JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (J&A)
Network Analyzer Refresh FY19
NITYU19AV373
1. Identification of the agency and the contracting activity and specific identification of the document as a
“Justification for an Exception to Fair Opportunity.”
a. Requiring/Requesting Activity
XXXXXXXXXXX
XXXXXXXXXXX
8899 East 56th Street
Indianapolis, IN 46249
b. Contracting Activity
DFAS Columbus
Contract Services Directorate
Building 21, Room 2B218
3990 E. Broad Street
Columbus, OH 43213-1152
2. Nature and/or description of the action being approved:
The purpose of this document is to obtain approval for items particular to one manufacturer (NETSCOUT) acquisition in accordance with FAR 16.505(b)(2)(ii)(B). Competition is limited to vendors supplying the following brand names:
NETSCOUT.
The procurement strategy is to issue a request for quote (RFQ) on the NASA Solution for Enterprise-Wide
Procurement (SEWP), and the fair opportunity procedures set up by the SEWP will be followed. According to those procedures, a request for quote (RFQ) with a brand name requirement must include a justification and approval and be submitted to all applicable SEWP Contract Groups. The order at issue includes brand name requirements. Therefore, the below justification and approval will be included with the RFQ, which will be submitted to all applicable SEWP
Contract Groups.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value):
This procurement is for the replacement of outdated equipment that will reach its end of life September 25, 2019.
DFAS I&T Infrastructure & Production Support (IPS) requires the procurement of hardware and software solution for the Enterprise Local Area Network (ELAN) Sniffer replacement project. For the purposes of this requirement, certain
Netscout brand name parts are required. DFAS IPS requires a network performance and analysis toolset that utilizes a central web portal, which provides a dashboard for services, session, and packet analysis. DFAS IPS also requires a portable analysis tool that integrates seamlessly with the purchased toolset in order to minimize confusion and enhance diagnostics capabilities.
DFAS IPS requires a solution which meets all these essential features listed below:
Must be UNIX based appliance for both hardware and virtual appliances in order to integrate with the current system
Must be able to meet DOD STIG (Security Technical Implementation Guide) compliance
Must integrate packet capture products into a central web portal/dashboard
Must have the ability monitor services and provide threshold alerting
Must provide hardware with 1G and 10G options
Must provide hardware with expanded storage capabilities
Must provide expanded mirroring capabilities utilizing 1GE or 10GE ports, up to 24 ports
Must provide a portable unit with WiFi analysis that integrates with the solution
Appliances must be on the DOD APL
DFAS IPS requires purchase and maintenance support for one year plus four option years for items listed in the bill of materials. Based on the average of the quotes received, the estimated cost of this requirement is:
Base Year XXXXXXXXX 07/01/2019-06/30/2020
Option Year 1 XXXXXXX 07/01/2020-06/30/2021
Option Year 2 XXXXXXX 07/01/2021-06/30/2022
Option Year 3 XXXXXXX 07/01/2022-06/30/2023
Option Year 4 XXXXXXX 07/01/2023-06/30/2024
Total XXXXXXXXXXXX
4. Identification of the exception to fair opportunity (see 16.505(b)(2)) and the supporting rationale, including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited. If the contracting officer uses the logical follow-on exception, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g., in terms of scope, period of performance, or value).
Items peculiar to one manufacturer.
DFAS has performed extensive research on alternative products and found that only the Netscout solution meets its requirements listed in paragraph 3. The purpose of this justification is to obtain approval to proceed with a limited source acquisition of brand name product, Netscout. No other brand meets the DOD requirements.
A Request for Quote (RFQ) will be issued through NASA SEWP to Contract Holders in accordance with
NASA SEWPs Fair Opportunity Procedures. Accordingly, the exception in FAR 5.202(a)(6) applies.
5. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
In determining a fair and reasonable price, the Contracting Officer will evaluate the Independent Government
Cost Estimate (IGCE). Based on an RFQ issued against the NASA SEWP IDIQ vehicle it is anticipated the pricing will be fair and reasonable. The RFQ will be submitted through NASA SEWP. Price competition is anticipated in which the overall fair and reasonable determination would be made based upon the lowest priced Technically
Acceptable (LPTA) offer.
These items are available from multiple Value Added Resellers on the NASA SEWP schedule. Based on market research, it is anticipated that NASA SEWP pricing will be lower than open market pricing.
Availability and pricing information was sought from the following NASA SEWP RFI# 109526 with 4 option years of maintenance:
Base 4 Option years
XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX
XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX
XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX
XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX
Based on the average of the quotes received, the estimated cost of this requirement is XXXXXXX and the option year average of XXXXXXX was used for this procurement. The total of this procurement with the base year and all 4 option years is XXXXXXXXX.
6. Any other facts supporting the justification.
Nothing to add to this section that has not already been articulated within this justification document.
7. A Statement of actions, if any, the agency may take or remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made:
In order to remove or overcome barriers to competition in future acquisitions for this requirement the agency will work with the program office to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed on other than a name brand basis.
8. The contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
9. Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or requirements or other rationale for an exception to fair opportunity) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.
10. A written determination by the approving official that one of the circumstances in (b)(2)(i)(A) through (E) of this section applies to the order.
