2.6 Section 6. Scope Summary

1. The Metropolitan Government of Nashville and Davidson County (Metro) is soliciting proposals from qualified contractors to operate emergency debris removal services within Metro Nashville-Davidson County.

The intent of this RFP is to select a contractor that is authorized to complete all required work within the scope in the event that Nashville-Davidson County is impacted by major disaster events.

2.7 Section 7. Scope Details

1. The Metro Nashville–Davidson County Debris Management Plan provides for the removal, processing, and disposal of disaster-generated debris. The Plan is based on the strategic pre-positioning of resources to support timely, coordinated recovery operations, including debris removal from public property and rights-of-way by both Metro and Contractor forces.

The Contractor shall be capable of managing a large workforce and multiple subcontractors; funding operations prior to initial and interim payments; and providing all required bonds and insurance. The Contractor shall maintain an established management team, a reliable equipment and personnel network, comprehensive debris removal and reduction plans, and demonstrated experience in major disaster recovery.

This is a contingency contract activated only in response to an actual or anticipated emergency. No compensation will be provided unless the contract is activated. The Contractor may be required to participate in Metro-directed disaster recovery training and exercises at no cost to Metro.

Services include the removal, processing, and lawful disposal of disaster-generated debris, excluding hazardous materials and household putrefied garbage, from public property and rights-of-way. Services also include establishing and operating Temporary Debris Staging and Reduction (TDSR) sites within Davidson County following tornadoes, severe storms, or other disasters.

The attached Map of Metro Nashville and Davidson County displays the full coverage area that the awarded contractor shall be responsible for servicing in the event that this contract is utilized, based on where the need for these services a designated.

The Contractor shall provide and manage sufficient resources to complete debris removal within 90 calendar days and disposal operations within 180 calendar days. TDSR sites and landfills outside Davidson County shall not be assumed available unless specifically authorized in a Task Order. All work shall comply with the current FEMA Public Assistance Program and Policy and all applicable FEMA certification requirements.

FEMA Certification Requirements

Work under the resulting contract for Emergency Debris Removal Services may be eligible for FEMA federal assistance funding. The attached FEMA Certification document is a mandatory component of this solicitation and must be completed signed and submitted with your proposal. This document is included to ensure compliance with all applicable federal laws, requirements, regulations, and contract provisions associated with the project that may be funded, reimbursed, or otherwise supported by the Federal Emergency Management Agency (FEMA). See the attached FEMA Certification Document.

The January 6, 2025 FEMA Public Assistance Program and Policy Guide include references to the regulations, policies, tools, disaster guidance, etc related to the agency and FEMA-supported circumstances. See the attached FEMA Public Assistance Program and Policy Guide in this solicitation.

Planning Standard for Debris Removal and Disposal

Metro Nashville utilizes a countywide equal-intensity disaster scenario with an estimated debris volume of 15 million cubic yards. This planning estimate, identified in the Metro Debris Management Plan, is used to determine TDSR site acreage and resource requirements. Actual debris quantities may vary.

For proposal purposes, Contractors shall use 15 million cubic yards as the potential assigned debris volume. Metro anticipates completion of debris removal within 90 calendar days and disposal and recycling operations within 180 calendar days, assuming reasonable site access. Operations may be delayed in certain areas and may not begin simultaneously across all debris zones.

Recycling efforts are encouraged and will be coordinated with NDOT and applicable landfill recycling programs.

Debris Management Planning as a function of NDOT and the Mayor's Office of Emergency Management

(OEM)

NDOT's Debris Manager, in coordination with OEM, will direct all debris removal and disposal activities through the Debris Management Center. Metro will utilize both internal resources and a contingency debris removal contract to ensure immediate post-disaster response capability. The awarded Contractor shall serve as the General Contractor and may utilize both local and non-local subcontractor resources to fulfill contract requirements.

