52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JUN 2020)
Paragraphs (a) thru (l) of Federal Acquisition Regulation (FAR) 52.212-1 are incorporated by reference:
Paragraph (m) Submission Instructions:
(1) All questions regarding this requirement shall be submitted electronically to julius.arrascuepasto@socom.mil by 30 AUG 2021 at 10:00 a.m. Pacific Standard Time
(PST).
(2) Quotes are due NLT 21 SEP 2021 at 7:00AM PDT/10:00 AM EDT. Quotes shall be emailed to shelly.pollock@socom.mil and christian.smith@socom.mil. Quote submissions shall cite at a minimum “H92240-21-T-0047 – Winter Gear” in the subject line of the email.
Offerors are responsible for verifying that quote submissions have been received for consideration.
(3) Quote Format and Content. Electronic quotes shall address the sections listed below.
Individual emails may not exceed 10 MB. Submissions with .zip files are not acceptable and will not be delivered by the government email server. The government server does not generate rejection notices and it may not forward a file if quarantined by the edge device. As such it is the vendor’s responsibility to ensure its quote is received. The quote page format will be 8 1/2” x 11” except for fold-outs used for charts, tables, or diagrams, which may not exceed 11” x 17”. A page is defined as one face of a sheet of paper containing information. Type shall not be less than 10 pitch. Elaborate formats or color presentations are not desired or required.
(4) ADMINISTRATIVE INFORMATION: Complete business address of the Offeror, the corporate name to be used on any resultant contract, and the remittance address if different from that above. If this name does not identify a "parent company" or sponsoring "corporation" name, also provide such identity, as appropriate.
(i) The Offeror’s Commercial and Government Entity (CAGE) Code and Dun & Bradstreet (DUNs) Number.
(ii) Name, telephone numbers and e-mail address of person(s) to be contacted for clarification or questions to the quote.
(iii) Offerors shall submit Representations and Certifications listed on the SF1449 at Federal Acquisition Regulation (FAR), 52.204-24, 52.204-26, 52.209-7 and 52.212-3 Alt. I.
Certifications are highlighted on the SF 1449 in YELLOW for ease of completion.
(5) TECHNICAL CAPABILITY. If the Offeror does not quote Brand Name products as outlined in Attachment 1 – Product Description, offerors shall clearly and adequately demonstrate that the proposed “or equal” items meet or exceed the salient characteristics specified in Attachment 1. Providing only the name and part number of the ‘or equal’ item may be considered insufficient and unacceptable.
For example, if quoting an equal product to “Bison GWS Expedition” sleeping bag (ELIN A001), offeror shall include the following information at a minimum: if it is rated at or below -40 degrees Fahrenheit, if the length is at least 72”, if the total packed weight does not exceed 5lbs., if the fabric is wind resistant, if the bag has a full collar, and if it is water resistant.
Offerors shall ensure proposed items meet or exceed requirements in accordance with Attachment 1 – Product Description.
(7) PRICE: The offeror shall complete and submit Attachment 2 – Pricing Worksheet (in MS Excel format), including providing the country of origin and lead time for each item (NLE 90 days). Items with lead times greater than 90 days may be considered unacceptable. Proposed unit pricing shall include any/all associated shipping charges. Partial shipments are authorized and shall be made to expedite receipt of items as soon as available to meet mission requirements.
In order to assist offerors, offerors shall populate the yellow shaded areas only.
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government intends to award a contract(s) resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
Factor 1 - Technical Capability. Quoted items shall meet or exceed the requirements outlined in Attachment 1 – Product Description. Items quoted on an “or equal basis” will be considered acceptable if the offeror adequately demonstrates that the item meets or exceeds the item description and salient characteristics outlined in Attachment 1 – Product Description. If quoting “or equal” products, offerors shall adequately demonstrate that those products meet or exceed the salient characteristics specified in Attachment 1. Providing only the name and part number of the ‘or equal’ product may be considered unacceptable.
Factor 2 – Price. All prices will be evaluated for reasonableness in accordance with FAR 13.106-3(a).
BASIS FOR AWARD: The Government intends to issue an award to the offeror(s) whose quote represents the best value to the Government. The Government’s preference is to make a single award from this combined synopsis/solicitation on an “all or none” basis (excluding Option items); however, the Government reserves the right to make multiple award(s) on a line item basis. Option items, as annotated in Attachment 1 and 2, are not included in the Government’s preference to make a single award on an “all or none” basis, but may be evaluated and exercised at the time of contract award if determined to be in the best interest of the Government. Award(s) will be made on the basis of technical capability and price. All pricing must be determined fair and reasonable prior to award. Award(s) for supplies will not be made to offerors with pricing that is determined to be unreasonable.
