SECTION K - REPRESENTATIONS, CERTIFICATIONS AND OTHER STATEMENTS OF OFFERORS

The following have been modified:

CERTIFICATION REQUIREMENTS

1. Offeror must hold an updated Certificate of Classification issued by the “registro Oficial de Contratistas de Obras del Estado” of the “Ministerio de Economia y Hacienda” covering the following groups, subgroups and categories. The certification documents must be incorporated in

PART II – TECHNICAL PROPOSAL.

The offeror, as holders of the respective certifications, shall be the only entity that performs the associated works.

The above general outline in no way limits or reduces the responsibility of the Contractor to perform all work as required by the statement of work and project drawings in order to provide a complete and operable facility.

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

SECTION L- PROPOSAL PREPARATION INSTRUCTIONS

A. General Instructions: This section provides general guidance for preparing proposals, as well as specific instructions on the format and content of the proposal. Throughout this section, the term “offeror” means the prime contractor submitting the proposal. The offeror’s proposal shall include all data and information requested and shall be submitted in accordance with these instructions. Any offeror who submits an incomplete package may be considered unacceptable. The offer shall be compliant with the requirements as stated in the Request for Proposal (RFP). A proposal that is sufficiently documented to support cost/price and technical requirements in a complete, orderly, and specific detailed manner will enable the Government to perform a thorough and fair evaluation. Non-compliance with the instructions of this RFP may result in an unacceptable proposal evaluation and the proposal may be eliminated from consideration for contract award.

B. Type of Acquisition: For this acquisition, the selection will be made using Lowest Priced Technically Acceptable (LPTA) procedures with the technical factor and subfactors evaluated on an acceptable/unacceptable basis.

C. Discrepancies and Ambiguities: If an offeror believes the requirements in these instructions contain an error, omission, ambiguities, or are otherwise unsound, the offeror shall immediately notify the CO in writing with supporting rationale no later than 10 calendar days after the RFP release.

D. Mistakes: Mistakes in offeror’s proposal shall be handled in accordance with FAR 14.407-4 as referenced in FAR 15.508.

E. Postponement of Proposal Closing Date: If a determination is made to postpone a proposal closing date, an announcement of the determination shall be posted to FBO and, if practicable, before issuance of a formal RFP amendment otherwise communicated to prospective offerors.

F. Post-Award/Pre-Performance Conference: A post-award/pre-performance conference will be scheduled by the Contracting Officer (CO) and held prior to the commencement of any work under the awarded contract. The offeror or their duly authorized representative is required to attend the post-award/pre-performance conference.

G. Contract Document: Sections K, L and M apply to the solicitation phase only; therefore, they will not be a physical part of the resulting contract.

NOTE: All questions and answers will be posted on FBO.

NOTE: Not attending the site visit will not result in an extension of the solicitation closing date and time.

Proposal Format and Submission Instructions

A. The proposal package must be completed and:

It must be hand delivered in CD form with .pdf format files (to include all three parts) to the address in Block 7 of the SF 1442.

Only electronic copies of the proposal will be accepted.

It is the offerors responsibility to ensure that the proposal reaches the office designated for receipt of proposals within the time established in the solicitation.

B. HAND-CARRIED PROPOSALS NOTICE: Offerors are cautioned that Morón Air Base has stringent visitor control procedures requiring individuals not affiliated with the installation to obtain a visitor pass and be cleared by the Government point of contact prior to entrance. Please contact the POC’s listed at least 3 days prior to the Solicitation closing date to coordinate delivery of hand carried proposals. All Third Country Nationals must notify the POC’s at least 10 days prior to the solicitation closing date, as they must be approved through ODC Madrid prior to requesting base access.