Upon an actual or impending disaster, the Debris Manager will notify the Contractor of Metro's intent to activate the contract. Debris removal will generally be limited to public streets, rights-of-way, facilities, municipal properties, and other public locations. The Contractor shall determine removal methods consistent with this Scope of Work. Disposal shall occur only at Metro-approved facilities. For this contract, TDSR Site and Temporary Debris Management Site are synonymous.

Following activation, the Debris Manager may require the Contractor's Operations Manager to report to the Debris Management Center within 24 hours. The initial Task Order, typically issued within 24 hours, will authorize mobilization and require Performance and Payment Bonds. Subsequent Task Orders may address debris removal, reduction, and temporary disposal. Invoices shall be submitted to NDOT unless otherwise directed.

Debris collection will occur through multiple passes to allow residents time to place debris curbside. Collection schedules will be established by the Debris Manager based on disaster impacts and critical infrastructure priorities.

Debris Collection Efficiency and Cleanliness

The Contractor shall remove all debris from public rights-of-way that is beyond the capability of a typical homeowner to collect using basic tools. Homeowners shall remain responsible only for minor residual materials such as leaves, dirt, twigs, and sawdust that can be bagged.

Except for these minor materials, the Contractor shall remove all debris during each collection pass and shall not leave debris for future passes. Separate crews or equipment may be used for bagged debris, C&D debris, recyclable timber, and stumps; however, all debris categories shall be collected during the same pass.

Damages to Public or Private Property

The Contractor shall be responsible for all damage resulting from debris operations to public or private property.

Damages shall be repaired immediately and restored to equal or better condition. Disputes will be resolved through negotiation. The Contractor shall provide semi-weekly reports identifying resolved and outstanding claims.

Debris Removal from Drainage Systems

The Contractor may be directed to remove debris from ditches, canals, streams, lakes, reservoirs, and other drainage systems. Disposal may require hauling or on-site placement as directed by the Debris Manager. Metro will provide site-specific scopes of work, including quantities, descriptions, photographs, and access information. The Contractor shall submit lump-sum estimates using Part B unit prices.

TDSR sites will be designated for staging and reduction of vegetative debris and may include white-goods processing areas. Only authorized vehicles may access these sites. Homeowner drop-off locations may also be established, and the Contractor shall remove accumulated debris daily.

The Contractor shall support Metro's curbside segregation program and manage debris by the following categories:

1. Household trash and putrefied garbage – NDOT and Contractor responsibility.

2. Leaves and lawn litter in recyclable bags – collected separately or co-mingled with vegetative debris as approved by the Debris Manager.

3. Vegetative debris (trees, limbs, logs, stumps) – Contractor responsibility, including reduction.

4. Construction and demolition (C&D) debris, furniture, and furnishings – Contractor responsibility.

5. Household Hazardous Waste (HHW) – NDOT and Contractor responsibility.

6. White goods containing refrigerants – Contractor responsibility.

Citizens will be instructed to separate debris; however, failure to do so does not relieve the Contractor of reasonable segregation responsibilities.

HHW encountered during operations shall be isolated for NDOT disposal. HHW includes, but is not limited to, cleaning products, batteries, paints, pesticides, automotive fluids, electronics, propane cylinders, fluorescent bulbs, and lithium or cadmium batteries.

The Contractor shall establish a lined containment area at each TDSR site for inadvertently delivered HHW.

Commercial and industrial hazardous materials shall be isolated for Hazardous Materials Removal.

White-goods refrigerant recovery shall comply with all applicable federal, state, and local regulations, including EPA Section 608 and 40 CFR 82. Contractors and subcontractors shall maintain required certifications and documentation.

Work Authorization and Mobilization

All work shall be authorized through written Task Orders specifying scope, location, schedule, and rates. Additional work not included in the Proposal may be negotiated. Metro may extend operations on a weekly basis.

