LIMITED SOURCES JUSTIFICATION

Determination Memorandum for Acquisitions Over $3,500 but not Exceeding the SAT

All solicitations and orders shall be competed unless a justification to limit competition using an exception in FAR Part 8, 13, or 16, as applicable to the acquisition, is approved by the Contracting Officer. When the customer describes an item or service, which limits the availability to one source or a particular brand name, there must be a technical explanation describing why only that specific one will meet the government’s requirement. Statements must be detailed and identify the harm that would come to the government (e.g. lack of capability or safety impact). The customer MUST COMPLETE all questions below, as applicable.

PURCHASE REQUEST OR REQUISITION NUMBER ESTIMATED AMOUNT

1. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES AND THE INTENDED USE.

2. THE CIRCUMSTANCE THAT REQUIRED LIMITING SOURCES TO A SINGLE MANUFACTURER OR SERVICE PROVIDER. (See FAR 8.405- 6(a)(1)(i) and (b)(1) for exceptions that apply to orders under GSA schedules. See FAR 13.106-1(b)(1)(i) for open market purchase exceptions. See FAR 16.505(b)(2)(i) for exceptions that apply to orders against multiple award contracts.)

4. WHY IS THE PROCUREMENT SO URGENT THAT TIME WILL NOT TO ALLOW FOR ADVERTISING? (FAR Part 13)

5. STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION.

This form may be used in lieu of the determination described in FAR 8.405-6(a)(1)(i), 8.405-6(b)(2), 13.106-1(b)(1), or 16.505(a)(4).

Commercial Internet Service (ISP) to support the Foreign Language Program (FLP), Public Affairs Office (PAO), Recruiting Directorate and Cultural Engagement Unit (CEU)/Support Activity One.

Per FAR 13.106-1(b)(1)(i), only one source is deemed reasonably available to satisfy this requirement (unique qualifications).

NWS Corporation/Command Broadband has been our Commercial Internet Internet Services provider for the past 6 years. We have stayed with them for their service reliability and reasonable cost. The unique attribute they possess is base fiber connectivity between the buildings requiring these service which we do not have. We could go with another vendor but they would not have the fiber infrastructure on base already in place to fulfill our requirements. WARCOM would have to provide this fiber which could cost us an additional $ to run new fiber to (4) other building on NAB requiring this service. At this time, WARCOM has no plans to install new fiber as there is future plans to move down to the Coastal Campus but not in the next 2 years. In addition, Bldg 322 which requires the majority of this services, has no more space in the TELCOM conduits in the manhole to even run new fiber.

N/A

The Government will continue to serve the market to see if new vendors become available, however unless they have the ability to utilize the current fiber run from the NAB Base Demarcation Point in Bldg 254 to the different buildings requiring this service going with a new vendor will be an additional cost. If new wire is to be run this would also require base approval which normally takes a couple of month to get approved.
