DEPARTMENT OF DEFENSE
MISSILE DEFENSE AGENCY
5700 18th STREET
FORT BELVOIR, VIRGINIA 22060-5573
BRAND NAME JUSTIFICATION
FOR SIMPLIFIED ACQUISITION
EATON UPS EQUIPMENT AND RACKS
1. Introduction
The Missile Defense Agency Directorate for Test Resources, Range Infrastructure Division
(MDA/DTRR) has a requirement for uninterruptible power supply (UPS) equipment for the new
MDA Test Support Facility (TSF) used to support MDA flight tests at Wake Island. Due to specialized requirements and other limiting factors, MDA intends to specify a brand name source to meet this requirement. The estimated cost of this acquisition is
2. Statutory Requirements
According to FAR 6.302-1(c), an acquisition that specifies a brand name peculiar to one manufacturer does not provide for full and open competition and must be justified as such.
To ensure the requirements in FAR 6.305 are satisfied with respect to making justifications publicly available, this Brand Name Justification will be posted with the synopsis required by
FAR 5.101.
3. Brand Name Justification
Only Eaton UPS, batteries, and racks will meet the Government’s requirements. The equipment will be delivered to MDA in Huntsville, AL and will be shipped to Wake Island in the central
Pacific Ocean to support MDA flight test activities. The Eaton brand name is needed because:
(1) MDA currently uses the same Eaton UPS equipment and racks in the MDA Flight Test
Comms Facility at Wake Island, (2) personnel deployed to Wake Island to support flight tests are trained for Eaton UPS equipment, and (3) use of the same modular UPS equipment in both facilities reduces the risk to flight tests by enabling the rapid swapping of failed equipment, and
(4) the logistics supply chain is established to support Eaton UPS equipment. The cost and time required to retrain technicians and revamp the logistics supply chain to accommodate multiple makes and models of UPS equipment would be prohibitive and is not in the best interest of the
Government.
4. Determination
In accordance with FAR Part 13.106-1(a) (1) (i), the undersigned Contracting Officer hereby determines that the circumstances of this acquisition deem Eaton as the only available brand name. The Government will be mindful of opportunities to increase the potential for competition on future UPS equipment procurements.
