contractor will be notified of the assessment. The contractor will be allowed 60 days to respond to the SFLC’s assessment of its performance entered into CPARS. The contractor’s response, if any, will be made part of the CPAR system.

(c) INFORMATION: Information included in the CPAR may include, but is not limited to, the contractor’s record of conforming to contract requirements and to standards of good workmanship; the contractor’s record of forecasting and controlling costs; the contractor’s adherence to contract schedules, including the administrative aspects of performance; the contractor’s history of reasonable and cooperative behavior and commitment to customer satisfaction; the contractor’s record of integrity and business ethics, and generally, the contractor’s business-like concern for the interest of the customer.

(d) RELEASE OF DATA: CPARS information is considered business sensitive and will not be released except: (1) to other Federal procurement activities which request it; (2) when SFLC must release pursuant to a Freedom of

Information Act (FOIA) request; or (3) when prior written consent is requested and obtained from the contractor.

NOTE: Quotations that fail to follow these submission requirements may be determined unacceptable and may be eliminated from further consideration.

Quotations submitted in response to this solicitation shall demonstrate an understanding of and ability to meet all of the minimum functional, performance, and operational characteristics set forth in the Statement of Work. The Contractor shall demonstrate that the quotation is in compliance with ALL requirements, terms, and conditions of the solicitation.

General statements offered as the only evidence of compliance with the solicitation requirements, such as: the Contractor can or will comply with the solicitation requirements, that standard procedures and well known techniques will be used, or statements which paraphrase the solicitation requirement in whole or in part shall not be considered as compliance with the solicitation requirements and may constitute a basis for the rejection of the quotation. Any information provided may be selectively verified.

Quotations shall be prepared in such a manner as to enable personnel with general training to make a thorough evaluation and arrive at a sound determination as to whether or not the proposed equipment will satisfy the requirements of the government. In order to provide all necessary information for a comprehensive evaluation, all quotations must be complete, self-sufficient and respond directly to the requirements of the solicitation.

The contractor shall submit one (1) copy of the quotation. The quotation shall be presented in three (3) separate volumes and clearly marked as follows:

Volume I, Technical – Limited to fifteen (15) pages.

Volume II, Past Performance

Volume III, Price

Each volume of the quotation shall be clearly marked as to volume number, solicitation number, and the company name or logo with a point of contact with complete contact information including name, telephone number, and email address, clearly indicated. Pages within each volume shall be numbered consecutively within each volume.

All quotations submitted in response to this solicitation shall discuss the following:

VOLUME I - TECHNICAL CAPABILITY

Technical capability and is the ability of the Offeror to meet all material, performance, and operating characteristics identified in the Statement of Work and solicitation. Offeror’s must submit the following minimum information:

Descriptive literature to include cuts, illustrations, drawings, and brochures that clearly shows the proposed product’s characteristics, construction, and operation meets or exceeds the minimum requirements identified in the specification. Drawings may be submitted as electronic media (preferred) or paper copies. Electronic media must be in AutoCAD and at least Version 2009 or later.

One (1) copy of the Offeror’s complete standard commercial warranty.

Description of training to be provided, in accordance with the Statement of Work, to include materials to be provide and topics to be discussed.

PAST PERFORMANCE

Offerors are required to provide three (3) past performance references for contracts completed during the past three years or currently in process for the same items/services being requested under this solicitation. Contracts listed may include those entered into by the Federal Government, agencies of the state and local governments, and commercial customers.

Include the following information for each:

1. Name of Contracting Activity/Commercial Business.

2. Contract Number.

3. Contract Award Date.

4. Contract Completion Date.

5. Contract Value.

6. Two (2) customer points of contact and their daytime telephone numbers.

References other than those provided by the Offeror may be contacted by the Government to obtain additional information that shall be used in the evaluation of the offeror’s past performance.

FAR 52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (JUL 2013)

(a) Definitions. As used in this provision—

“Administrative proceeding” means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract

Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceeding at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.

“Federal contracts and grants with total value greater than $10,000,000” means—

(1) The total value of all current, active contracts and grants, including all priced options; and

“Principal” means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the

Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The

Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

A written award or acceptance of proposal mailed or otherwise furnished to the successful offeror within the time specified in the proposal shall result in a binding contract without further action by either party.

TECHNICAL EVALUATION

The offeror will be evaluated on the completeness of information submitted and the extent to which the proposed equipment meets or exceeds specification requirements.
