SUMMARY OF CHANGES
SECTION SF 1449 - CONTINUATION SHEET
The following have been modified:
ADDENDUM TO FAR 52.212-2
ADDENDUM TO FAR 52.212-2
EVALUATION – COMMERCIAL ITEMS
1. BASIS OF AWARD: The Government will award one or more contract(s) resulting from this solicitation. An offeror may submit a proposal on one or more groups. One award will be determined per geographical group. It is possible for one offeror to receive one award for more than one group. The contract award (s) will be made on an “all or none” basis for commissary locations within each geographical group. The source selection methodology will be the Best Value Methodology, Lowest Price; Technically Acceptable (LPTA) source selection process. Offerors will only be considered for award where all required line items within a group are priced and all required information submitted. Contract award(s) will be made to the responsible offeror whose proposal conforms to the solicitation and will provide the best value to the Government.
2. GENERAL INFORMATION: The evaluation factors and respective sub-factors are as stated below:
A. TECHNICAL CAPABILITY (Maximum Points 100)
1. Experience
2. Distribution Plan
3. Production Capability
4. Quality Program
5. Additional Support/Promotion Plan
B. PAST PERFORMANCE (Maximum Points 100)
1. Product Delivery
2. Quality History
3. Customer Satisfaction/Business Relations
C. PRICE
(Note: The evaluation factor Price is not assigned points)
TECHNICAL CAPABILITY: The Technical Capability evaluation factor is the Government’s determination of whether an offeror possesses the technical capability to implement their proposed plans with an established viable plan of action. Technical capability will be based on the narratives submitted by the offeror demonstrating the firm’s technical capabilities, or other relevant technical facts and circumstances. The Technical Capability evaluation consists of five (5) sub-factors, Experience, Distribution Plan, Production Capability, Quality Program, and Additional Support/Promotion Plan. A minimum total of 60 points (technical score) must be earned for the evaluation factor to be considered satisfactory. Less than 60 total points (technical score) is considered unsatisfactory and your proposal may not be considered for contract award.
PAST PERFORMANCE: The Government will assess performance based on the offerors past performance history as it relates to the probability of successful accomplishment of the work similar to the requirements of this solicitation in both the commercial and military environments. Specifically, the Government is seeking to determine whether the offeror has demonstrated consistent delivering of complete orders of quality products in a timely manner while maintaining good customer service and professional business relationships. The Past Performance evaluation consists of three (3) sub-factors, Product Delivery, Quality History, and Customer Satisfaction/Business Relations. A minimum total of 60 points must be earned for the evaluation factor to be considered satisfactory. Less than 60 total points is considered unsatisfactory and your proposal may not be considered for contract award.
TECHNICAL ACCEPTABILITY: Technical Capability with a minimum total score of 60 points (technical score) and Past Performance with a minimum total score of 60 points (technical score) when combined for a minimum total technical score of 120 points are the evaluation factors that determine Technical Acceptability. Offerors’ proposals with at least the minimum technical scores for each factor or more will be ranked by price from highest priced to lowest priced for each geographical group. The Contracting Officer will make the source selection decision for contract award of each group based upon the responsible offeror with the lowest-priced, technically acceptable proposal.
3. EVALUATION OF PROPOSALS: The Government will assess the overall technical capability and past performance by documenting strengths, weaknesses, deficiencies, significant deficiencies, and material deficiencies of each technical proposal and performance history. The Government will rate the evaluation factors and respective sub-factors, assign points (technical score) to each sub-factor, as well assign overall cumulative points (technical score) for each evaluation factor. The offerors with proposals that meet or exceed the minimum total technical scores for each evaluation factor will be determined Technically Acceptable. The Technically Acceptable offerors will be ranked from highest priced to lowest priced per each geographical group. The responsible offeror with the lowest-priced, technically acceptable proposal will be the contract awardee for each group.
For the purposes of this solicitation, the following defines the descriptive findings used for the assessment of technical proposals:
· Strength is an attribute or quality of a proposed approach and past performance that exceeds the minimum Government requirements, and/or is considered advantageous to the Government.
· Weakness is a flaw in a proposal that is minor in nature representing little or no disadvantage to the Government. Weaknesses may not require addressing during discussions.
· Significant Weakness is a flaw in a proposal that appreciably increases the risk of unsuccessful contract performance. A significant weakness will be addressed if discussions are held, and an offeror will be provided the opportunity to make a correction.
· Deficiency is a material omission or failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. A deficiency will be addressed if discussions are held, and an offeror will be provided the opportunity to make a correction. If contract award is made without discussions, a deficiency in a proposal will render the entire proposal deficient and it will be removed from further consideration for contract award.
