SECTION C—DESCRIPTION /SPECIFICATIONS/STATEMENT OF WORK

C-1 SUMMARY OF WORK

This contract involves critical updates to the dry pipe fire system at the Johnston Ridge Observatory (JRO). The overall work aspects consist of the following:

- Accomplish complete replacement of all dry pipe sprinkler piping, mains, branch line, and sprinkler heads in certain areas of the facility.

- In areas were the current dry sprinkler piping, mains, and branch lines are in good condition, replacement of the dry pendent sprinkler heads will occur.

- Installation of permanent access panels will be installed throughout the facility for access to sprinklers and associated piping.

- Installation of a nitrogen generator system to improve corrosion resistance, maintenance, and longevity of the piping.

- Replacement of current fire panel and associated devices with a new fire panel and associated devices. The system will continue to be connected to the Johnson Control Inc. (JCI) Metasys Building Automation System (BAS).

The contract will begin on July 5, 2021. The Owner is open to field investigations, project submittal work, and other off-site work to occur prior to October 4, 2021. It is expected that on-site work will begin when the visitation season slows down in the fall, as the center will be open to the public during construction. It is estimated that on-site work will begin October 4, 2021. It is anticipated that the contract will be completed by the time access is restricted by snow, which is expected to be December 1, 2021. As a result, there will be 149 contract day to accomplish the work within the contract.

Note, work can start each day as early as 5:00 am and work can occur as late as 6:00 pm, Monday- Friday. Work during the weekends and on Federal holidays are not allowed, unless requested to and approved by the Owner.

C-2 PROJECT LOCATION

The project site locations are at JRO and access to the site is described below:

- From Castle Rock, WA, travel eastbound on State Route 504 for approximately 49.0 miles, to the end of the road system. At the end of the road system is where JRO is located.

C-3 CURRENT CONDITIONS AND TASKS TO ACCOMPLISH

Architectural

The existing ceilings are to remain. New 24” x 24” metal ceiling access panels are to be provided in all hard-lid ceilings adjacent to each fire sprinkler head. Five different ceiling access panels will be provided for each specific ceiling type, wood panel, gypsum wall board, 1 hour rated gypsum wall board, acoustical plaster, and textured painted exterior gypsum wall board. The existing acoustical panel ceilings are to be removed as required for fire sprinkler work and reinstalled once complete. No new access panels are anticipated in the existing Women’s Room 103, Janitor Room 102, and Men’s Room 101 since there is adequate space above the existing ceilings for access to the existing fire sprinkler system.

Smaller 12” x 12” ceiling access panels can be provided in lieu of 24” x 24” where it is determined the smaller opening will provide adequate access. Two existing light fixtures located in A/V Room 111 are to be removed and relocated for new ceiling access panels.

Fire Protection

The project includes deferred maintenance and repair of the existing dry pipe fire sprinkler system to bring the system into conformance with NFPA 13 and NFPA 25 requirements. As identified in the 12/6/2016 Evaluation Report, dry pendent sprinkler heads are in need of replacement and interior pipe investigations identified a severely corroded section of the system at the NE corner of the building that cannot be repaired and must be replaced.

The existing dry pipe system is an appropriate system type given the seasonal operation, cold temperatures, and high wind conditions at the site. The existing dry pipe system is hydraulically calculated and provided with a suitable water supply from an existing water tank and fire pump. The dry pipe system will remain unchanged from a hydraulic design standpoint, and the scope of work is considered maintenance, rather than a new installation, in accordance with NFPA 25.

The dry pendent sprinkler heads have been identified and shown on the drawings. The manufacturer and model of the sprinklers has been identified and suitable replacements are available. As dry pendent sprinklers must be ordered to length for each location, the work will involve the sprinkler installer to measure each existing dry pendent sprinkler, ordering the appropriate replacement sprinklers, and replacing each sprinkler at the point of connection to the sprinkler branch line above. To meet current seismic requirements, oversized escutcheons will be provided where dry pendent sprinklers are located in suspended grid ceilings to allow differential movement between the sprinkler head and ceiling tiles.

New piping and fittings will be limited to the Men’s, Women’s, and Storage Room area. Pipe sizing will match the existing piping as a one-for-one replacement. In lieu of the schedule 10 piping that was originally installed, schedule 40 piping will be used as it has a longer service life due to the greater wall thickness. The new piping will be sloped to drain to eliminate trapped water, which was the cause of the corrosion in the original installation.

To further improve corrosion resistance in the system, a nitrogen generation corrosion inhibiting system will be provided. The system will replace the existing air compressor.

At the conclusion of the work, the new piping in the restroom area will be hydrostatically tested at 200 psi for 2 hours as required by NFPA 13. After successful hydrostatic testing, the new piping will be connected to the existing system and after replacement of all dry pendent sprinkler heads, an air test of 40 psi for 24 hours will be performed as required by NFPA 13. After successful air testing, a trip test of the dry pipe system will be conducted, followed by a working pressure test for 2 hours at system static water pressure to ensure no leaks exist. At the conclusion of the tests, the sprinkler installer will fully drain the system, quick fill the piping with air, and then activate the nitrogen generation corrosion inhibiting system and auto purge valve so that the system will automatically be maintained at a minimum of 98% nitrogen.

