Amendment 0004

Questions 32- 47 – received through 3/28/2008 Q32. For the referenced solicitation we are to provide an “Exhibit B – Past Performance Questionnaire (PPQ) – Offeror” for each of the five projects we are using for past performance. Would it be possible, in lieu of the Exhibit Bs, to provide copies of evaluations from federal government reporting systems? Specifically, I am referring to data bases of construction project evaluations such as CCASS and PPIRS. The evaluations in these systems cover all of the issues that Exhibit B does. And being able to use these existing evaluations, as we have been able to do on other solicitations, eliminates the need to go back to references on several occasions for the same information.

A32. No. Due to differences in questionnaire formats, only Exhibit B will be accepted for Past Performance information.

Q33. Factor 2 – Page 8 of the proposal submittal requirements states, “Offerors, who submit projects and resumes for key personnel, a subsidiary, satellite office, or parent company, must explain how this office/person will participate in this contract. If it is not clear how this office/person will participate in this contract, the project will be removed and discarded prior to evaluation.” Is this to apply only to a project submitted that was performed by an employee only and not the company as a whole?

A33. It applies to projects performed by employees. The language of this paragraph is changed to read “Offerors who submit projects and resumes for key personnel must explain how this person will participate in this contract. If it is not clear how this person will participate in this contract, the project will be removed and discarded prior to evaluation.”

Q34. It was my understanding that we were not permitted to submit resumes for personnel in the proposal (other than Exhibit C for PM’s). However, the statement in question 1 (Q33) indicates that this is acceptable. Please clarify.

A34. We are requesting key personnel resumes for the Project Managers, Superintendents, and Foremen who would be assigned responsibilities for Task Orders under this contract. (See also Question 14, Amendment 0003). The language pertaining to subsidiary/satellite office/parent company/office is being deleted.

Q35. (Regarding Sample Project) Re: Sheet A1, A2, and E2 – Sheets A1 and E2 have hash marks indicating that no work is to be performed in the restrooms. However sheet A2 does not reflect this and offers a ceiling height. Are the bathrooms to be included in the scope of work?

A35. Yes. Bathrooms are to be included in the Scope of Work.

Q36. (Regarding Sample Project) Re: Proposal pricing form. The proposal pricing form shows bathroom accessories listed under division 10. In conjunction with question #3 (Q35), is this included in the scope of work. If so, no accessory specification or schedule is provided.

A36. Please use the following:

Q37. (Regarding Sample Project) Re. Sheet M1. Sheet M1 reflects a different floor plan than the rest of the building. Please clarify.

A37. Please use sheet M-1 for your quantities (diffusers, return air grills, duct lengths, etc.) and equipment lists only.

Q38. It was indicated at the pre-bid that the rates and percentages on Exhibit E are to be listed as the maximum allowable for the contract length. In regards to the bond costs, our bonding rate is figured on a sliding scale per each contract amount (it gets less as the project increases in size.) Are we allowed to show a range for this category (i.e. – 1% to 3%)? If so, what about the other categories as our GC’s and profit are now based upon individual project ranges and not set figure amounts? If I list the maximums will this reflect poorly upon us as a company?

A38. The amounts that you submit on Exhibit E will be compared against the Government Estimate, and used to calculate a portion of the pricing factor evaluation score. As such, they become part of the competitive basis for contract award. However, these amounts also become the ceiling prices for future task orders. If a contractor submits figures on Exhibit E that do not reflect actual business conditions, they run the risk of not recovering their full costs on task orders. Please submit only a maximum number for each Exhibit E category. If a range is submitted, the evaluation committee will use only the highest number in the range to calculate the pricing score.

When completing the Sample Project Bid Form (Exhibit F), you may use your actual bonding rate applicable to a project of this size/type (as long as it does not exceed the Exhibit E maximum rate.)

Q39. (Regarding Sample Project) The specs call for "Center Glazed" and later calls for "Front Glazed", please clarify.

A39. Assume center glazing throughout the project.

Q40. (Regarding Sample Project) Door No. 7, the schedule says Type C and Aluminum, but the door type says "solid core wood door, please clarify. If it is Wood, do you want an aluminum frame?

A40. This door will be an Aluminum door (Type D) Q41. (Regarding Sample Project) Regarding door frame Type A according to the elevation on sheet A3, we cannot locate a manufacturer (Kawneer, Manko, Vistawall, Tubelite or US Aluminum) that will supply the arched door, please let me know how to proceed.

A41. The door identified as Type A is not limited to any of the manufacturers identified above. The contractor may choose any manufacturer and/or fabrication process deemed necessary to provide the door specified.

Q42. Will you require a proposal letter for the sample project to be included with the IDIQ proposal?

A42. No. The sample project does not require a proposal letter. However, you may choose to clarify your pricing, if needed. Please refer to the last paragraph on page 8, Factor 3: Price Factors, which reads, “Any inconsistency, whether real or apparent, between proposed performance and price must be clearly explained in the price proposal. For example, if unique and innovative approaches are the basis for an apparently unbalanced/inconsistently priced proposal, the nature of these approaches and their impact on price must be completely documented. The burden of proof of price realism rests solely with the Offeror.”

Q43. I am planning to also submit a proposal for the unrestricted MACC IDIQ GS-08P-08-JB-D-0049. Can I use the same past performance evaluations for both contracts?

A43. You may submit the same projects for both contracts. However, please note that these are separate contracts, and will be treated as such. No proposal documents (past performance questionnaires or other) will be accepted for GS-08P-08-JB-D-0049 until the RFP for that contract has been posted on FedBizOpps. Note also, that the MACC IDIQ contract number must be listed on the first page of the past performance questionnaire. The evaluation committee cannot accept a questionnaire that lists an incorrect contract number.

Q44. If awarded a contract under this solicitation, has the SBA ever had additional requirements in order to sign off on the contract acceptance? If so, what was it? Was it ever in relation to bonding or financial resource requirements? If not, has there been any federal regulation changes that might alter this requirement that we need to be aware of?

A44. To submit a proposal for this solicitation, contractors must be in good standing with the SBA 8(a) program, and meet all program requirements. These requirements are between the SBA and the contractor. This solicitation has no additional SBA requirements prior to award. Regarding federal regulation changes, this solicitation is current through Federal Acquisition Circular (FAC) #24.

Q45. The drawings that we received with the solicitation do not include demolition plans.

The floor plan does not include a wall type legend. The restrooms are cross-hatched. There is not a legend telling us what the cross-hatching means.

A45. Bidders should figure the project as a gutted space w/ only new construction being performed. Wall Section cuts are shown on Sheet A2. Cross hatching on the Restroom is to be disregarded.

Q46. The bid form does not show the following line items which are part of the specifications and the drawings for the USO remodel:

Are we allowed to modify the description list to include these items?

A46. Yes, the bid proposal form can be modified to add additional lines. Please add line items in the appropriate CSI division and highlight the change.

Q47. Is there a page missing from Exhibit A?

A47. Yes, a second page was excluded from the RFP. The corrected Exhibit is attached.
