PART 1 GENERAL

1.1 REFERENCES

The publications listed below form a part of this specification to the extent referenced. The publications are referred to within the text by the basic designation only.

U.S. NATIONAL ARCHIVES AND RECORDS ADMINISTRATION (NARA)

40 CFR 247 Comprehensive Procurement Guideline for

Products Containing Recovered Materials

1.2 OBJECTIVES

Executive Order 13101, dated September 14, 1998, requires the Federal Government assume leadership in making efficient use of natural resources through the acquisition of items made with recovered materials. The Government's policy is to acquire, in a cost-effective manner, items composed of the highest percentage of recovered materials practical, consistent with maintaining a satisfactory level of competition without adversely affecting performance requirements or exposing supplier's employees to undue hazards from the recovered materials.

1.3 EPA DESIGNATED ITEMS INCORPORATED IN THE WORK

To comply with the affirmative procurement requirements of Section 6002 of the Resource Conservation and Recovery Act and Executive Order 13101, the Government requires the use of recycled and recovered materials and products identified in the Environmental Comprehensive Procurement Guidelines (CPG).

These materials and products and their respective recycled/recovered material content are identified in each respective section of the specification. The latest CGP product list, and the specific recycled-content requirements for each product, can be found on the EPA's website http://www.epa.gov/epaoswer/non-hw/procure/factshts.htm. EPA guideline items are viewed as the minimum that should be considered when evaluating recycled/reused materials. Other materials and products not listed, but commonly used in industry outside of the Government, shall also be considered. Material and product submittals for all recycled-content items shall list the recycled and recovered materials used and percentage content.

1.4 EPA PROPOSED ITEMS INCORPORATED IN THE WORK

Products other than those designated by EPA are still being researched and are being considered for future Comprehensive Procurement Guideline (CPG) designation. It is recommended that these items, when incorporated in the work under this contract, contain the highest practicable percentage of

Section 01 62 35 Page 2 recycled or recovered materials, provided specified requirements are also met.

1.5 EPA LISTED ITEMS USED IN CONDUCT OF THE WORK BUT NOT INCORPORATED IN

THE WORK

There are many products listed in 40 CFR 247 which have been designated or proposed by EPA to include recycled or recovered materials that may be used by the Contractor in performing the work but will not be incorporated into the work. These products include office products, temporary traffic control products, and pallets. It is recommended that these non-construction products, when used in the conduct of the work, contain the highest practicable percentage of recycled or recovered materials and that these products be recycled when no longer needed.

First consideration shall be given to salvage for reuse since little or no re-processing is necessary for this method, and less pollution is created when items are reused in their original form. Sale or donation of waste suitable for reuse shall be considered. Salvaged materials, other than those specified in other sections to be salvaged and reinstalled, shall not be used in this project.

1.6.2 Recycle.

Waste materials not suitable for reuse, but having value as being recyclable, shall be made available for recycling whenever economically feasible .

1.6.3 Waste.

Materials with no practical use or economic benefit shall be disposed at a landfill or incinerator.

1.7 SOLID WASTE DISPOSAL AND RECYCLING

1.7.1 Documentation

The Contractor shall record, document and report the total amount of construction/demolition debris and other solid waste that is generated and disposed of under this contract. The Contractor shall also record the total amount of debris and waste that has been recycled, salvaged and reused. The waste shall be recorded preferably by weight, but volume in cubic yards will also be acceptable. The Contractor shall provide the Contracting Officer Receipts of Recycled Materials and Receipts of Solid Waste on a periodic basis determined by the Contracting Officer.

Section 01 74 19 Page 4

The Contractor will salvage and reuse the construction/demolition debris to the greatest extent possible. Waste materials that cannot be salvaged and/or reused and have value as being recyclable, shall be recycled. Only materials unable to be economically salvaged or recycled shall be transported to a landfill or incinerator. Revenues or other savings obtained for recycling or returns shall accrue to the Contractor, except revenues generated from Base Recycling activities.

1.2 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

The current MPI, "Approved Product List" which lists paint by brand, label, product name and product code as of the date of contract award, will be used to determine compliance with the submittal requirements of this specification. The Contractor may choose to use a subsequent MPI "Approved Product List", however, only one list may be used for the entire contract and each coating system is to be from a single manufacturer. All coats on a particular substrate must be from a single manufacturer. No variation from the MPI Approved Products List is acceptable.

Samples of specified materials may be taken and tested for compliance with specification requirements.

In keeping with the intent of Executive Order 13101, "Greening the Government through Waste Prevention, Recycling, and Federal Acquisition", products certified by SCS as meeting SCS SP-01 shall be given preferential consideration over registered products. Products that are registered shall be given preferential consideration over products not carrying any EPP designation.

Take samples of each chosen product as specified in the paragraph "Sampling Procedures." Test each chosen product as specified in the paragraph "Testing Procedure." Products which do not conform, shall be removed from the job site and replaced with new products that conform to the referenced specification. Testing of replacement products that failed initial testing shall be at no cost to the Government.

1.4.1.2 Testing Procedure

Provide Batch Quality Conformance Testing for specified products, as defined by and performed by MPI. As an alternative to Batch Quality Conformance Testing, the Contractor may provide Qualification Testing for specified products above to the appropriate MPI product specification, using the third-party laboratory approved under the paragraph "Qualification Testing" laboratory for coatings. The qualification testing lab report shall include the backup data and summary of the test results.

The summary shall list all of the reference specification requirements and the result of each test. The summary shall clearly indicate whether the tested paint meets each test requirement. Note that Qualification Testing may take 4 to 6 weeks to perform, due to the extent of testing required.

Submit name, address, telephone number, FAX number, and e-mail address of the independent third party laboratory selected to perform testing of coating samples for compliance with specification requirements. Submit documentation that laboratory is regularly engaged in testing of paint samples for conformance with specifications, and that employees performing testing are qualified. If the Contractor chooses MPI to perform the Batch Quality Conformance testing, the above submittal information is not required, only a letter is required from the Contractor stating that MPI will perform the testing.
