Request for Proposal Solicitation

HSCG38-12-R-H00007

NOTICE FOR FILING AGENCY PROTESTS

It is the policy of the Coast Guard to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accounting Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the Coast Guard as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman.

Informal forum with the Ombudsman. Interested parties who believe that a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the USCG Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester’s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth at FAR 33.103. If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to:

4.5 Unusual Damage

4.5.1 General

The Coast Guard intends that ALL components specified in the schedule will be shipped for overhaul within the firm-fixed prices established in the resulting contract. Occasionally, components may be received in a condition outside the confines of the applicable technical directives; those components may be determined “Unusually Damaged”. In order to be determined” Unusually Damaged”, a component must be received for routine overhaul and upon evaluation any one of the following conditions are discovered:

Obvious misuse Cannibalization Crash damage Note: Only components meeting one or more of the above criteria may be considered as Unusually Damaged. All other components shall be overhauled in accordance with the fixed overhaul prices accepted for contract award.

4.5.2 Unusual Damage Reporting Requirements

When a component is processed for Unusual Damage Evaluation, the Contractor shall within fifteen (15) calendar days of receipt of the item, submit an inspection condition report and overhaul price proposal, covering all parts and repairs needed to return the unit to satisfactory condition that meets all applicable AFTO specifications. The proposal shall contain the task order number, line item number, national stock number (NSN), part number (P/N), nomenclature, and serial number of the component, a listing of the replacement parts and/or material required, the time needed to effect the overhaul, and a cost breakdown including the cost of each required part and the number of labor hours. The hourly labor rate will be charged at the firm-fixed hourly labor rate contained in the Schedule of Supplies/Services. The Contractor’s delivery obligation shall stop from the date of notification that an item has been determined to be a candidate for “Unusual Damage Evaluation.” The delivery obligation will be specified in the task order modification and will apply only to those items specifically addressed by the modification. The Contractor is obligated to deliver all other components not individually addressed by the modification under the original delivery date specified on the task order. The proposal shall not include the work involved in the teardown and inspection, which will have already occurred, as this is covered by the firm-fixed price specified CLINs X002 for the Inspection/No Fault Found.

Within thirty (30) calendar days, the Contracting Officer shall either initiate negotiations for a firm-fixed price with the Contractor or deny authorization for the overhaul based on information in the report and any other information which may be available. Upon mutual agreement as to price and delivery, a task order modification will be issued to require overhaul at the agreed upon terms. If overhaul is not desired, the Contracting Officer will provide the Contractor with disposition instructions for the un-overhauled item. In the event an item is returned to the Government in a disassembled condition, the Contractor shall be entitled only to appropriate compensation for Inspection/ No Fault Found as specified in CLINs X002.

4.5.3 Cannibalized Units

Firm-fixed prices proposed in the Schedule of Supplies/Services for overhaul and upgrade and overhaul shall not include assemblies and components which have been cannibalized for repairable parts or severely damaged due to mishandling, crash damage, or acts of God. These items shall be evaluated at the firm-fixed-price specified in the Schedule of Supplies/Services for Inspection/No Fault Found. In the event any of the components listed in the Schedule of Supplies/Services are received in a condition that represents obvious cannibalization, misuse, crash damage or acts of God, immediate notification to the Contracting Officer is required. This notification shall include a detailed description of the noted deficiencies and shall reference the task order number, national stock number, part number, and serial number and is subject to the discretion of the Contracting Officer.

