About this file
This is a Federal Required Certification document related to a City of Pasadena Water and Power Department (PWP) procurement for four electric cargo vans with custom upfitting in California. The certification, based on 44 C.F.R. Part 18 and Appendix A, establishes lobbying compliance requirements for contractors participating in federally funded contracts, grants, loans, and cooperative agreements. The document requires the contractor's authorized official to certify that no federal appropriated funds have been or will be paid to influence federal agency officials, Members of Congress, or congressional staff in connection with the award of this contract or any modifications thereof.
The certification mandates contractor disclosure of any non-federal funds used for lobbying purposes through submission of Standard Form-LLL and requires inclusion of identical certification language in all subawards and subcontractor documents. Contractors must understand that the certification constitutes a material representation of fact and that submission is a prerequisite for contract award under 31 U.S.C. Section 1352. Failure to comply with certification requirements subjects contractors to civil penalties ranging from $10,000 to $100,000 per violation, and the provisions of 31 U.S.C. Chapter 38 regarding administrative remedies for false claims and statements apply to all certifications and disclosures made.
