I. Contracting Activity.

II. Nature and/or description of the action being processed.
This Individual Justification and Approval (J&A) authorizes use of other than full and open competition procedures to procure:
Quantity: One (1) Cass Chiller #3 Replacement in Building 2122
The resulting new contract is brand name, “C” type with associated services.
Commercial Commodity, Contract Type: Firm-Fixed Price (FFP).
The Contractor shall remove, supply, and install all necessary components and parts to replace one (1) Trane Chiller in Building 2122. The Contractor shall ensure all items are in full operational capacity and provide training to engineers and maintenance personnel.
Total estimated cost of equipment, removal, install and training:
Estimated Award Date of Contract: 1 May 2017.
Acquisition History: A previous contract (FA8125-16-M-0035) was awarded on a competitive basis to on 4 May 2016 for for the same type of equipment. The solicitation was issued competitively for the same requirement but different model number as a brand name purchase. Upon completion of the solicitation, four companies responded. Due to competition received from the solicitation, the Government was able to award to the Lowest Price Technically Acceptable (LPTA) contractor.
AMXG is requesting the replacement of one (1) Trane Chiller. It is used in support of the B-1B Centralized Aircraft Support System. This is a critical system that protects the aircraft electronics/electrical systems from heat damage while in dock. Due to normal wear and tear, the existing obsolete chiller is currently failing and has been determined to be un-repairable. This requirement will include the removal and disposal of the existing unit and installation of a new Trane Chiller Model # RTAC-1554-UXXH-UAGN-W1TY-1CDB-NA5U-A10A- GEEX-N.
III. Description of supplies/services required to meet agency needs.
Supply Contract: The proposed contract shall include the following:
Contractor shall remove:
(2) Sixty Ton Trane Chillers -All associated components such as refrigerant, chill water pipe, electrical disconnects and any other components associated with the existing equipment.
Contractor shall provide all labor, tools, equipment, test equipment, material, parts, quality control, transportation, inspection manuals, training, and any other items or services necessary for:
(1) Trane 155 CASS Chiller with manufacturer's equipment specifications and the applicable Statement of Work (SOW)

Funding: The funding source for the resulting contract is through 76 AMXG's Fiscal Year 2017 DMAG Funding.

Description of Services: The Contractor shall provide the specified chiller to building 2122 at Tinker AFB, OK. New chiller shall be a Trane, Model: RTAC-1554-UXXH-UAGN-W1TY-1CDB-NA5U- A10A-GEEX-N. The Contractor shall provide all labor, equipment, parts, consumables, transportation, and any other items and services necessary to provide a complete turn-key system. The Contractor shall complete all work without disturbing the current processes. Shut-off valves are available on each pipe to isolate the chiller from the chill water system. Installation shall include integrating chiller with existing controls and other existing equipment. All services shall conform to NFPA 101, NFPA 70, and general industry standards. The Contractor shall provide and use only new parts and materials. The Contractor shall provide start-up upon completion. The Contractor shall provide 8 hours training to engineers and maintenance personnel explaining chiller controls and operation at a minimum. The Contractor shall provide a full warranty on all components and workmanship for a period of no less than one (1) year after the date of final acceptance. Government use of the chiller before the date of final acceptance shall not be deemed part of the warranty period. All warranty work shall be completed on-site at Tinker AFB.
IV. Statutory authority permitting Other than Full and Open Competition.
The authority for this action is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(c)(ii)(A)), "Application for brand name descriptions", required by FAR 6.303-2(b)(4).
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The Trane Chiller located in Building 2122 is viewed as a vital Centralized Aircraft Support System (CASS) for the B-1B. This is a critical system that protects the aircraft electronics/electrical systems from heat damage while in dock.
Market research was conducted and found that the Trane Model is the only brand that is able to fulfill the Air Force's requirement. Based on the information gathered from market research, this item is Peculiar to One Manufacturer (FAR6.302-1(c)(ii)(A)). The Trane Chiller RTAC-1554-UXXH-UAGN-W1TY-1CDB-NA5U-A10A- GEEX-N produced by Trane is the only brand that will work in this application. The Trane Chiller RTAC-1554- UXXH-UAGN-W1TY-1CDB-NA5U-A10A- GEEX-N is a direct bolt-in replacement for the existing unit, (Trane, Model: CGAFC604AGA10000000000000T0000). The requested unit will eliminate the need for removal/ replacement of controls, hard line plumbing, electricity and concrete reinforced mounting and hardware for a different machine. This is an estimated savings of by going with the Trane unit and not replacing with some different type of machine. The CASS system (parent equipment) was custom designed and manufactured to work with the Trane unit and controls. This brand has proven to meet all our needs and works with current government systems.
The government currently lacks the license rights to perform the Installation Services of the Trane Chiller organically, or to solicit the contemplated contract under full and open competition. Although the government realizes that it has unlimited usage rights to form, fit, and function data as well as operation, maintenance, installation, and training data, such rights are insufficient for the government's needs as they are not detailed enough to accomplish the required installation of this item. Access to protected and licensed rights is required to accomplish these tasks and the OEM is unwilling to sell license rights to the government.
It is not possible to draft adequate specifications for the installation of this item or OEM unique and highly specialized capabilities without the data usage rights.
The 76 AMXG believes that award to any other source would result in unacceptable delays in fulfilling the Air Force's requirements, as well as cost the government substantially more as described above.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
The commercial requirement will be posted on FedBizOpps for public review and response IAW FAR 5.203. This requirement is for a Brand Name acquisition.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer will ensure the items identified for procurement are fair and reasonable prices to the Government. Price analysis IAW FAR 15.404-1(b) will be performed to determine price reasonableness on competitive prices provide by authorized distributors and comparison to recent historical prices paid by the Air Force for same or similar items and supported by a technical evaluation. Being a commercial item, certified cost and pricing data cannot be requested, however, other than certified cost and pricing data and redacted invoices of similar items can be requested for comparison.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
IAW Far 10.001(a)(2), market research has revealed these items are commercial as defined in FAR 2.101. Market research, in accordance with FAR Part 10, was conducted using SAM, Dynamic Small Business Search (http:// dsbs.sba.gov) defined by NAICS Code 238220 and telephone calls to vendors. Competition for this requirement is anticipated to be high based on the amount of BRAND NAME distributors identified and the results of market research.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The Government will continue to monitor the market for other chiller systems that are compatible in form, fit and function that will work within the existing infrastructure.
XII. Certification by the Contracting Officer.
The contracting officer's signature on the Coordination and Approval Document is evidence that he has determined this document to be both accurate and complete to the best of his knowledge and belief.
XIII. Certification by the technical/requirements personnel.
By their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified as accurate and complete all supporting data, which is their responsibility, contained herein IAW FAR 6.303-2((c).
