Solicitation FA8601-13-R-0026, Integrated Solid Waste Management AMENDMENT/Questions & Answers- March 26, 2013

• Addition to solicitation text: In addition to other requirements of the solicitation, submitted proposals should include a copy of each amendment/modification posted on FBO for the Integrated Solid Waste Management solicitation with the contractor’s signature.

• Delete: Provision DFARS 252.209-7999 from solicitation.

252.209-7997 - REPRESENTATION BY CORPORATIONS REGARDING AN UNPAID

DELINQUENT TAX LIABILITY OR A FELONY CONVICTION UNDER ANY FEDERAL

LAW—DOD APPROPRIATIONS. (DEVIATION 2013-O0006) (JAN 2013)

(a) In accordance with section 101 (a) (3) of the Continuing Appropriations Resolution, 2013, (Pub. L. 112-175) none of the funds made available by that Act for general appropriations for DoD may be used to enter into a contract with any corporation that—

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, unless the agency is aware of the unpaid tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government.

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless the agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

(b) The Offeror represents that—

(1) It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability,

(2) It is [ ] is not [ ] a corporation that was convicted of a felony criminal violation under a Federal law within the preceding 24 months. (End of provision)

• Add: FAR clause 52.222-17 to the solicitation by reference

Additional Questions:

1. The concern is the PWS requirement that the contractor is responsible for container cleaning.

This requirement in itself is not unusual but not defining the number of cleanings required does not enable the contractor to know what its operating costs will be.

ANSWER: PWS, Table A-2 has been updated to add a column for frequency of cleaning containers. The cleaning of container verbiage can be found in PWS 1.4. Updated PWS (dated March 22, 2013) to include this additional information to the table is now attached to the FBP posting.

2. I think there may be an error on the latest set of documents posted to FBO.

MOD 1 - REVISED CLINS: Regarding CLIN #0032 & #0033, Discrepancies between Disposal Fees and Generation Fees at the Medical Center. The sanitary disposal fees in the base year is 260 tons whereas the generation fees are only 250 tons. Each of the remaining option years now lists sanitary disposal fees as 260 tons and generation fees at 750 tons.

Shouldn't the sanitary disposal fees and generation fees match for each period?

ANSWER: The CLIN amounts are to remain as stated.

3. I think there may be an error on the latest set of documents posted to FBO.

MOD 2 - REVISED PWS: The cover sheet on the latest PWS posted to FBO is dated January 22, 2013. The yellow highlighted portions of the latest document (Maintenance of Govt Containers & the Lugger Locations on Appendix A Table 2) are identical to the previous PWS dated February 4th, 2013.

Was the intention to make additional changes to these sections? The only actual difference between the latest PWS and the February 4th version that I identified was related to asbestos collection. Are there any other changes that were made to the latest PWS that have not been highlighted?

ANSWER: The yellow highlighted portion was noted for internal use. There is no significance to it being highlighted. Change made had to do with asbestos collection.