· Material Deficiency is a lack of understanding the basic intent of the acquisition that will likely result in unsatisfactory contract performance as well as material failure to meet the Government’s requirements. A materially deficient proposal lacks clear and convincing evidence to support the merit and feasibility of a proposal’s approach in meeting the Government’s requirements; or inconsistencies that indicate a lack of understanding of the scope of the requirements and a complete proposal revision will be required. A materially deficient proposal will be eliminated from further consideration for contract award.
In evaluating past performance, the Government may use the commercial business references provided by the offeror and other sources of information, including but not limited to: federal, state, and local government agencies, Better Business Bureaus, published media, and electronic databases. The Government will also consider in-house information available, such as, but not limited to: Contractor Performance Evaluations (DeCA Form 10-17), past performance surveys, non-conformance reports (DeCA Form 10-21), pricing statistics, emails, business review information, and correspondence on file regarding a contractor’s current DeCA contracts. Where the offeror’s relevant performance history indicates performance problems, the Government will consider the trends and severity of the problems and the appropriateness and effectiveness of any corrective action taken. If adverse information is obtained that has not been communicated to the firm, the offerors will be given an opportunity to respond.
4. PRICE: The Price evaluation factor is evaluated but is not assigned a point value. The prices submitted are analyzed per group for completeness, consistency, and to identify any irregularities. Offers will be considered for contract award where all mandatory line items within the proposed group are priced. The Government may reject any proposal where all line items within a group are not priced. An offeror may propose an alternate for consideration provided they have priced all of the required line items. The Government is not obligated to accept any alternate proposal. Offerors may submit pricing for any one group, or any combination of groups. Prices must be submitted for the base period of performance and each option year. Pricing must be FOB Destination for all stores within a group. If the Contracting Officer determines discussions are not necessary, contract award will be made from the initial price proposal. All proposals determined to be Technically Acceptable will be ranked from highest priced to lowest priced per geographical group.
5. EVALUATION OF OPTIONS: The Government will evaluate offers for contract award by conducting price analysis by group. The total price for each proposal will be calculated by adding the total price for the base period and all option years of all items. Evaluation of options will not obligate the Government to exercise the option(s). The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.
6. SOURCE SELECTION DECISION: The objective of the source selection process is to select the proposal(s) that represents the best value to the Government. The Contracting Officer (Source Selection Authority) will use best value methodology; lowest-priced, technically acceptable procedures to make the final source selection decision per geographical group. This process evaluates each proposal received in response to the solicitation and makes a determination whether each proposal is technically acceptable or not. All proposals determined to be technically acceptable will be ranked from the highest-priced to the lowest-priced per geographical group. The lowest-priced, technically acceptable proposal from a responsible offeror for each group will receive contract award. It is possible for one offeror to be awarded one, some, or all groups on one contract, however the source selection is determined by each geographical group. If the proposal is not determined to be technically acceptable, then the proposal will be eliminated from further consideration for contract award. The Contracting Officer may reject some or all proposals received in response to this solicitation, if the proposal does not meet the requirements of the solicitation and it is in the best interest of the Government to do so.
The Federal Awardee Performance and Integrity Information System (FAPIIS) is a tool designed to enhance the Government’s ability to evaluate the business ethics and quality of prospective offerors as well as identify responsible sources of supply. In FAPIIS, information specific to a prospective contractor may be found regarding criminal, civil, or administrative proceedings in connection with the award of a Government contract, terminations for default or cause, or determinations of non-responsibility because the contractor does not have a satisfactory performance record or a satisfactory record of integrity and business ethics, or comparable information relating to a grant.
In accordance with FAR 9.105-1, a determination of responsibility is required prior to issuing a contract award. If such information results in a determination of non-responsibility, the contractor will not be awarded the contract, and the non-responsibility determination will be entered in FAPIIS to assist other agencies in their responsibility determinations. However, offerors will be provided an opportunity to provide additional information that demonstrates their responsibility before the Contracting Officer makes a non-responsibility determination based on relevant information from FAPIIS. The determination of responsibility shall consider the information in FAPIIS and documented the official file folder.
7. NOTIFICATION: Notification of contract award(s) per group will be made to all active participants in the procurement. A written notice of contract award and/or acceptance of a proposal emailed, faxed, mailed or otherwise furnished to the successful offeror within the timeframe for acceptance specified in the proposal shall result in a binding contract without further action by either party. The Government may accept a proposal (or part of a proposal), whether or not there are negotiations after its receipt, unless the offeror submits a written notice of withdrawal to the Government that is received by the Government before contract award, and before the time for acceptance of the offer expires. Any proposal removed from further consideration for contract award will be made in writing and will provide an opportunity to request a debriefing.
