vi) Description
STATEMENT OF WORK (SOW) – DARK FIBER CIRCUITS
BACKGROUND
The U.S. Food and Drug Administration (FDA) impacts the lives of Americans every day. The FDA’s information technology investments are closely aligned with the mission and goals of the FDA to ensure the safety, efficacy, and security of human and veterinary drugs, biological products, medical devices, our nation’s food supply, cosmetics, and products that emit radiation.
The FDA currently leases dark fiber circuits from Zayo which are being used within the FDA’s DC Metro Area Network. Zayo brings fiber into the FDA buildings and terminates it on a fiber patch panel which is Zayo’s demarc.
Zayo does not have any other equipment at FDA facilities. The FDA connects GFE (network router or switches) into Zayo fiber patch panel. Circuit speed is controlled by the FDA and is dependent upon on the fiber transceiver plugged into the GFE router or switch. These fiber circuits are used as the backbone of the FDA’s network and critical to all functions of our datacenters and office buildings.
Dark Fiber Locations The delivery order resulting from award of this requirement shall include the lease and maintenance of dark fiber circuits.

ix) The provision at 52.212-2, Evaluation—Commercial Items (Oct 2014), is applicable to this requirement. The specific evaluation criteria to be included in paragraph (a) of that provision are as follows:
The Government intends to issue a single-award contract resulting from this solicitation to the offeror whose offer conforming to the solicitation and represents the best value Lowest Price Technically Acceptable (LPTA) to the Government. The Government will award a contract to the offeror who can satisfy the requirements contained in the Statement of Work and has submitted a proposal which represents a fair and reasonable cost to the Government and has provided the necessary technical capabilities to fulfill the requirements set forth in this solicitation. The Government reserves the right to award a contract without conducting exchanges. Therefore, the Offeror’s initial proposal should represent its best effort to perform the work described herein.
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are exchanges after its receipt, unless a written notice of withdrawal is received before award.
Evaluation Factors Best value will be obtained using a Lowest Price Technically Acceptable (LPTA) process, which allows the Government to accept the lowest priced proposal.
The following shall be used to evaluate offers and (listed in descending order of importance):
• Technical – Overall Technical Understanding/Approach
• Past Performance
• Price
Technical – Overall Technical Understanding/Approach Evaluation The Government will evaluate:
• The extent the proposed technical approach demonstrates an understanding for achieving the objectives set forth in the Statement of Work. The Government will also evaluate the extent the technical proposal demonstrates an understanding and capability to perform tasks identified in the following sections:
• Task Area 1 – Existing Dark Fiber
• Task Area 2 – Service Level Agreements
• The extent to which the proposed technical approach identifies applicable risks relevant to the services to be provided and demonstrates the ability to successfully mitigate risks.
• The extent the proposed technical approach demonstrates current staff have the appropriate skills, expertise, certifications, and relevant experience as described in the Labor Category description section of the SOW to perform the tasks.
Past Performance
The Government will evaluate past performance as a risk assessment; not as a weighted technical evaluation factor.
The Government will assess the relative risks associated with each offer. Performance risks are those associated with an Offeror's likelihood of success in performing the acquisition requirements as indicated by that Offeror’s record of past performance.
The assessment of performance risk is not intended to be a product of a mechanical or mathematical analysis of an Offeror's performance on a list of contracts but rather the product of subjective judgment by the Government after it considers relevant information.
When assessing performance risks, the Government will focus on the past performance of the Offeror as it relates to providing relevant SOW services and any other relevant acquisitions such as the Offeror's record of performing according to specifications, including standards of good workmanship; the Offeror's record of controlling and forecasting costs; the Offeror's adherence to contract schedules, including the administrative aspects of performance; the Offeror's reputation for reasonable and cooperative behavior and commitment to customer satisfaction; and generally, the Offeror's business-like concern for the interest of the customer.
The government is seeking to determine whether an Offeror has consistently demonstrated a strong commitment to customer satisfaction and high performance of services. This is a matter of judgment. The government will assess the relative risks associated with each Offeror. Performance risks are those associated with an Offeror’s likelihood of success in performing the acquisition requirements as indicated by that Offeror’s record of past performance.
The Government will be searching relevant government databases to understand if the Offeror has complaints registered against them from other government contracts. If found FDA may contact these former customers for clarifications on issues.
If the performance information contains negative information on which the Offeror has not previously been given an opportunity to comment, FDA will provide the Offeror an opportunity to comment on it prior to its consideration in the evaluation, and any Offeror comment will be considered with the negative performance information.
The Government will consider the currency and relevance of the information, source of the information, context of the data, and general trends in the Offeror's performance. The lack of a past performance record may result in an unknown performance risk assessment, which will neither be used to the advantage nor disadvantage of the Offeror.
Price
The Evaluated Price will be the Total Price for all years, base plus 4 option years for all the Fibers/lines identified in the pricing table. The Government will evaluate the Offerors price based on how clearly, they state the overall cost to the Government for the Base and Four Option Years by submitting a breakdown of how the per line pricing is derived. Providing details on how much it will cost to do these line items and provide how pricing was created. If these are commercial rates, provide where they are coming from or if they are published. Submitting pricing both on an Excel Spreadsheet and Word document. Offeror shall provide discounts.
