About this file

This document is a brand name justification for the procurement of 1,000 Box software licenses. The U.S. Army Mission and Installation Contracting Command at Fort Sam Houston is seeking these licenses to replace the soon-to-be downgraded storage capacity of the MilDrive platform currently used by the Judge Advocate General's Corps (JAGC). The Box software is necessary to meet JAGC's requirements for cloud-based storage of over 50 gigabytes, real-time collaborative editing capabilities, editing of Microsoft Office files within the platform, support for both CAC and non-CAC users, and approval by the Joint Staff J6 Portal and Defense Information Systems Agency. Interested vendors must be authorized Box resellers who responded to a sources sought notice by September 16, 2020. The contract resulting from solicitation W9124J-20-R-EE26 is estimated at $1.2 million over three and a half years beginning September 30, 2020.

Control No.: MICC 2020-104 Program/Equipment: Box Software Licenses

Version – March 2017 FOR OFFICIAL USE ONLY

Small Business Specialist, Small Business Program:

Contracting Office Division Chief:

Director, MICC-Fort Sam Houston:

Assistant Director, Small Business Program:

g. Box's auditing and logging ability is unmatched in the marketplace with the ability to create and view, in-depth audit reports tracking all user actions conducted within the platform, such as tracking document views, downloads, edits, and uploads. This provides JAGC with centralized control and audibility on how content is being used across the organization and thus reduces security risk, and is in alignment with DoD’s increased focus on cyber security and data protection as demonstrated by Box being able to obtain DISA’s Provisional Authorization.

h. Based on the above, the brand name Box Software is essential to meet the current needs of JAGC. No other brand name software can be considered due to the limited capabilities identified on other similar software currently on the market, and due to the JSP and DISA approvals required. Box is the only CSM that meets all six (6) essential requirements for JAGC CSM. BOX will meet the needed storage capacity, real time editing, in app editing of MS office files, CAC and Non-CAC support, and the critical need to be approved by JSP. As such, the brand name Box Software is currently the only product that can meet all of JAGC’s requirement.

i. Impact if justification not approved. If this justification is not approved, JAGC will continue to rely on the limited capabilities that MilDrive offers. JAGC has a constant need to collaborate and communicate with Non-DoD partners, an essential capability that MilDrive does not have. Without this capability JAGC will have to continue working with Non-DoD partners through electronic email to communicate and share documents requiring the downloading and uploading of working documents. The current and inefficient administrative work process has a high probability for human error to occur, and is doubling the efforts and time to complete various administration tasks. MilDrive will also fail to meet JAGC’s storage capacity need which is currently at 50 plus Gigabytes (GB) which is expected to grow. MilDrive individual accounts will be restricted down to 20 GB of storage capacity instead of the 1 Terabyte (TB) currently in use. This reduction in storage capacity will become effective towards the end of September 2020, thus JAGC is in need of the Box licenses to continue its routine and normal business operations. The purchasing of the Box software licenses will also allow JAGC to have their own software contract and receive timely technical support service. This will eliminate the need of having to go through DISA’s multi-tier customer support system to determine the level of support required before having to be directed to JSP to obtain a final technical support resolution. Having timely technical support is crucial to minimize interruptions and delays caused by technical software issues.

6. Efforts to Obtain Competition: This requirement has a brand name restriction that will limit competition. In an effort to identify other potential vendors a sources sought notice was issued through beta.sam.gov on 9 September 2020 for 6 days and revealed the interested and capable sources identified in Table 2 of Paragraph 9 of this J&A.

7. Actions to Increase Competition: The JAGC will continue to monitor for the JSP and DISA approvals of other CMS products that can meet their software needs in order to expand the contracting opportunity to a larger pool of vendors. Contractors will also be strongly encouraged to offer subcontracting opportunities in order to assure maximum and adequate amount of resources are obtained to achieve the needs of this requirement.

8. Market Research: Market research details are included below; however, full market research details are documented on the Market Research Report.

a. The Army’s Computer Hardware, Enterprise Software and Solutions (CHESS) program is the mandatory source for commercial information technology (IT) hardware and software purchases regardless of dollar value or appropriation IAW AFARS 5139.101-90. Any IT hardware or software purchase made outside of the CHESS contracts requires an Army Chief Information Officer (CIO)/G6 approved Information Technology Approval System (ITAS) Waiver. Supporting documentation must include documentation submitted with the ITAS Waiver request such as a CHESS Statement of Non-Availability (SONA) for items that are not available from CHESS or other rationale for not using CHESS. The SONA for this requirement was approved by CHESS on 20 May 2020, and the ITAS waiver to purchase this requirement outside the CHESS Program was approved by the Army CIO/G6 on 31 July 2020.

b. Market research has revealed that GSA and NASA have established

Government-wide Acquisition Contracts that can support this requirement. However, it is not in the best interest of the Government to pay for the additional fees charged by GSA currently at 0.75% and NASA SWEP currently at 0.36%. Due to the total value of this requirement after exercising all options, this added fee will be significant; thus, it will not be cost beneficial to utilize these non-DoD contract vehicles. Any accurate discounts gained when utilizing these contract vehicles were not able to be obtained to determine the cost effectiveness of using these non-DoD contracts. IAW DFARS 217.770(a)(3) the use of a non-DoD contract vehicle shall be determined cost effective.

c. The Government will procure this requirement using the procedures outlined in FAR Part 13, Simplified Acquisition Procedures and will acquire this requirement as a commercial item under FAR Part 12, Acquisition of Commercial Items.

d. Due to the possibility of not being able to obtain quotes from two or more small business concerns, this requirement will not be set aside for small businesses. This requirement shall be solicited through the GPE (beta.sam.gov) as an unrestricted acquisition, utilizing NAICS 511210, IAW FAR 13.501, brand name acquisitions. This procurement shall result in a firm-firm-price (FFP) contract award.

9. Interested Sources: Box authorized resellers are available through GSA and NASA SEWP GWACs. In an effort to have these potential sources respond along with other authorized resellers in the open market, a sources sought notice was issued through beta.sam.gov on 9 September 2020 for 6 days and revealed the results as captured in the following table.

13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable. This determination will be made using price analysis and comparison with the IGCE. As a part of this basis, certified cost or pricing data is not required because the item and/or services being acquired are considered commercial.
