1 INTRODUCTION AND SUMMARY OF THE REQUEST FOR QUOTES

This Request for Quotes (RFQ) is issued by the New Jersey Department of Environmental Protection (NJDEP). The Contract will be awarded in the State of New Jersey’s eProcurement system, NJSTART (www.njstart.gov). The awarded Contractor is advised to read through all Quick Reference Guides (QRGs) located on the NJSTART Vendor Support Page for information.

1.1 PURPOSE, INTENT, AND BACKGROUND

1.1.1 PURPOSE AND INTENT

The purpose of this RFQ is to solicit Quotes for the NJDEP’s Division of Information Technology for Full Time Employee (FTE) staff for the maintenance and support of NJDEP’s enterprise systems and applications including:

NJ Environmental Management System (NJEMS);

Regulatory Services Portal (RSP);

Data Miner;

OPRATS;

COMPASS; and Related Interfaces and Integrated Processors (refer to Section 4.9.6 of this RFQ).

NJDEP anticipates the need for the following experienced personnel/services to fulfill this requirement:

A. Information Technology (IT) project management services;

B. IT technical consulting services;

C. IT functional consulting services;

D. IT senior systems programming services;

E. IT systems programming services; and F. IT business systems analysis services.

It is the intent of the State of New Jersey (State) to award a Contracts to that responsible Bidder whose Quote, conforming to this RFQ is most advantageous to the State, price and other factors considered. The State may award any or all price lines. The State, however, reserves the right to separately procure individual requirements that are the subject of the Contract during the Contract term, when deemed to be in the State’s best interest.

Quotes will only be accepted from Bidders with an active GSA contract under SIN 54151S – Information Technology Professional Services/IT Development Services.

The State of New Jersey Standard Terms and Conditions (SSTCs) included with this RFQ will apply to all Contracts made with the State.

These terms are in addition to the terms and conditions set forth in this RFQ and should be read in conjunction with them unless the RFQ specifically indicates otherwise.

1.1.2 BACKGROUND

This is a reprocurement of the services under G1005 – NJ Environmental Management System (NJEMS) for DEP. Bidders interested in reviewing the current Contract specifications and pricing information may do so by following the instruction below. Bidders should not rely upon or use data or information from the Contract when preparing a response to this RFQ as this RFQ addresses the State’s current requirements.

Go to: www.njstart.gov In the search bar, select “Contracts” from the drop down menu Enter G1005 and click “ ” The current Contract list will appear under “Results”

The NJDEP has a need for comprehensive production and application maintenance services to support the ongoing operations and maintenance of the NJDEP systems noted in Sections 1.1, 1.1.3, and 4 of this RFQ. All these systems are in production and are used by NJDEP staff across all program areas to perform day-to-day business operations. NJDEP staff and the regulatory community continue to require system support and may make requests for minor changes for various reasons (i.e., mandated business process changes).

The primary business objectives of this Contract include:

A. Sustaining efficiency gains from previously implemented software, including high-traffic public-facing systems (eNJEMS/RSP) and the departments backend enterprise system (NJEMS), which are critical to executing NJDEP’s regulatory obligations;

B. Supporting continued migration of NJEMS system components from PowerBuilder to NJDEP’s next generation enterprise platform, PEGA;

C. Refining existing business processes through software enhancements to provide streamlined services and great convenience to the regulated community;

D. Increasing automation to reduce the flow of paper and number of forms required to support existing processes, including the strengthening of NJDEP’s revenue collection processes; and

E. Maximizing the accuracy and timeliness of public entities engaging in regulatory-related activities.

1.1.3 NJDEP PRIMARY IT SYSTEM DESCRIPTIONS

New Jersey Environmental Management System (NJEMS):

