Justification Review Document for Other than Full and Open Competition.
Control No: TBD
1. Contracting Agency: Defense Security Cooperation Agency (DSCA) DBO-CON.
2. Description of Action: Approval is being requested for modification of a current contract.
This is a fixed price contract using FMS administrative funds. There are no share, ceiling, fee, or profit arrangements. Current contractor has established, approved GSA labor rate categories. FY09 funds are to be used. The estimated total value of the modification is $300,000 ($275,000 for services and deliverables and $25,000 for travel).
3. Description of Supplies/Services: The services to be provided are to collect and report data on security cooperation personnel indicating the numbers of personnel by location and job category, collect training data on those personnel, and provide this information in a format suitable for metric analysis of the overall security assistance/security cooperation labor force. This task is similar to the current contract effort which established an international affairs professional certification tracking system, but goes beyond the scope of a voluntary system of data leading to an international affairs certification as it includes the entire labor force as opposed to only those who choose to apply for certification. Due to the similarity of effort and the contractor’s ongoing performance level, continuity of service is a factor in this request [FAR 52.237-3]. It is anticipated that this effort will take approximately two years to complete. Options for continuing support of the effort will be evaluated within the performance period.
4. Authority Cited: FAR6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
a. 6.302-1 (a) (2) (iii) (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or
b. 6.302-1 (a) (2) (iii) (B) Unacceptable delays in fulfilling the agency’s requirements.
(See 10 U.S.C. 2304(d)(1)(B) or 41 U.S.C. 253 (d)(1)(B).)
FAR 37.106(b) Funding and term of service contracts.
5. Reason for Authority Cited: The current contractor (Wedgewood Consulting Group) was competitively selected to perform the same basic type of work as is currently desired in FY 09 as well as in FY 06. They have extensive knowledge of the qualifications and training requirements of the security assistance/security cooperation workforce as well as extensive experience in tracking training and other requirements for the International Affairs certification program. The current requested contract modification is primarily expanding the current effort with more labor hours, some higher category labor categories and additional travel.
a. Additionally, this is a relatively “modest effort” - $300,000. A competitive selection at this point in the development would require extensive duplicative work by a new contractor and any benefits resulting from competition would likely be overcome by these additional costs and result in a higher cost to the USG.
b. Ref 4b. Above. Further, the delay noted above as a result of potential hiring of a contractor not familiar with the SA/SC community would result in implementation delays not consistent with the Direction of the Director, DSCA, and the Deputy Secretary of Defense direction to implement training enhancements and tracking of the security cooperation workforce within the year.
c. The identification of the newly expanded requirement of the DepSecDef and Director DSCA has been within the last few weeks and was not anticipated at the time when the competitive contract was awarded – Oct 2009.
d. The nature of the service provided – gathering data, formatting and entering the data, and producing statistical type outputs on the data is such that it is not feasibly severalble by fiscal year.
6. Efforts to obtain competition: As noted, a competitive source selection was held in FY 09 with only one other contractor responding to the solicitation. That source was deemed to be out of the competitive range due to excessive cost.
7. Actions to Increase Competition: If it is necessary to continue this enhanced effort beyond one (1) year, competitive sources will be sought.
8. Market Research: Identification of qualified sources was sought in the solicitation of May 2008 for the contract awarded in Oct 2008 (FY2009).
9. Interested Sources: As noted in 6. Above, only one other source responded to the solicitation and that source was deemed out of the competitive range. Further, their technical proposal indicating a lack of experience and comprehension of training requirements for the SA/SC workforce.
10. Other facts: None
11. TECHNICAL CERTIFICATION: “I certify that the supporting data under my cognizance which are included in this J & A are accurate and complete to the best of my knowledge and belief.