PART I – CONTRACT DOCUMENTATION AND PRICE PROPOSAL

SF 1442: Complete applicable blanks. In doing so, the offeror accedes to the contract terms and conditions as written in the RFP Sections A through J. Acknowledge all amendments issued to the solicitation (see Block 19 of the SF 1442)

A. Section B: Insert the proposed price for CLIN 0001 and CLIN 0002 and the TOTAL AMOUNT to provide a complete and usable end product in accordance with the terms and conditions stated in this solicitation. Offerors’ proposals not conforming to this RFP may be considered ineligible for award. The prices shall be valid through the proposal acceptance period (SF 1442 Block 13 D).

B. Section C through J: Complete applicable blanks, the offeror shall submit only those pages that require a fill-in.

C. Section K: Complete the representations, certifications, and acknowledgments. Section K shall be returned in its entirety. Submit all the required certificates.

D. Construction Cost Estimate Breakdown: The Construction Cost Estimate Breakdown will be used to perform proposal analysis if an unrealistically low proposal is received.

E. Letters of Agreement: The offeror shall provide Letter of Agreement (LOA) for all teaming partnerships, joint ventures, A/E Firm partnerships or significant subcontractors that will be performing as part of this contract. Changes will not be permitted after contract award without a valid justification and approval from the Contracting Officer

PART II -TECHNICAL PROPOSAL

Offerors shall meet the minimum standards of each Technical Factor and subfactor in order for their technical proposal to be determined “technically acceptable.” The standards are defined in Section M of the RFP.

Note: Offerors are responsible for ensuring their proposal meets the minimum requirements of the Statement of Work. See Section M – Other – Conformance to Specification Requirements.

A. Subfactor 1 – Past Experience: The offeror must submit one (1) example of design and one (1) example of construction performed that effectively demonstrates the offeror’s relevant experience related to performing work similar to that contained within the Statement of Work and of a similar magnitude. Past experience must be within five (5) years from the date this solicitation is posted.

B. Subfactor 2 – Schedule/Phasing Plan and Communications Plan: The offeror shall submit the scheduling/phasing plan in the form of Gantt chart, showing the relationship between activities, the critical path and any floats placed in the schedule. The communications plan may be in narrative form or chart form. It must explain method and frequency of effective communications between offeror, CE, Security Forces (USAF and Spanish Air Force) and Airfield Manager, in order to mitigate any risks and avoid schedule delays. These plans shall include at a minimum:

i. Design Schedule including site visits, site surveys, all meetings, and submittals

ii. Demolition schedule including site visits, site surveys, all meetings, and submittals

iii. Construction schedule including site visits, site surveys, all meetings, and submittals

iv. Communications Plan including method and frequency

The above general outline in no way limits or reduces the responsibility of the Contractor to perform all work as required by the Statement of Work and project drawings in order to provide a complete and operable perimeter fence.

SECTION M - EVALUATION FACTORS FOR AWARD

SECTION M – EVALUATION FACTORS FOR AWARD

A. Basis for Contract Award: This is a Lowest Price Technically Acceptable (LPTA) source selection conducted in accordance with Federal Acquisition Regulation (FAR) part 15, Contracting by Negotiation, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), the Air Force Federal Acquisition Regulation Supplement (AFFARS), DoD Source Selection Procedures, Appendix A, and Air Force Mandatory Procedures 5315.3.

These regulations are available electronically at the Air Force (AF) FAR Site, http://farsite.hill.af.mil.

B. Number of Contracts to be Awarded: The Government intends to award one (1) Firm Fixed

Priced (FFP) contract in response to this solicitation to the offeror who is deemed responsible in accordance with the FAR Subpart 9.1, as supplemented, whose proposal conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all information required by Section L and M of this solicitation) and is judged, based on the evaluation factors to represent the lowest price technically acceptable proposal. While the Government will strive for maximum objectivity, the source selection process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process.

C. Discussions: The Government intends to award without discussions; therefore, offerors should submit proposals that represent their best efforts. If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation

Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision. In the event discussions are to be conducted, a competitive range will be established IAW FAR 15.306(c)(2). The Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit effective competition. (10 U.S.C.