Whether NJDEP captures data online, through hard copy, disk, or email, data related to its regulated entities and their activities is captured and processed in the New Jersey Environmental Management System (NJEMS). NJEMS is the NJDEP’s department-wide enterprise database system that integrates all data related to its regulated activities for the purposes of processing, sharing and reporting data, improving workflow and business practices, and making better environmental decisions. NJEMS serves as the day-to-day business tool for over 3,000 NJDEP staff. NJEMS stores, tracks and reports data related to all certifications, registrations, permits, cases, inspections, violations, enforcement actions and assessments and financial collections. NJEMS tracks the data associated with those activities, as well as documents (i.e., Word, Excel, PDFs, electronic attachments) related to the activities, and the NJDEP workflow tasks, staff assigned and processing time for each of those activities. NJEMS tracks each permit requirement, facility submittal and inspection requirement to provide for automated compliance determination where possible. For example, discharge monitoring reports, air emissions, water withdraw requirements and monitoring reports are captured in NJEMS so that Nightly Cycle processing can evaluate the data for missing submittals or exceedances and autogenerate violations for the department’s response and enforcement action. NJEMS provides all staff with access to any NJDEP data related to regulated entities and provides the department a way to track and report this data easily to the public. In addition, NJEMS is fully integrated with other NJDEP enterprise systems and NJ State systems, sharing data to-and-from these related systems to ensure all of the NJDEP data is synchronized and up to date.

Regulatory Services Portal (RSP) and eNJEMS:

NJDEP’s online system www.njdeponline.com allows regulated entities to submit permit applications, registrations and certifications, reports, monitoring data and test results, chemical inventories, and payments electronically.

NJDEP completed retooling, redesigning and developing its legacy on-line platform (eNJEMS), building on its existing capabilities but using a framework/workbench tool, jTAP. This retooled on-line platform is called the RSP. The RSP allows an applicant to submit their application and payment electronically, evaluate the submittal for completeness, and process the application. In some cases that application is processed entirely online allowing the applicant to generate an approved permit. In other cases, it generates the data necessary to complete the application in the department’s enterprise data system, NJEMS, and assigns it to a permit reviewer. In all cases the applicant receives emails notifying them of receipt, completeness and processing status. The system has been linked to the department’s geographic information system (NJ GeoWeb) allowing for evaluation with over 40 GIS data layers. This provides the applicant and the NJDEP with a way to determine if environmentally sensitive areas would potentially be impacted. For example, it notifies the submitter when a proposed well is located within an area of ground water contamination. The system has also been linked to the department’s enterprise imaging/content management system (HighView), allowing submitted service attachments and outputs to be automatically ingested and indexed into HighView.

COMPASS:

As NJDEP works to maintain more of its ambient data electronically, and improve older electronic ambient data systems, data is being centralized in the department’s ambient data system COMPASS. This allows us to take advantage of existing enterprise software and hardware as well as the link to NJEMS and eNJEMS to provide for integration with other program data and electronic submittal.

COMPASS is currently being used for PWTA data, Volunteer Water Monitoring, Water Quality Monitoring, and Hazardous Site data.

Open Public Records Act Tracking System (OPRATS):

As NJDEP continues to process the increasing number of public record requests as required by the Open Public Records Act, increased use and efficiencies are being required of the OPRATS. These new efficiencies have enabled the NJDEP to respond to the increased demand for public record access, while working with reduced staff in all program areas of the NJDEP required to gather the documents and information needed to answer these access requests. Currently OPRATS is in the Pega 8 platform.

NJDEP Data Miner:

NJDEP’s web site provides easy, around-the-clock access to key environmental reports and other public documents seven days a week at no charge through NJDEP Data Miner. This site not only provides our constituents with the best, most up to date, environmental information possible, but it also reduces NJDEP’s staff burden in producing that information.

The NJDEP Data Miner web site enables users to search for information on NJDEP-regulated sites by location, name, or identification number. Data Miner users obtain information and documents associated with the regulated sites quickly and easily by clicking on links to licenses and registrations permits, inspections, violations, enforcement actions, and environmental monitoring. Users can download data and analyze it with typical desktop software such as Excel or Access. Anyone who wants to monitor the NJDEP’s response to an environmental incident can access NJDEP Data Miner’s Incident Reports. Or, by searching NJDEP Data Miner’s Pesticide Applicator Business report, a homeowner can find out if an exterminator is properly licensed. Regulatees can track their permit application through processing using the Pending Permit Report. Through NJDEP’s integrated, enterprise data systems, Data Miner makes available real-time information.

