About this file

This document contains questions and answers related to solicitation number H92240-21-T-0047 for winter warfare gear. The solicitation seeks fixed price quotes for various items of winter clothing and equipment, including parkas, balaclavas, tents, skis, and helmets. Key details include that the request was originally a small business set-aside but has been changed to full and open competition due to Berry Amendment requirements. Mounting of skis is not required, and the Team Wendy backcountry helmet is an acceptable alternative to the M216 model. H92240-21-T-0047 QUESTIONS & ANSWERS

1. QUESTION: On the Lightning Ascent tails item #13 what size tails would the end user like quoted 4” or 8”?

ANSWER: 8” tails

2. QUESTION: On the Balaclave item #11: What size would you like quoted: S/M or Lg/XL?

ANSWER: Lg/ XL

3. QUESTION: All items except for the 4-man tent are personal use items. Please confirm that it is the intent to purchase 133 total 4-man tents.

ANSWER: This was a typo. It should be 18 tents for SEAL Team 2 and 12 for SEAL Team 8, for a total of 30 tents. Attachments 1 (Product Description) and 2 (Pricing Worksheet) have been revised to include the correct quantities.

4. QUESTION: Are we permitted to offer multiple items for some lines, the one they want and then an alternative that we have available?

ANSWER: Quoters may quote multiple items for some lines. Per provision 52.212-1(e): Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

5. QUESTION: Will you please confirm with the user that they would like the skis mounted?

Ideally, we would not want to be involved in mounting the skis bindings, as that would include an additional cost and massively increase shipping costs (as they cannot be mailed flat). Also, you typically require at least one of the actual boots in order to mount the bindings (dependent on the boot size).

ANSWER: Mounting is not required.

6. QUESTION: is it correct that the OEMs would have to be of small-business status or was that a mistake by chance? The issue we are seeing is that this will be over $250k , causing the Berry Amendment to apply and negating some of those OEM small businesses mentioned in the Product Description, forcing us to find alternates, but then those MFGs are not of small business ANSWER: The RFQ has been changed from small business set aside to full and open competition, since not all the small business manufacturers can comply with the Berry Amendment.

7. QUESTION: The M216 Backcountry helmet (being requested in the RFQ) comes with an injected molded shroud and standard sport chinstrap. This design is NOT optimized for NVG use. Please confirm the Team Wendy Backcountry is acceptable.

ANSWER: The brand name or equivalent – Team Wendy backcountry SAR helmet fits that build and is acceptable. https://www.teamwendy.com/products/helmets-accessories/helmets/x1-backcountry-search-and-rescue-ski-helmet https://www.teamwendy.com/products/helmets-accessories/helmets/x1-backcountry-search-and-rescue-ski-helmet https://www.teamwendy.com/products/helmets-accessories/helmets/x1-backcountry-search-and-rescue-ski-helmet
