About this file
This is a Federal Required Certification document applicable to the Pasadena Water & Power (PWP) Personal Protective Equipment procurement in California. The certification pertains to lobbying activities and compliance requirements under 44 C.F.R. Part 18 and 31 U.S.C. Section 1352. The document establishes that contractors must certify no federal appropriated funds have been or will be used to influence federal officers, Members of Congress, or their employees in connection with the contract award. Any use of non-federal funds for lobbying purposes requires submission of Standard Form-LLL, Disclosure Form to Report Lobbying, completed in accordance with prescribed instructions.
The certification imposes mandatory compliance requirements on all contractors and subrecipients at all tiers of the contract structure, including subcontracts and subgrants. Contractors must include the certification language in all award documents and require subrecipients to certify and disclose accordingly. Failure to file the required certification subjects the contractor to civil penalties ranging from $10,000 to $100,000 per violation. The contractor's authorized official must sign the document, affirming the truthfulness and accuracy of all statements. The certification is considered a material representation of fact and a prerequisite for contract execution, with provisions of 31 U.S.C. Chapter 38 regarding administrative remedies for false claims and statements applying to all certifications and disclosures submitted.
