4. FAR 52.212-2, Evaluation – Commercial Items, does not apply to this acquisition.

The Government will award one contract to the offeror with the lowest evaluated price, that is rated “acceptable” for the following factors: technical capability and past performance.

FAR Subpart 12.6 streamlined evaluation procedures and FAR Subpart 13.5 simplified procedures apply to this solicitation... Accordingly, the following factors will be used to evaluate quotations: Technical, Past Performance, and Price.

All quotes will be evaluated first on price. The lowest priced proposal’s technical and past performance will be evaluated for acceptability on an “Acceptable” or “Unacceptable” basis.

If the lowest priced proposal’s technical and past performance is found to be acceptable, then no further evaluations will be conducted and award will be made. If the lowest priced proposal’s technical and past performance is evaluated as ”Unacceptable,” the next lowest priced quote will be evaluated, and so on until a quote meeting technical and past performance requirements is found.

The quote with the lowest evaluated price rated “Acceptable” for the technical capability and past performance factors will be awarded a Requirements contract, and the Government will issue a task order for School Year 2017-2018 upon award. Issuance of a task order is at the sole discretion of the Government. The Government reserves the right to order less and/or more than the estimated quantities identified in Section B of the solicitation.

FACTOR 1 – TECHNICAL

The Government will evaluate the offeror’s technical capabilities to assess whether the offeror’s quote meets the Government’s requirements, and rated “Acceptable” or “Unacceptable” based on the following criteria:

1) Whether the quotation provides a sufficient explanation of the offeror’s technical experience and ability to meet the performance requirements as set forth in the Performance Work Statement (PWS).

2) The acceptability of the offeror’s technical approach to manage and perform the requirements of the solicitation, to include the offeror’s approach to supervision, staffing, recruitment, substitution, and replacement of qualified and properly licensed school bus drivers and administrative personnel to perform the requirements of the

PWS.

3) Meeting the requirement to provide current and valid business license issued by a local, state, or federal government agency or organization within Japan. Business license submitted in Japanese shall also have an English translation.

Rating Description Acceptable Quote meets the requirements of the solicitation.

Unacceptable Quote does not meet the requirements of the solicitation.

FACTOR 2 - PAST PERFORMANCE

The Government will evaluate the offeror’s past performance to assess the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance information that pertains to the services outlined in the solicitation requirements. Past performance will be rated on an “Acceptable” or “Unacceptable” basis.

Rating Description

Acceptable

Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below)

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: If an offeror is determined to have “Unknown” past performance, the “Unknown” past performance will be rated “Acceptable.”

FACTOR 3 – PRICE

1) Price will be evaluated based on the total price, including the base period and all option periods.

2) Price evaluation will not be given an adjectival rating.

3) Price will be analyzed for errors, omissions, and mistakes, and evaluated to determine whether it is fair and reasonable and indicates the offeror understands the work to be performed.

4) All referenced Contract Line Items (CLINS) 0001-0007, 1001-1007, 2001-2007, 3001-3007 and 4001-4007 will be evaluated to determine if prices are unbalanced. If analysis indicates pricing is unbalanced, the price quote may be rejected if it is determined to pose an unacceptable risk to the Government.

5) The Government will evaluate prices for award purposes by adding the total price for all options to the total price for the basic requirement in Section B. To account for the option period(s) possible under Clause 52.217-8 (maximum six months), Option to Extend Services, the Government will take the price for all CLINs of the final option period, prorate it to a six-month value, and add it to the sum of all CLINs (base plus all option periods). This amount, which includes the full six-month FAR 52.217-

8 option pricing, will be the total evaluated price. Evaluation of options does not obligate the Government to exercise the options.

52.216-19 ORDER LIMITATIONS. (OCT 1995)

(d) Notwithstanding paragraphs (b) and (c) above, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within three (3) days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
