JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (J&A)

19- CVTC Audio Video Hardware Maintenance

NITYU19RC173

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for an

Exception to Fair Opportunity.”

a. Requiring/Requesting Activity

DFAS I&T Infrastructure & Production Support

XXXXX XXXXXX

8899 East 56th Street

b. Contracting Activity

DFAS Columbus

Contract Services Directorate

Building 21, Room 2B218

3990 E. Broad St.

Columbus, Oh 43213-1152

2. Nature and/or description of the action being approved.

The purpose of this document is to obtain approval for an Items Peculiar to One Manufacturer (Brand Name) acquisition for maintenance services of existing audio visual hardware. In accordance with FAR 16.505(b)(2)(ii)(B), competition is limited to the brand names identified below in paragraph 3.

The procurement strategy is to issue a request for quote (RFQ) on the NASA Solution for Enterprise-Wide Procurement

(SEWP), and to follow the fair opportunity procedures set up by the SEWP. According to those procedures, an RFQ with a brand name requirement must include a justification and approval and be submitted to all four SEWP Contract Groups.

The order at issue includes a brand name requirement. Therefore, the RFQ will include the below justification and approval and be submitted to the appropriate SEWP Contract Groups.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

This requirement is for the purchase of maintenance services to maintain existing audio visual hardware located in four of the largest VTC rooms in DFAS. Specific brand name equipment in each location is listed below.

The contract will consist of a base period and four option periods not to exceed total of XXXXXXX

Cost estimate for the total planned acquisition and pricing arrangements:

Base period = 3/6/2019 – 3/5/2020, XXXXXX

Option Year = 3/6/2020– 3/5/2021, XXXXXX

Option Year = 3/6/2021– 3/5/2022, XXXXXX

Option Year = 3/6/2022– 3/5/2023, XXXXXX

4. Identification of the exception to fair opportunity (see 16.505(a)(4)) and the supporting rationale, including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited. If the contracting officer uses the logical follow-on exception, the rationale shall describe why the relationship between the initial order and the follow-on is logical .

General Exceptions used at DFAS for the fair opportunity process:

(a) FAR 8.405-6(b) - Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.

(a) Reason that this is sole source/brand name procurement (i.e., proposed contractor's unique qualifications, etc.):

The existing audio visual hardware is less than three years old and has not reached the end of support life. This equipment is no longer covered under the VTC maintenance contract. This procurement is for hardware maintenance and engineering services necessary to maintain the identified large meeting rooms and auditorium locations identified by DFAS. The vendor will provide engineering services to determine all room/system issues. If the issue is determined to be associated with the audio/visual equipment, the vendor will support with the Return Merchandise

Authorization (RMA) process and reinstallation. The vendor will configure and test all audio/visual equipment replaced. Since the equipment has already been purchased, installed and configured to work within the current system at DFAS it would be in the best interest of the Government to establish a contract that provides continuity of maintenance and engineering services on the existing equipment. Although the existing audio visual hardware is manufactured by specific companies, the audio visual hardware maintenance is available from multiple vendors on the

NASA SEWP schedule.

5. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The following is a high-level Government cost estimate:

Base period = 3/6/2019 – 3/5/2020, XXXXX

Option Year = 3/6/2020– 3/5/2021, XXXXX

Option Year = 3/6/2021– 3/5/2022, XXXXX

Option Year = 3/6/2022– 3/5/2023, XXXXX

Option Year = 3/6/2023– 3/5/2024, XXXXX

In determining a fair and reasonable price, the Contracting Officer will evaluate the Independent Government Cost

Estimate (IGCE). Based on an RFQ issued against the SEWP IDIQ vehicle, it is anticipated the pricing will be fair and reasonable, as determined under the terms and conditions of the RFQ to be submitted to all SEWP contract holders.

Additionally, price comparisons will also be accomplished from as many other sources as possible, including commercially as well as any Government-Wide Acquisition Contracts (GWAC) and the GSA Federal Supply

Schedules.

This audio visual hardware maintenance is available from multiple vendors on the NASA SEWP schedule. Based on market research, it is anticipated that SEWP pricing will be lower than open market pricing.

The contracting officer is confident in obtaining the best value for DFAS.

6. Any other facts supporting the justification.

http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/16.htm#P464_78748

Nothing to add to this section that has not already been articulated within this justification document. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

The quotes below were provided from NASA SEWP RFI 103947. Avg. quote XXXXXXXXX

Vendor Base Year Total of 4 Option Years Grand Total

XXXXXXXXXXX XXXXXXX XXXXXXX XXXXXXXX

XXXXXX XXXXXXX XXXXXXX XXXXXXXX

XXX XXXXXXX XXXXXXX XXXXXXXX

XXXXXXXX XXXXXXX XXXXXXX XXXXXXXX

7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.

Market research was conducted for the purpose of seeking as many potential sources as possible. Although there are specific manufacturers for the existing equipment, there are multiple vendors that provided maintenance services for this hardware available on the NASA SEWP Contracts. An RFQ will be posted on NASA SEWP. Competition will be sought among all authorized resellers for the best possible pricing. Market research has shown that audio visual hardware maintenance services are available in a competitive environment under NASA SEWP with Base plus 4

Option Years.

8. The contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
