About this file

This document is a Method of Operation (MOO) for a New Jersey state contract (Blanket Purchase Order G4018) for Integrity Oversight Monitoring services, issued by the New Jersey Department of Treasury. The contract involves multiple pre-qualified Integrity Monitors, including BDO Public Sector LLP, CohnReznick LLP, Cotton & Company Addurance and Advisory LLC, Deloitte & Touche LLP, Regis & Associates P.C., Rumph and Associates P.C., The North Highland Company, and Vander Weele Group LLC. The procurement is designed to establish a pool of providers that can be utilized by New Jersey State agencies, quasi-state agencies, and cooperative purchasing partners.

The contract covers program and process management monitoring, financial auditing, grant management, and integrity/anti-fraud support services, specifically focused on COVID-19 recovery funds and programs. The Blanket Purchase Order has a two-year term with the option to extend up to three additional years. Each using agency must conduct a mini-bid process to select an appropriate Integrity Monitor from the pre-qualified pool, with selection based on specific engagement requirements, experience, and pricing. The contract utilizes hourly ceiling rates for services, with each provider's detailed pricing available in the NJSTART system. The procurement allows for flexible, targeted engagement of monitoring services across various state and local government entities.

RFQ1465257S

Blanket P.O. Number: Multiple March 28, 2023

I. Purpose and Intent

The purpose of this RFQ was to solicit Quotes for program and process management monitoring, financial auditing and grant management, and integrity monitoring/anti-fraud support services (“Integrity Monitoring Services”), to be made available to the Department of Treasury, other State Agencies, and Cooperative Purchasing Partners (“Using Agencies”). The procurement process established a pool of prequalified Integrity Monitors, who, through a mini-bid process, will be tasked with providing integrity monitoring services for the Using Agencies. Each Using Agency will conduct a mini-bid process with the pool of Integrity Monitors to select the one (1) Integrity Monitor that meets the Using Agency’s Engagement-specific needs. All Using Agencies, including Quasi- or non-State Agencies wishing to use this Blanket P.O. must conduct the mini-bid process to select an appropriate Integrity Monitor from the pool.

Note: The applicable procurement law may vary by Using Agency. These instructions are primarily intended to assist New Jersey State agencies in conducting a mini-bid process that satisfies applicable New Jersey State procurement law. However, this Blanket P.O. is also open to Quasi- and non-State Agencies under New Jersey’s Cooperative Purchasing laws. Please be advised that these agencies may be subject to different procurement laws, which may not require the same process, and may require a different process than that which is set forth in this Method of Operation. Each Using Agency is responsible for ensuring that any procurement it conducts for its own needs fully conforms with its applicable procurement law.

II. Important Note

All Integrity Monitors and Using Agencies shall refer to RFQ1465257S for all Engagement Process requirements, Engagement requirements, Special Contractual Terms and Conditions, and New Jersey Standard Terms and Conditions that pertain to this Blanket P.O. It is strongly encouraged that each Using Agency print out and review the entire RFQ, and keep a copy. The RFQ contains numerous terms and conditions that apply to the Blanket P.O., specifically when used by a State Agency or Quasi- State Agency. These terms and conditions govern important topics such as insurance, indemnification, governing law, and many other important items. Please review the entire RFQ so you are familiar with its contents.

VI. Prior to Use

Prior to use of this Blanket P.O., the Using Agency must submit an Engagement Query to all Integrity Monitors with a detailed scope of work that includes specific performance milestones, timelines, and standards and deliverables and liquidated damages for failure to meet any required milestones, timelines, or standards or deliverables.

A. The Using Agency shall designate an agency employee to act as the Agency Contract Manager. The Agency Contract Manager will notify the State Contract Manager (SCM) of its request for an Integrity Monitor utilizing a form set forth by the Department of Treasury. The Agency Contract Manager shall include any required supporting documentation with the request to the SCM. The Agency Contract Manager shall indicate which services are required.

B. An Engagement Query will be prepared by the Agency Contract Manager and will include a detailed scope of work, specific performance milestones, timelines, and standards and deliverables. The Engagement Query shall also include liquidated damages for failure to meet any required milestones, timelines, standards, or deliverables.

C. The Agency Contract Manager shall consult with the Office of the Attorney General, Division of Law to structure a liquidated damages provision for the failure to meet any required milestones, timelines, standards, or deliverables, as appropriate.

D. The Agency Contract Manager shall submit its Engagement Query to the SCM. Upon approval by the SCM the Engagement Query must be sent to the Office of the State Comptroller (OSC) for approval pursuant to EO 166. After receiving approval from OSC, the SCM will send the Engagement Query to all eligible Integrity Monitors within the Integrity Monitoring pool.

E. Interested Integrity Monitors shall respond to the Engagement Query within the timeframe designated by the SCM, with a detailed Engagement Quote that includes a detailed budget, timelines, and plan to perform the scope of work and other requirements of the Engagement Query. Integrity Monitors shall identify any potential conflicts of interest that would prevent them from accepting an Engagement. Integrity Monitors shall also indicate if they do not wish to submit an Engagement Quote for the Engagement Query.

F. The SCM will forward to the Agency Contract Manager all Engagement Quotes received in response to the Engagement Query. The Agency Contract Manager will evaluate the Engagement Quotes based on specific Engagement tasks and responsibilities, experience, and pricing and select the Integrity Monitor whose Engagement Quote is most advantageous to the State, price and other factors considered. The Agency Contract Manager will memorialize in writing the justification for selecting an Integrity Monitor(s).

G. Prior to finalizing any Engagement under this contract, the Agency Contract Manager, in consultation with the Accountability Officer, will independently determine whether the intended Integrity Monitor has any potential conflicts with the engagement.

H. The SCM, on behalf of the Using Agency, will then issue a Letter of Engagement with a “Not to Exceed” clause to the selected Integrity Monitor and work with the Agency Contract Manager to begin the issuance of Letter of Engagement.

I. All documentation and evaluation materials shall be kept by the Using Agency for at least five (5) years pursuant to the requirements of N.J.S.A. 52:15C-14 and N.J.A.C. 17:44-2.3. Each Using Agency should also adhere to its standard record retention policies, which may require a longer retention.

VII. Directions for Use of the Blanket P.O.