Upon receipt of a mobilization Task Order, the Contractor shall mobilize resources according to the following minimum schedule:

• 36 Hours – 25%

• 72 Hours – 50%

• 96 Hours – 75%

• 120 Hours – 100%

Earlier mobilization is encouraged. Additional Task Orders shall be sequentially numbered.

The Contractor shall maintain all required State of Tennessee and Metro Nashville licenses and permits, including business and contractor licenses, and provide copies to the Debris Manager.

Work quantities are estimates only. Payment shall be based on proposed unit prices and verified daily operational reports. For hourly equipment, up to 15 minutes of preventive maintenance per day is compensable. Additional maintenance, fueling, or downtime is non-payable and rounded to the nearest half hour.

The Contractor shall correct, at no cost to Metro, any violations resulting from Contractor or subcontractor operations.

Work shall not interfere with other emergency response activities. At least one supervisor per non-English-speaking crew shall be fluent in English.

Debris Removal and Disposal Operations

The Contractor shall provide all labor, equipment, fuel, maintenance, repairs, supervision, traffic control, transportation, protective equipment, benefits, and other resources necessary to perform the work.

Equipment, personnel, and subcontractors shall not be transferred between debris zones without notification to the

Debris Manager. Self-loading grapple trucks and loaders are preferred. Hand-loading requires written approval.

Hand-loaded trucks shall receive credit for no more than 50 percent of measured capacity.

Metro shall certify hauling vehicles by equipment type, identification, and measured load-bed volume. Measured capacities shall match posted signage, and Metro may re-measure vehicles at any time.

All hauling equipment shall display identification signage on both sides. Debris-hauling vehicles shall also display certified cubic-yard capacity. Sign lettering shall be a minimum of three inches high and remain legible throughout the contract.

Vehicles shall have secure tailgates and approved sideboards. Sideboards shall be constructed of at least 2x6 material and may not exceed two feet above the bed unless approved in writing. Equipment assigned to this contract shall not be used for other work, and debris collected under this contract shall not be mixed with debris from other sources.

Contractor Responsibilities: Debris Haul

The Contractor shall ensure all loads are secured, compacted, and trimmed prior to transport. No debris may extend beyond the load bed. Tarps or coverings shall be used to prevent material loss during transport.

Maximum vehicle height, including debris and sideboards, shall not exceed 13 feet 6 inches unless approved by the Debris Manager. Maximum vehicle width shall not exceed 8 feet 6 inches.

The Contractor shall verify clearances for bridges, overpasses, traffic signals, conductors, and overhead utilities.

Structures with reduced clearances shall be properly identified.

Additional Responsibilities

The Contractor shall assign an Operations Manager (OM) to serve as the primary liaison with the Debris Manager. The OM shall be authorized to commit the Contractor, available 24 hours per day, maintain reliable communications, attend required meetings and exercises, and report directly to the Debris Manager.

Operations Supervisors shall provide daily field coordination with Metro. The Contractor shall provide traffic and pedestrian control, including at least one flagger for each work approach.

The Contractor shall supervise all operations using qualified personnel and appropriate equipment and shall provide all labor, materials, taxes, and fees required to perform the work.

Debris hauling payment shall be based on cubic yards and haul distance. Loads delivered to TDSR sites shall be documented with validated load tickets. Metro monitors shall estimate debris quantities, retain required ticket copies, and verify disposal records.

Metro monitor determinations of debris quantities shall be final. Loads shall be assumed full unless deductions are warranted for consolidation, light packing, or incomplete loading.

TDSR Site Operations

Phase I – Site Setup/Preparation & Closeout/Restoration Phase I includes all activities necessary to establish, operate, close, and restore TDSR sites. Compensation shall be based on Part B time-and-materials rates.

Work includes clearing, grading, fill placement, processing pads, access roads, hauling, sodding, and all activities necessary to restore the site to pre-use condition. Materials shall be paid at cost or as negotiated.