2305(b)(4) and 41 U.S.C. 3703).

D. Solicitation Requirements, Terms and Conditions: Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors and subfactors. Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award. Offerors shall clearly identify any exception to the solicitation terms and conditions and shall provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable.

EVALUATION PROCESS

Step 1: Review proposals and rank them by total price from lowest to highest.

Step 2: Conduct technical evaluations beginning with the lowest priced proposal. If the lowest priced proposal is determined to be technically unacceptable, then the next lowest priced proposal will be evaluated. Technical evaluations will continue until the lowest priced technically acceptable proposal is identified. The Government, at its discretion, may continue technical evaluations until the Contracting Officer determines that a sufficient number of technically acceptable proposals have been identified to permit determination of price fair and reasonable. The Government reserves the right to award without discussions. Only those offerors determined to be technically acceptable, either initially or as a result of discussions, will be considered for award.

EVALUATION FACTORS -

The following evaluation factors and sub-factors will be used to evaluate each proposal. The Government will evaluate proposals for acceptability, but will not rank the proposals by the non-price factors.

Factor 1: Price Factor 2: Technical Subfactor 1: Past Experience Subfactor 2: Schedule/Phasing/ Communications Plan

Factor 1 – Price: The evaluated price shall be the total price proposed by the offeror in Section B. The offeror’s total price proposal will be evaluated, using one or more of the techniques defined in FAR 15.404, in order to determine if it is fair, reasonable and balanced. Normally, adequate price competition establishes a fair and reasonable price (FAR 15.403-1(c)(1)(i)).

Factor 2 – Technical: For the purposes of technical evaluation, the term “offeror” will include any proposed teaming arrangements. The Government’s technical evaluation team shall evaluate the technical proposals on an acceptable or unacceptable basis, assigning one of the ratings described below for each factor. Any factor evaluated as “Unacceptable” will render the entire proposal unacceptable and, therefore, will not be eligible for award. Only those proposals determined to be technically acceptable, either initially or as a result of discussions, will be considered for award. However, the offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.

The proposals shall be evaluated against the following Technical Subfactors:

A. Subfactor 1 – Past Experience: The offeror must submit one (1) example of design and one (1) example of construction performed that effectively demonstrates the offeror’s relevant experience related to performing work similar to that contained within the Statement of Work and of a similar magnitude. Past experience must be within five (5) years from the date this solicitation is posted.

Minimum requirement has been met: This requirement is met when the offeror submits all information required per Subfactor 1 and demonstrates relevant experience related to performing similar work as contained in the Statement of Work and of similar magnitude.

B. Subfactor 2 – Schedule/Phasing/Communications Plan: The offeror shall submit the scheduling/phasing plan in the form of Gantt chart, showing the relationship between activities, the critical path and any floats placed in the schedule. The communications plan may be in narrative form or chart form. It must explain method and frequency of effective communications between offeror, CE, Security Forces (USAF and Spanish Air Force) and Airfield Manager, in order to mitigate any risks and avoid schedule delays. These plans shall include at a minimum:

i. Design Schedule including all significant actions, site visits, site surveys, all meetings, and submittals

ii. Demolition schedule including all significant actions, site visits, site surveys, all meetings, and submittals

iii. Construction schedule including all significant actions, site visits, site surveys, all meetings, and submittals

iv. Communications Plan including method and frequency

Minimum requirement has been met: This requirement is met when the offeror submits a complete, realistic, well-sequenced and effective schedule/phasing/communications plan that captures all Statement of Work requirements and conforms to the period of performance stated in the Section F of this RFP. The offeror shall demonstrate project completion showing all major elements of work to include percentage of each work element in accordance with the Statement of Work. The offeror shall also demonstrate an effective method and frequency of communication between offeror, CE, Security Forces (USAF and Spanish Air Force) and Airfield Manager, that mitigates any risks and avoids schedule delays
