RFP HC102818R0102 Armed Guards Additional Question and Answer 26 September 2018

1. The requirement for "final" secret facilities clearance (FCL) is overly restrictive and can unreasonably limit competition under the set-aside programs.

RESPONSE: The Government has previously determined that this contract will require clearance up to the Secret Level. Without a FINAL Secret FCL, a Vendor’s DD254 cannot be signed and approved; without a DISA Security signed DD254, the Government cannot make an Award or initiate performance under this contract. There are no exceptions to this rule as this contract has been deemed to require up to the Secret level.

2. There are interim-steps in the FCL process that can allow a contractor without final FCL to perform until final FCL is granted. Given your stated performance start date, it would seem reasonable for the government to follow it's procedures and allow interim to final FCL-approval as an acceptable option versus limiting competition or creating pass-thru shell prime contractor to subcontractor relationships.

RESPONSE: Because of the reasons outlined under question 1 above, a FINAL Secret FCL is required at time of award. Additionally, Pass-through relationships are not allowable. Prime vendors must employ at least 50% of the workforce for any contract awarded as a small business set aside under any socio economic category.

3. Why are proposals due in October 2018 without starting work under a presumed contract until 1 June 2019. This is a lengthy proposal acceptance period that creates substantial risk for a contractor. In this case, the late performance start date may also present constraints on responses as well. Can you provide any insight for the proposal closing date and period of performance start?

RESPONSE: The timeline takes into consideration the Source Selection process and transition time. The Government plans to award prior to the June 1 start date to allow the awardee ample time to staff the contract prior to the Period of Performance start date.