Site setup, operation, and restoration shall comply with the Metro Debris Management Plan, including requirements for grinding, burning, air-curtain operations, ash management, and restoration.

Phase II – TDSR Operations & Material Processing Phase II includes TDSR management, debris reduction, and material processing and shall be compensated using Part A unit prices.

The Contractor shall provide all labor, equipment, fuel, maintenance, mobilization, insurance, supervision, and related costs. Work includes debris reduction through grinding or air-curtain burning and recycling of marketable materials.

Vegetative debris will generally be processed at TDSR sites. Mixed and C&D debris will typically be delivered directly to approved transfer stations or landfills unless C&D TDSR operations are authorized. Vegetative debris shall be measured and paid based on inbound truck-measured cubic yards.

TDSR site improvements require prior approval. Daily reports documenting labor, equipment, handled volumes, and recycled quantities shall be submitted by 11:00 a.m. Failure to provide adequate documentation may result in non-payment.

The Contractor shall provide utilities, sanitation facilities, site security, utility clearances, and protection of existing infrastructure. Any damage shall be repaired at no cost to Metro.

The Contractor shall minimize fire hazards and close each TDSR site within 30 days after receipt of the final debris load. Closure includes removing equipment and temporary facilities, disposing of residual materials, and restoring the site to pre-use condition. Final payment requires Debris Manager approval.

Phase III – Debris Clearance for Access Phase III consists of emergency debris clearance from public property and rights-of-way to restore access. Metro normally performs this work using internal resources; however, the Contractor may provide supplemental support during major disasters. Work shall be compensated on a time-and-materials basis using Part B rates and shall not exceed 70 hours unless otherwise authorized.

TDSR Site Management Plan

Upon designation of a TDSR site, the Contractor shall submit three copies of a TDSR Site Management Plan drawn to a scale of 1" = 50'. The plan shall address:

• Site access, preparation, clearing, grading, and erosion control

• Traffic control and safety measures

• Debris segregation and processing layout

The Contractor shall provide OSHA-compliant lifts, scaffolding, and inspection towers. Inspection towers shall include a roof with a minimum clearance of 6 feet 6 inches below support beams, stair access with handrails, and anchoring sufficient to prevent overturning. Alternative designs may be approved by the Debris Manager if equivalent safety and functionality are maintained.

TDSR sites and inspection towers shall be subject to periodic FEMA and OSHA compliance inspections.

Household Hazardous Waste Containment Area

The Contractor shall construct a 30-foot by 30-foot HHW containment area at each TDSR site. The containment area shall include hay bale perimeter controls, a heavy-gauge plastic liner, a six-inch sand layer for absorption and puncture protection, and protective plastic covering for rain events. Site grading shall direct stormwater runoff away from the containment area.

Private Property

The Contractor shall not perform work on private property or accept requests directly from property owners. When access across private property is required to reach public debris, Metro shall provide a Right of Entry Agreement. If debris removal from private property becomes necessary, the scope of work and compensation shall be negotiated separately.

Debris Collection Efficiency and Cleanliness

The Contractor shall remove all debris from public rights-of-way that cannot reasonably be collected by a typical homeowner using basic tools. Homeowners remain responsible only for minor residual materials, including leaves, dirt, twigs, and sawdust.

Except for these residual materials, all debris shall be removed during each collection pass. Separate crews or equipment may be used for specific debris streams; however, all debris types shall be collected during the same pass.

Damages to Public or Private Property

The Contractor shall be responsible for all damage resulting from debris operations. Damaged property shall be restored immediately to equal or better condition. The Contractor shall provide semi-weekly reports identifying resolved and unresolved damage claims. Disputes shall be resolved through negotiation.

Debris Removal from Drainage Systems

The Contractor may be directed to remove debris from drainage facilities, including ditches, canals, streams, lakes, and reservoirs. Metro shall provide site-specific scopes of work identifying debris quantities, descriptions, photographs, and access requirements. The Contractor shall submit lump-sum estimates based on Part B unit prices. Disposal methods shall be determined by the Debris Manager.

