52.212-2 Evaluation--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

This acquisition will utilize the best value trade-off methodology to make an integrated assessment for a best value award decision. The evaluation factors are Corporate Experience and Knowledge, Past Performance and Price. Non-price factors are significantly more important than price. The Government intends to make an award without revisions. Award will be made to the responsible quoter whose quotation provides the best value to the Government.

Factor 1 – Technical The Government will evaluate the Quoters ability to demonstrate, in a written narrative, the extent to which it satisfy the OEA requirements, with specific regard to the required software and equipment as outlined under “CONTRACTOR QUALIFICATIONS/REQUIREMENTS” of the SOW. The Government will also evaluate the Quoters ability to demonstrate, in writing, established production knowledge of the Department of Defense and demonstrate the extent to which it is familiar with the base realignment and closure process, compatible land use issues, and Defense industry adjustment and economic development.

The Government will evaluate the merits of the submission for Factor 1 - Technical using the following adjectival ratings and definitions scale:

Adjectival Rating
Definitions
Excellent
The quotation exceeds requirements in a manner beneficial to the Government and demonstrates an exceptional understanding of the goals and objectives of the acquisition. One or more strengths exist and there are no weaknesses present. Risk of unsuccessful performance is very low.
Good
The quotation meets all minimum requirements and demonstrates a comprehensive understanding of the goals and objectives of the acquisition. One or more strengths exist and the strength(s) outweigh any weaknesses present. Risk of unsuccessful performance is low.
Acceptable
The quotation meets all minimum requirements and demonstrates an acceptable understanding of the goals and objectives of the acquisition. Proposal/quotation offers no additional benefits beyond the stated requirements and no significant weaknesses exist. Risk of unsuccessful performance is moderate.
Marginal
The quotation demonstrates a fair understanding of the goals and objectives of the acquisition but fails to meet all minimum requirements. Weaknesses outweigh any strengths that exist. Some revision(s) are required for minimum acceptability. Risk of unsuccessful performance is high.
Unacceptable
The quotation fails to demonstrate an understanding of the goals and objectives of the acquisition and fails to meet all minimum requirements. The quotation has one or more significant weaknesses that will be very difficult and/or impossible to correct. Major revision(s) are required for minimum acceptability. The proposal/quotation is unawardable.

Factor 2 - Past Performance The Government will evaluate the relevancy and quality of each past performance reference and assign an overall confidence rating to the body of past performance information reviewed:

Relevancy: Relevancy is a measurement of the extent of similarity between the current requirement in terms of scope (types of tasks), magnitude (dollar value), and complexity.

Quality: The quality of past performance is determined by how well the quoter satisfied their customer’s needs in terms of schedule, performance requirements, resource management, and general customer satisfaction. The quality of an offeror’s past performance will be evaluated for each questionnaire or other source of past performance information that may be consulted.

The Government reserves the right to evaluate past performance based on data obtained from other sources. Quoters with no relevant past performance will not be rated favorably or unfavorably but will receive a neutral rating.

The Government will evaluate Past Performance using the following adjectival ratings and definitions scale:

Adjectival Rating Definitions

Substantial Confidence
Based on the Offeror’s recent (NLT 3 years) and relevant (similar in magnitude, complexity, and scope of this effort) performance record, the Government has a high expectation that the Offeror will successfully perform.
Satisfactory Confidence
Based on the Offeror’s recent (NLT 3 years) and relevant (similar in magnitude, complexity, and scope of this effort) performance record, the Government has a reasonable expectation that the Offeror will successfully perform.
Limited Confidence
Based on the Offeror’s recent (NLT 3 years) and relevant (similar in magnitude, complexity, and scope of this effort) performance record, the Government has a limited expectation that the Offeror will successfully perform.
No Confidence
Based on the Offeror’s recent (NLT 3 years) and relevant (similar in magnitude, complexity, and scope of this effort) performance record, the Government has no expectation that the Offeror will successfully perform.
Unknown Confidence (Neutral)
The Offeror does not have recent (NLT 3 years) and relevant (similar in magnitude, complexity, and scope of this effort) performance; or the Offeror’s performance record is so sparse, a meaningful confidence rating cannot be reasonably assigned.

During the course of the evaluation, the Technical Evaluation Team will record strengths, weaknesses, deficiencies, and clarifications for each of the non-price criteria. The definitions of these terms are as follows:

Term
Definition
Strength
An aspect of the quote that increases the likelihood of successful contract performance.
Weakness
A flaw in a quote that increases the risk of unsuccessful contract performance.
Significant Weakness
A weakness, or combination of weaknesses, that appreciably increases the risk of unsuccessful contract performance.
Deficiency
A material failure of a quotation to meet a Government requirement or a combination of significant weaknesses in a quotation that increases the risk of unsuccessful contract performance to an unacceptable level.
Clarification
Limited exchanges, between the Government and offerors that may occur when award without discussions is contemplated. Clarifications do not result in the submission of a revised quote.

Factor 3. Price Price: The price will be not be evaluated adjectivally, will be evaluated to determine if it is reasonable. Quoter shall provide pricing for CLINs, with the exception of Travel and Overtime which will be priced on a Not to Exceed (NTE) basis.
