INSTRUCTIONS TO OFFERORS

Section L - Instructions, Conditions and Notices to Bidders Each Offeror is required to submit their proposal as specified in RFP provision 52.212-1, Instructions to Offerors- Commercial Items, along with the following addendum. Failure to provide any required information may result in an offer being determined non-responsive.

ADDENDUM - 52.212-1, Instructions to Offerors – Commercial Items

A. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein.

Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors.

Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of three (3) separate parts, Part I – Technical Capability, and Part II – Pricing.

B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

C. Specific Instructions.

1. Part I – TECHNICAL CAPABILITY - In accordance with PWS paragraphs 2.2 and 2.3 and 2.5, the onsite contractor shall be able to demonstrate expertise through a combination of education and experience. Section M - Evaluation Factors for Award

4. ADDENDUM – 52.212-2 – Evaluation – Commercial Items

1. BASIS FOR CONTRACT AWARD: The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation meets the Government’s technical, price and price related factors. To assure timely and equitable evaluation of the proposal, the offeror must follow the instructions contained herein. The proposal must be complete, self sufficient, and respond directly to the requirements of this solicitation. The response shall consist of two (2) separate parts, Part I - Technical Capability Proposal, and Part II – Price Proposal. The technical capability will be evaluated on an acceptable or unacceptable basis in accordance with the requirements stated in Addendum to FAR Provision 52.212-1, Instructions to Offerors-Commercial Items. Offerors shall meet all requirements established in this Addendum in order to be considered responsive to the requirements of this solicitation. The Government will select the proposal(s) whose technical capability is acceptable and lowest proposed price.

2. This is a LPTA source selection process.

3. Once proposals have been deemed Technically Acceptable and ‘Satisfactory’, price will be the final evaluation factor for contract award. The lowest priced, Technically Acceptable proposal will be awarded this requirement.

4. The Government reserves the right to award to a single awardee and reasonably expects to make one

(1) award.

A. EVALUATION

1. Technical Capability: The offeror’s technical capability will be evaluated and assigned one of the following ratings shown in the table below. The ratings depict how well the offeror’s technical proposal meets the requirements in accordance with the stated evaluation criteria and solicitation requirements set forth in Addendum to FAR Provision 52.212-1, Instructions to Offerors – Commercial Items.

RATING DEFINITION

Acceptable Meets specified minimum performance or capability requirements. A proposal must have no deficiencies to receive acceptable but may have one or more strengths.

Unacceptable Fails to meet specified minimum performance or capability requirements. The proposal has one or more deficiencies and is not awardable.

The rating of the offeror’s Technical Capability, alone with Price will determine whether or not the Government will consider the offeror for award. The Government will proceed as follows based on Technical Capability rating:

(a) If deemed technically acceptable: Proceed to evaluate offeror’s price proposal.

(b) If deemed technically unacceptable: Halt evaluations for that offeror. Unacceptable proposals will be removed from the competitive range and shall be deemed ineligible for award.

2. Price Evaluation: Proposals shall then be ranked according to proposed cost/price, from the lowest to highest, including the base year and all option years.

(a) The lowest priced offeror shall have an ‘Acceptable’ Technical rating. Award shall be made to the offeror.

(b) Total price will be calculated inclusive of the base year and all option years.

(c) Reasonableness. The Price Proposal must be complete and shall reflect a clear understanding of the requirements. Unrealistically low proposed prices, initially or subsequently, may be grounds for eliminating a Proposal from the competitive range either on the basis that the offeror does not understand the requirement or the offeror has provided an unrealistic Proposal.

B. ADDITIONAL INFORMATION AND GOVERNMENT RIGHTS

1. Communications: Communications conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revision. Offerors are cautioned to submit sufficient information and in the format specified in Addendum to FAR Provision 52.212-1, Instructions to Offerors – Commercial Items. Offerors may be asked to clarify certain aspects of their proposal or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system.

2. Government’s Intent to Award: The government intends to award a contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest. If discussions are held, discussions will only be held with those offeror’s determined to be in the competitive range.

3. Competitive Range: The Contracting Officer may determine that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted. The Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition.

4. A contract issued by the Contracting Office, signed by the Contracting Officer, is the only instrument by which Government funds are obligated. The Government reserves the right to cancel this solicitation, either before or after the closing date. If you proceed with work prior to receipt of a fully executed contract, you do so at our own risk.