Tree and Limb Removal with Specialized Equipment

The Contractor may be directed to remove hazardous hanging limbs and leaning, damaged, or otherwise hazardous trees. The Debris Manager shall determine hazard conditions and provide location-specific descriptions. The Contractor shall submit lump-sum estimates using Item 2.2 unit prices in Part A. Any pricing deviations shall be negotiated.

Removal of Hazardous Stumps

The Contractor may be directed to remove hazardous stumps that are partially uprooted or otherwise determined hazardous by the Debris Manager. The Contractor shall submit lump-sum estimates using Item 2.1 unit prices in Part A. Any pricing deviations shall be negotiated. Removal, hauling, and disposal of uprooted stumps and root balls shall be compensated under Items 1.1 through 1.4, as applicable.

Additional Considerations

The Debris Manager may terminate all or part of the contract if:

• Unforeseen conditions require suspension of work

• Contract specifications are not met

• Proper methods are not followed after notice

• Adequate personnel or equipment are not provided

• Work progress becomes unacceptable

• Contractor refuses direction from Metro

• Work is abandoned

• A debarred subcontractor is utilized

Performance Schedule

Following contract execution, the Contractor shall meet with the Debris Manager to review safety requirements, reporting procedures, quality control, payment processes, and operational coordination.

Each grinder shall maintain a processing rate of 200–250 cubic yards per hour, with no more than four hours of downtime during any 24-hour period. Minimum production requirements shall be achieved no later than Day 3 following Notice to Proceed.

Assistance to Small (SBE) and/or Service-Disabled Veteran (SDV) Owned Businesses

The Metro Procurement Code (Section 4.44) and Regulations (Section R4.44.020.04) provide options for the Purchasing Agent to maximize the participation and performance of Metro approved SBE/SDV businesses.

Assistance is provided to offerors who are SBE/SDV, or who need assistance in locating potential SBE/SDV subcontractors or suppliers. For assistance, offerors are encouraged to contact the BAO by email at BAO@Nashville.gov or call the BAO at (615) 880-2814. For more information and the forms go to Business Assistance Office (BAO) at the website listed in the attachment section herein.

If the Offeror is an SBE/SDV business, Metro considers the work the SBE/SDV firm commits to self-perform. If the work is subcontracted or otherwise procured, only the work performed by a Metro approved SBE/SDV subcontractor or supplier may be considered for the purposes of award incentive. All SBE/SDV businesses included in offers must be registered online with Metro and approved by the BAO prior to the solicitation closing date.

Several ways that SBE/SDV participation may be promoted in individual solicitations are described below:

• Cost Incentive - The Metro Procurement Code (Section 4.44) and Regulations (Section R4.

If this solicitation includes a cost incentive for the participation of approved SBE/SDV business, the methodology for evaluating the SBE/SDV participation is described in the regulations found at website link shown in the attachment section herein. This requires that ALL SBE/SDV Subcontractors and/or Subconsultants be listed on the Subcontractor/Subconsultant Form.

• Set-Aside - Some solicitations are the result of an SBE/SDV set-aside. In those cases only approved SBE/SDV firms may submit an offer. The solicitation will state in the opening description if it is an SBE/SDV set-aside solicitation. This requires that ALL SBE/SDV Subcontractors and/or Subconsultants be listed on the Subcontractor/Subconsultant Form.

• Small Business Reserve (SBR) - Some solicitations are the result of an SBR set-aside. In those cases, only approved Small Business Reserve participants may submit an offer. The solicitation will state in the opening description if it is an SBR solicitation. This requires that a preliminary list of SBE/SDV subcontractors and/or subconsultants be included on the Subcontractor/Subconsultant Form.

• Threshold - If the solicitation has a SBE/SDV threshold, only offers that meet the established threshold will be eligible for SBE/SDV…
