Informal Acquisition Plan FY23 Duluth-Superior Harbor Maintenance Dredging

Below is the information acquisition plan for FY23 Duluth-Superior Harbor Maintenance Dredging. The below addresses all requirements outlined in FAR 7.105 and DFARS

207.105. Some items have been removed or consolidated based on likelihood of applicability below the threshold for a formal acquisition plan, including major systems acquisitions and similar high complexity requirements. All removed requirements have been reviewed by the Project Manager and Contracting Officer and determined to be non-applicable.

(a) Acquisition background and objectives-

(1) Statement of need.

A Sources Sought was posted from 21 FEB 2023 through 08 MAR 2023. There were small business responses; however, based on historical data and offer responses for the FY22 dredging project in the same project area, in order to ensure competition is received this action will be full and open.

The Current Working Estimate (CWE) (based on SSB) is $2,584,688 (base = $1,682,188 and options = $902,500). Price reasonableness will be conducted to ensure the overall proposed price is fair and reasonable in comparison to the Independent Government Estimate (IGE) and competition. Future cost risk is fairly low for this requirement because the scope is well defined and there is no expectation for modifications or scope change during construction and the Government intends to award a firm fixed price (FPP) contract.

While dredging work is contingent upon completion within the dredging window, schedule risk is low due to the fact that the project requirements are well defined, and the project has gone through several levels of review such as BCOES review. Standard QC and oversight will be utilized.

A BCOES review is warranted for this construction project. The plans and specifications clearly describe the work needed. A determination of contractor responsibility will be performed on the low bidder to ensure that they are capable of performing the required work.

An NTP by 10 JUL 2023 will allow sufficient time to complete the dredging work by the end of the applicable dredging window in October 2023 and earthwork (if the option is awarded) in the CDF by 31 MAR 2024.

The procurement will utilize the Invitation for Bid (IFB) process under FAR Part 14, Sealed Bidding. An IFB is the most advantageous procurement method since FAR 6.401(a) is applicable and this method has successfully been used in the past for similar work.

(b) Plan of action

(1) Sources.

(2) Does the requirement meet the definition of consolidation?

Yes

No

Does the requirement meet the definition of bundling?

Yes

No

Work will be routinely monitored by Government personnel (COR) and risk of unsuccessful performance is very low.

Technical: The Detroit District held multiple Biddability, Constructability, Operability, Environmental, and Sustainability (BCOES) reviews in-house to review the design and contract documents, in addition to performing standard District Quality Control (DQC) process on the contract documents.

Construction: This type of procurement has been performed on similar projects and the risk is considered low. The plans and specifications will address the construction approach and potential bidders will have an opportunity to ask questions during the RFI period.

While this requirement has not been identified for acquisition streamlining, the Government intends to use simplified processes to the maximum extent practicable and allowable.

This procurement is for a full and open contract under NAICS Code 237990, with a $45.0 million small business size standard. A DD2579 was sent to the Small Business Deputy with no set-aside which will be signed off by the Small Business Deputy and the concurred by the SBA Procurement Center Representative prior to advertising.

(3) Competition.

(4) Contract type

Firm-Fixed-Price Cost Time and Material Other Combination

Economic Price Adjustment Schedule Incentive Cost Incentive

(5) Source-selection procedures

IFB LPTA BVTO

A FFP construction contract was selected for use based on past acquisition history and clearly defined requirements for this procurement. This provides maximum incentive for the contractor to control costs and perform effectively and imposes a minimum administrative burden upon the contracting parties.

N/A it is unlikely that incentivization would improve cost or performance

The Specifications are clearly identified for offerors to bid on the subject action.

As such, the Requirement is relatively standard and technical capabilities. Award will be made to the lowest priced bidder deemed responsible.

A Sources Sought was posted on SAM.gov from 21 FEB 2023 through 08 MAR 2023. This resulted in five (5) responses, four (4) of which were small businesses.

Two (2) of which are considered capable. The remaining small business that replied to the source sought did not demonstrate the necessary capabilities in their submittal that they could perform the work. Based on lack of competition in recent years, where we did not receive sufficient small business responses to the solicitation, it is recommended to solicit as full and open.

(6) Acquisition considerations.

(7) Budgeting and funding

Identify any particular acquisition considerations including:

Dredging requires specialized equipment and capabilities not typically maintained by the Government. Self-performance would require costly maintenance and would be highly impractical.

Type of Contract. One FFP construction contract will be awarded lowest priced bidder deemed responsible under FAR Part 14 to award to the contractor determined to be responsive and responsible. The scope of work for this project does not include any activities that are considered high-risk or of a nature that would be unusual for a large number of contractors to perform. Based on the market research previously described for this requirement, there is a sufficient number of contractors available to perform this work under a firm fixed-price structure.

Contract Incentives. Not applicable to this procurement Multi-year Contracting. Not applicable to this procurement.

Sealed Bidding or Negotiation. This requirement will use FAR Part 14 , Sealed

Bidding Performance Based Contract. Performance based is not applicable to this procurement.

Use of Non-DoD Contract. Not applicable to this procurement

Options (if applicable)

Three (3) options have been incorporated into the solicitation and all have an equal opportunity of being awarded. Options 1 and 2 would allow additional areas of the Federal Navigation Channel to be dredged. Option 3 would involve earthwork at Erie Pier CDF.

O&M funds; all funds for award of the base contract are in place. We have received all funds authorized.

The amount budgeted for this construction contract is:

Base contract: $1,682,188 O&M Funds received: $2,628,450

(8) Priorities, allocations, and allotments.

(9) Make or buy

(10) Logistics considerations.

(11) Government-furnished property.

(12) Government-furnished information.

Government will prepare Ready to Advertise plans and specifications.

There is no urgency for this requirement that dictates a particularly short delivery or performance schedule, so no priorities, allocations or allotments apply.

N/A

No.

The contractor will have to ensure that quality and safety is maintained throughout construction. The contractor will be required to develop and implement quality and safety plans, which meet the Governments requirements, throughout the project.

FAR 52.246-12, Inspection of Construction, is included in the solicitation and will be applicable during construction.

(13) Environmental and energy conservation objectives.

(14) Security considerations.

Is the contract for information technology?

Yes

No

(15) Contract administration

(16) Other considerations.