Fire Panel and Devices

The current fire panel is the original panel and needs to be replaced with a new system. It is expected that the new system will be of the same make/model (unless newer model is available) of the current fire panel so that downstream devices (such as smoke detectors, heat sensors, and other notification devices) can continue to be used. It will be necessary to evaluate down stream devices to determine serviceability, and if serviceability is compromised, replace them as necessary. It is also assumed that the current wiring of the fire panel and associated devices will be serviceable. The current fire panel and associated devices are connected to/ monitored by a JCI BAS. It is necessary that the new fire panel system and associated devices are connected and monitored by the JCI BAS. It will also be necessary to ensure that the new fire panel system is tested via the JCI BAS.

I-2 FAR 52.217-7 Option for Increased Quantity—Separately Priced Line Item (MAR 1989)

The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within 60 days. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.

I.3 FAR 52.225-9 BUY AMERICAN ACT—CONSTRUCTION MATERIALS (FEB 2021)

(a) Definitions. As used in this clause—

“Commercially available off-the-shelf (COTS) item”—

(1) Means any item of supply (including construction material) that is—

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.

“Component” means an article, material, or supply incorporated directly into a construction material.

“Construction material” means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

“Cost of components” means— https://acquisition.gov/far/current/html/Subpart%202_1.html#wp1145508 http://uscode.house.gov/

(3) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(4) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

“Domestic construction material” means—

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if—

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which non availability determinations have been made are treated as domestic; or

(ii) The construction material is a COTS item.

“Foreign construction material” means a construction material other than a domestic construction material.

“United States” means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows: None

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that—

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American statute is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American statute to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American statute.

(1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including— http://uscode.house.gov/ http://uscode.house.gov/ https://acquisition.gov/far/current/html/Subpart%2012_5.html#wp1077123

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material.

However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

FOREIGN AND DOMESTIC CONSTRUCTION MATERIALS PRICE COMPARISON

Construction Material Description Unit of Measure Quantity Price (Dollars)* Item 1:

I.4 FAR 52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds –

(1) To unsuccessful bidders as soon as practicable after the opening of bids, and (2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be 20 percent of the bid price.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

52.228-11 Individual Surety - Pledge of Assets (FEB 2021) (DEVIATION APR 2020)

(a) The Contractor shall obtain from each person acting as an individual surety on a performance bond or a payment bond -

(1)A pledge of assets that meets the eligibility, valuation, and security requirements described in the Federal Acquisition Regulation (FAR) 28.203-1; and

(2) Standard Form 28, Affidavit of Individual Surety, [except that the words “being duly sworn, depose and say” on the Standard Form 28 are replaced with the word “affirm” and the Standard Form 28 is not required to be sworn and notarized in block 12].

(b)The Contracting Officer may release a portion of the security interest on the individual surety's assets based upon substantial performance of the Contractor's obligations under its performance bond. The security interest in support of a performance bond shall be maintained—

(1) Contracts for the construction, alteration, or repair of any public building or public work of the Federal Government exceeding $150,000 (40 U.S.C. 3131). Until completion of any warranty period, or for 1 year following final payment, whichever is later.

(2) Contracts subject to alternative payment protection (see FAR 28.102-1(b)(1)). For the full contract performance period plus 1 year.

https://www.acquisition.gov/far/part-28#FAR_28_203_1

(3) Other contracts not subject to the requirements of paragraph (b)(1) of this clause. Until completion of any warranty period, or for 90 days following final payment, whichever is later.

(c)A surety's assets pledged in support of a payment bond may be released to a subcontractor or supplier upon Government receipt of a Federal district court judgment, or a sworn statement by the subcontractor or supplier that the claim is correct along with a notarized authorization of the release by the surety stating that it approves of such release. The security interest on the individual surety's assets in support of a payment bond shall be maintained—

(1) Contracts for the construction, alteration, or repair of any public building or public work of the Federal Government exceeding $150,000 which require performance and payment bonds (40 U.S.C. 3131). For 1 year following final payment, or until resolution of all pending claims filed against the payment bond during the 1-year period following final payment, whichever is later.

(2) Contracts subject to alternative payment protection (see FAR 28.102-1(b)(1)). For the full contract performance period plus 1 year.

(3) Other contracts not subject to the requirements of paragraph (c)(1) of this clause. For 90 days following final payment.

(d)The Contracting Officer may allow the Contractor to substitute an individual surety, for a performance or payment bond, after contract award. The Contractor shall comply with the requirements of paragraph (a) of this clause within the timeframe established by the Contracting Officer.

52.228-15 Performance and Payment Bonds -- Construction (JUN 2020) (DEVIATION APR 2020)

(a)Definitions. As used in this clause -- “Original contract price” means the award price of the contract; or, for requirements contracts, the price payable for the estimated total quantity; or, for indefinite-quantity contracts, the price payable for the specified minimum quantity. Original contract price does not include the price of any options, except those options exercised at the time of contract award.

(b) Amount of required bonds. Unless the resulting contract price is valued at or below the threshold specified in Federal Acquisition Regulation 28.102-1(a) on the date of award of this contract, the successful offeror shall furnish performance and payment bonds to the Contracting Officer as follows:

(1) Performance Bonds (Standard Form 25, EXCEPT THAT A SEAL IS NOT REQUIRED).

The penal amount of performance bonds at the time of contract award shall be 100 percent of the original contract price.
