Justification and Approval For
Other Than Full and Open Competition
1. Contracting Agency: Defense Human Resource Activity- Procurement Support Office 4800 Mark Center Drive, Alexandria, Virginia, 22350.
2. Authority Cited: 10 U.S.C.2304(c)(1), FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements – BRAND NAME.
3. Description of Supplies and Services: DMDC requires preventive maintenance support for Xerox Printers currently located at DMDC – Seaside at 400 Gigling Road; Seaside, California 93955, DMDC – Mark Center 4800 Mark Center Drive, Ste 04E25, Alexandria, VA 22350, and DMDC – Beauregard, 1600 N. Beauregard, Alexandria, VA 22311.
4. Description of Action: A Firm fixed price contract is planned. The period of performance will include a 12-month base period and two 12-month option periods. FY14 Operating and Maintenance (O&M) funds are available for the base period.
5. Reason for Authority Cited:
a. The Government competed the original requirement through GSA in 2009. A follow-on maintenance contract (H98210-11-P-0034) was awarded in 2011 which expired on August 21, 2014. The warranty for these printers expired on August 13, 2010.
b. In order for the printers to maintain optimum performance, only certified authorized Xerox reseller technicians will satisfy the Government’s requirement. To replace the printers with any brand other than Xerox would require the Government to incur cost of approximately $150,000 and those costs cannot be recouped in a re-procurement action. DMDC does not seek to change the existing printers and infrastructure and only seeks continued maintenance support.
c. The market research determined that only authorized Xerox certified reseller technicians are the only ones capable of providing the required maintenance support against the locations described in paragraph 3.
6. Effort to Obtain Competition: This requirement will be electronically posted and interested Offerors will have fair opportunity to submit an offer.
7. Effort to remove barriers to/increase competition: DMDC is always considering which products supports its mission the best. DMDC’s mission has changed and evolved over time, and every day new technology emerges that is capable of supporting that mission. If it is decided that Xerox Printers no longer satisfies the Government’s requirements then the Government will search for a new solution, and re-compete the original requirement, and/or the new requirement.
8. Market Research: The market research included searching the internet for vendors that could support Xerox maintenance at multiple sites on both East and West Coasts and at three different locations.