Exchange Network:

NJDEP became an operational partner on the National Environmental Exchange Network (Exchange Network) in 2004. The Exchange Network is a partnership between state environmental departments and the U.S. Environmental Protection Agency that is revolutionizing the exchange of environmental information. Partners on the Exchange Network share data efficiently and securely over the Internet using web services. This new approach is providing automated machine-to-machine, real-time access to higher quality data while saving time, resources, and money for partner states, tribes, and territories.

NJDEP’s Node allows for automated machine-to-machine exchange of data with other partners using XML, web services and common data standards. This automated exchange eliminates NJDEP’s double data entry efforts and its manual processing of data to provide electronic copies. This helps NJDEP reduce costs, save time, and overcome delays in making better decisions and responding to environmental emergencies.

NJDEP is currently exchanging facility, air emissions, hazardous waste, beach notification, ambient air, monitoring data, homeland security data, safe drinking water data, water quality monitoring data, and more. NJDEP is reusing the infrastructure and data flows to provide the same effortless data exchange with other states (e.g. air quality monitoring) and other NJ state agencies (DHSS for health tracking, L&PS/OCT for homeland security, Treasury for licensed individuals), leveraging the capabilities developed through this grant funding for many other efforts.

NJDEP developed two tools (Java Flow Processor (JFP) and the Java Input Processor (JIP)) to allow NJDEP staff to develop new Exchange Network flows, reducing the need for vendor resources, reducing development costs, and allowing NJDEP to respond quickly to the need for additional flows.

Diagram 1 below illustrates the existing system architecture at NJDEP:

The Bidder should submit a completed and signed Confidentiality/Commitment to Defend Form with the Quote. In the event that the Bidder does not submit the Confidentiality form with the Quote, the State reserves the right to request that the Bidder submit the form after Quote submission.

After the opening of sealed Quotes, all information submitted by a Bidder in response to a RFQ is considered public information notwithstanding any disclaimers to the contrary submitted by a Bidder. Proprietary, financial, security and confidential information may be exempt from public disclosure by OPRA and/or the common law when the Bidder has a good faith, legal/factual basis for such assertion.

When the RFQ contains a negotiation component, the Quote will not be subject to public disclosure until a notice of intent to award a Contract is announced.

As part of its Quote, a Bidder may request that portions of the Quote be exempt from public disclosure under OPRA and/or the common law. The Bidder must provide a detailed statement clearly identifying those sections of the Quote that it claims are exempt from production, and the legal and factual basis that supports said exemption(s) as a matter of law. The State will not honor any attempts by a Bidder to designate its State-Supplied Price Sheet, Price List/Catalog, and/or the entire Quote as proprietary and/or confidential, and/or to claim copyright protection for its entire Quote. If the State does not agree with a Bidder’s designation of proprietary and/or confidential information, the State will use commercially reasonable efforts to advise the Bidder. Copyright law does not prohibit access to a record which is otherwise available under OPRA.

The State reserves the right to make the determination as to what to disclose in response to an OPRA request. Any information that the State determines to be exempt from disclosure under OPRA will be redacted.

In the event of any challenge to the Bidder’s assertion of confidentiality that is contrary to the State’s determination of confidentiality, the Bidder shall be solely responsible for defending its designation, but in doing so, all costs and expenses associated therewith shall be the responsibility of the Bidder. The State assumes no such responsibility or liability.

In order not to delay consideration of the Quote or the State’s response to a request for documents, the State requires that Bidder respond to any request regarding confidentiality markings within the timeframe designated in the State’s correspondence regarding confidentiality. If no response is received by the designated date and time, the State will be permitted to release a copy of the Quote with the State making the determination regarding what may be proprietary or confidential.

3.5.8 SUBCONTRACTOR UTILIZATION PLAN

Bidders intending to use Subcontractor(s) shall list all Subcontractors on the Subcontractor Utilization Plan form.

For a Quote that does NOT include the use of any Subcontractors, the Bidder is automatically certifying that, if selected for an award, the Bidder will be performing all work required by the Contract.