4.6 Service Bulletins, Modifications and/or Engineering Change Proposals

During the life of the Contract an Item may require incorporation of a Service Bulletin, a Modification or an Engineering Change Proposal. Either the Contractor or the Government may receive Notice from the OEM or other source of a required change. When the Contractor receives notice of a Service Bulletin, Modification and/or Engineering Change Proposal from the OEM, the Contractor shall immediately notify the Contracting Officer in writing and within thirty (30) calendar days submit a firm-fixed price proposal for an incremental charge to be assessed each time the Service Bulletin, Modification or Engineering Change Proposal is incorporated in a component. The same applies upon receiving written notice from the Contracting Officer of items requiring incorporation of a Service Bulletin, Modification and/or Engineering Change Proposal. The proposal shall contain a list of materials with associated prices, the number of labor hours required, turn-around-time needed to effect the Service Bulletin, Modification and/or Engineering Change Proposal and any impact on the contract delivery schedule. The Labor Rate shall be at the Firm-Fixed Labor Rates in X003 CLINS as applicable to the performance period. The incremental charge agreed to for incorporation of a service bulletin shall apply only to those components into which the Contractor incorporates a required service bulletin, not those into which the service bulletin has been previously incorporated. Upon mutual agreement of the incremental charge the Contracting Officer will issue a Contract modification and applicable Task Order modification to reflect the change and the service bulletin shall be incorporated into each subsequent component received at the Contractor’s facility if said service bulletin has not already been incorporated. The Contractor shall update the component’s data plate, if applicable, denoting the new part number, NSN, and/or modification number, and new Serial Number if one is assigned. The Contractor shall not incorporate Service Bulletins, Modifications and/or Engineering Change Proposals prior to receiving a Contract Modification and applicable Task Order modification.

4.7 Obsolete Parts or Processes

The Contractor shall use new parts meeting the requirements of specified Technical Orders, OEM specifications, or USCG specifications and/or drawings. In the event certain parts or processes become obsolete, the Contractor shall, within fifteen (15) calendar days after receipt of the assembly or component, notify the Contracting Officer in writing and submit (1) rationale and verification of any obsolete part or process, and (2) a written estimate of the effort required to make the overhaul. Such estimates shall include nomenclature, part number, cost and quantity of replacement parts, and total labor hours. The Contractor shall verify cost of part(s) with invoices or catalogs. The Contractor’s delivery obligation for the component(s) identified shall be suspended as of the date of the notice to the Contracting Officer. The Contracting Officer will, within thirty (30) calendar days of receipt of the Contractor’s written estimate make a written determination as to the disposition of the component. After receipt of the Contracting Officer’s disposition instruction, the Contractor shall have sixty (60) calendar days for delivery.

5.0 DELIVERY

5.1 Delivery Time

Required delivery for overhauled material is sixty (60) calendar days after receipt of material (ARM) at the Contractor’s facility. Earlier deliveries are acceptable provided there are no extra charges to the Government.

6.0 Government Furnished Material (GFM)

6.1 Requests for Government Furnished Material

The USCG reserves the right to provide to the Contractor Government Furnished Material (GFM) should it be determined to be in the best interest of the government. The Contractor shall provide all parts, labor, tooling, test equipment and facilities necessary to overhaul USCG owned Oxygen Regulators listed in the Schedule of Supplies/Services. The Contractor may receive equipment with components having a different part number than what is shown in the illustrated parts breakdown portion of a Technical Order. This does not necessarily mean the component(s) are incorrect parts. Suitable alternate/interchangeable part numbers are normally identified in a Technical Order (i.e., such as the Glossary). Prior to submitting a request for GFM due to equipment having an “incorrect” part, the Contractor shall first review the applicable Technical Order(s) to ensure it is in fact an incorrect part and not a suitable alternate and/or interchangeable part authorized in the Technical Order. Requests for GFM will be reviewed by the Government and a determination will be made to either furnish the requested material and adjust the monetary value of the Task order as applicable, or advise of its interchangeability/suitable alternate applicability. Requests for GFM shall be submitted in writing to the Contracting Officer with a brief narrative that supports the request.

7.0 Marking and Packaging of Shipment

7.1 Marking of shipments

The Contractor shall mark all shipments under this contract with the contract number. Further, the shipments shall be marked in accordance with the current edition of MIL-STD-129, “Marking for Shipping and Storage”. Failure to mark all packages, boxes, etc. may result in return of shipment at the Contractor’s expense.

