COMPLIANCE WITH LOCAL LABOR LAWS (OVERSEAS) (JUN 1997)

(a) The Contractor shall comply with all--

(1) Local laws, regulations, and labor union agreements governing work hours; and

(2) Labor regulations including collective bargaining agreements, workers' compensation, working conditions, fringe benefits, and labor standards or labor contract matters.

(b) The Contractor indemnifies and holds harmless the United States Government from all claims arising out of the requirements of this clause. This indemnity includes the Contractor's obligation to handle and settle, without cost to the United States Government, any claims or litigation concerning allegations that the Contractor or the United States Government, or both, have not fully complied with local labor laws or regulations relating to the performance of work required by this contract.

(c) Notwithstanding paragraph (b) of this clause, consistent with paragraphs 31.205-15(a) and 31.205-47(d) of the Federal Acquisition Regulation, the Contractor will be reimbursed for the costs of all fines, penalties, and reasonable litigation expenses incurred as a result of compliance with specific contract terms and conditions or written instructions from the Contracting Officer.

Section L - Instructions, Conditions, and Notices to Offerors (Non-commercial)

PROPOSAL PREPARATION INSTRUCTIONS

A. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of Three (3) separate parts; Part I - Summary and Miscellaneous Data, Part II - Price Proposal and, Part III - Technical Proposal.

B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists within the parameters of FAR 15.305(a) (1), no additional data will be requested. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists, offerors may be required to submit other than certified cost or pricing data IAW FAR 15.402(a)(2) to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

C. Specific Instructions:

1. Only submit electronic copies of the proposal

2. Submit copies via email to the Government POC's in the posting.

D. Proposal Instructions:

1. PART I - SUMMARY AND MISCELLANEOUS DATA. Submit electronic copy only.

(a) The offeror shall provide a concise summary and master table of contents of the entire proposal.

(b) Complete blocks 14, 15, 16, 17 and 18 of the RFP Section A, SF1442 In doing so, the offeror accedes to the contract terms and conditions as written in the RFP Sections A through K. These sections constitute the model contract.

(c) Complete block 19, 20a, 20b, and 20c of the RFP Section A, SF 1442, if any solicitation amendment(s) to the original solicitation documents was/were issued. Amendments will not be counted against the page limits.

(d) Complete the necessary fill-ins and certifications in Sections I through K. Section K shall be returned in its entirety. For Sections C through I, the offeror shall submit only those pages that require a fill-in.

(e) If applicable, provide a copy of the letter from the Small Business Administration (SBA) showing proof of Section 8(a) status.

2. PART II - PRICE PROPOSAL - Submit electronic copy only.

(a) This part shall contain a completed Section B (Supplies or Services and Prices/Costs).

(b) Insert proposed unit prices and extended amounts in Section B for each Contract Line Item Number (CLIN) or Sub CLIN (SCLIN). The extended amount must equal the unit price multiplied by the number of units. It is imperative that mathematical calculations are correct. The unit prices and extended amounts are limited to two decimal places.

(c) Extreme care should be exercised to ensure that no price data of any kind are included in any other Part of the proposal.

3. PART III - TECHNICAL PROPOSAL - Submit electronic copy only.

Please revise Seciton L Part III-TECHNICAL PROPOSAL to "Submit electronic copy only. Provide no more than a two page narrative demonstrating the offeror can identify and meet all the requirements stated in the attached Statement of Work.

***Please note that this is NOT a request for a capabilities statement or business competencies. The objective of this part is to submit a technical proposal that details the contractor's plan to accomplish the work and addresses the specifics of this project's requirements. A word-for-word copy of the Statement of Work also does NOT meet this factor. ***

4. Past Performance

The Government will obtain Past Performance information from established systems and other sources available to the Government. The evaluation of Past Performance is detailed in Section M. Offerors are not to submit Past Performance information. Any Past Performance information submitted will not be considered by the Government.

5. Format for proposal Parts I, II, and III, shall be as follows:

(a) Each written Part of the proposal shall contain a Table of Contents, Cross References, and the List of Tables and Drawings (if applicable).

(b) one electronic copy of each Part of the entire offer must be submitted. The electronic version of the proposal shall be submitted in a format readable by Microsoft Office 2010 which includes software programs such as WORD, EXCEL, or PowerPoint or Adobe Acrobat portable document files (.pdf) format. The electronic version shall be submitted via email to (Ross.Bousema@us.af.mil) and (Anna_Maria.Smith.1@us.af.mil). USB flash drives, floppy disks, and zip disks are not acceptable.

E. General Information:

1. Offerors are cautioned that JBER has visitor control procedures requiring individuals not affiliated with the installation to obtain a visitor pass prior to entrance. Late proposals will be processed in accordance with FAR 52.215-1(c)(3),"Submission, modification, revision, and withdrawal of proposals."

2. A site visit will be held at Joint Base Elmendorf Richardson (JBER) on 14 October 2021 to start at 2:00pm at Building 986. All costs associated with attending the site visit shall be borne by the offerors. Prospective offerors are urged to attend the site visit. If a contractor is unable to attend, there will be no future site visits scheduled.