7.2 Preservation, Packaging, and Packing

The Contractor shall preserve, pack, and package to ensure complete delivery at destination without damage or deterioration of the supplies due to the hazards of shipping, handling, or storage. Packaging, handling, shipping and transportation of material shall be in accordance with MIL-STD-2073-1D and ASTM D3951. In addition, because ALC is a supply depot, material will be stored and transshipped to various users. Therefore, material must be packed and labeled suitable for shipment via land, air or sea. Also, the following requirements apply:

a) Each individual item or unit must be individually packed in a separate crate.

b) Each individual container shall be labeled on the outside with National Stock Number (NSN), Bar Code of the National Stock Number, Part Number, Serial Number, Quantity, Nomenclature, Contract Number, Task order Number and Line Item Number.

c) The internal packaging material shall be sufficient to prevent damage during shipment, handling and storage. Preservation protection must be sufficient to prevent corrosion, deterioration or decay during warehouse storage for a period of one year.

d) Packaging material shall NOT consist of the following: popcorn, shredded paper, Styrofoam of any type or peanut style packaging.

e) Only Bar Coding of the National Stock Number is necessary.

f) When the AOG clause is invoked, the outside of the shipping container will be marked in highly visible lettering “AOG”.

g) The Contractor shall remove the unserviceable tag, DD Form 1577-2, from the components.

7.2.1 Durability

The Contractor shall ensure that all components, when packed in shipping containers or packaging, will be capable of being transported on standard transportation systems, commercial, or military carriers. The Contractor agrees that any item damaged in shipment from the Contractor will be repaired inclusive of this contract. The Contractor agrees to notify the Contracting Officer of the existence of any damaged and unusable shipping containers.

7.3 Warranty.

A minimum twelve-month warranty from the date of Government acceptance is required for any contract resulting from this solicitation.

7.3.1 Markings of Warranted Items

The Contractor shall stamp or mark the supplies delivered or otherwise furnish notice with the supplies of the existence of the warranty. Markings may be brief but should include:

a) A brief statement that a warranty exists.

b) The substance of the warranty.

c) Its duration.

d) Who to notify if the supplies are found to be defective.

For commercial items, the Contractor’s trade practice in warranty marking is acceptable if sufficient information is presented for supply personnel and users to identify warranted supplies.

8.0

INSPECTION AND ACCEPTANCE

8 .1 Material Inspection and Receiving Report At the time of each delivery for supplies or services under this contract, the contractor shall prepare and furnish to the government a properly completed commercial packaging slip in accordance with the procedures set forth in the paragraph Packaging and Slips.

8.1.2 Inspection and Acceptance

Inspection and Acceptance shall be performed by ALC’s Quality Assurance department.

8.2 Airworthiness or Conformance Certification

8.2.1 Airworthy and Suitability

All aircraft parts ordered, serviced, modified, repaired, and/or overhauled shall be airworthy and suitable for installation on USCG aircraft.

8.2.2 Required Certificates There are two (2) separate Certificate requirements: 1) an Airworthiness Certificate using either the FAA 8130 Certificate or an Equivalent using the same or similar format and language used for commercial/civil aviation industry, and 2) Certificate of Conformance in accordance with Federal Acquisition Regulation (FAR) clause 52.246-15.

1) Airworthiness Certification is required for all items that are overhauled. The contractor MAY use the FAA 8130 Certification Form, however use of this form is not “required”. The contractor may choose to use an "equivalent" Airworthiness Certificate to certify the airworthiness of an overhauled component. An equivalent Airworthiness Certification can be the same as used for other Government agencies such as an Air Force Airworthiness Certificate or a contractor developed Airworthiness Certificate that is equivalent to the FAA 8130 form. If an FAA 8130 "equivalent" is used, the Contractor shall provide written evidence with the Airworthiness Certificate that the Certification was performed by a qualified individual and include the individuals name and title. At the request of the Contracting Officer, the contractor shall provide proof of his/her qualification.
