Sections L & M

L-1 GENERAL INSTRUCTIONS
L-1.1 NOTICE TO OFFEROR(S). Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date for receipt of proposals. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an Offeror for any costs incurred in the development of the proposal.
This solicitation will not permit foreign contractor participation. The procurement will require the disclosure of classified military information and controlled unclassified information in which foreign contractors are considered non-qualified suppliers and thus are prohibited from submitting proposals.
L-1.2 Proposals in response to this solicitation will be valid for 365 calendar days. Block 12 of Standard Form 33 is completed to read 365 calendar days.
L-1.3 This section of the RFP provides general guidance for preparing proposals as well as specific instructions on the format and content of the required proposal volumes. Each proposal must include all data and information requested in the RFP. The Offeror shall comply with the solicitation requirements as stated and the PWS. The Offeror’s proposal must reflect a thorough understanding of the services required and display a logical development of the Offeror's plans to implement all PWS requirements as assessed by the RFP evaluation criteria.
L-1.4. Efforts shall be made to keep offers as concise as possible with the emphasis being on providing information essential for proper evaluation. The proposal shall be clear, concise, and shall include sufficient detail to provide for adequate evaluation and for substantiation of the validity of stated claims. Submitted documents must contain adequate information to enable the evaluation team to fully ascertain an Offeror's capability to perform contract requirements, must meet the requirements of the RFP, and must address the evaluation factors for award.
L-1.5 Offerors shall acknowledge awareness of all amendments to the solicitation by signing and dating Page 1 of each Standard Form 30, Amendment of Solicitation/Modification of Contract, and include it in Volume III, Price, of the proposal. Failure to comply with RFP requirements shall make an offeror deemed nonresponsive. Award CANNOT be made to a nonresponsive Offeror.
L-1.6 No contractor support will be used during the proposal evaluation process.
L-1.7 Proprietary information submitted in response to this solicitation shall be clearly marked as such and will be protected from unauthorized disclosure as required by Subsection 27 of the Office of Procurement Policy Act as amended (41 U.S.C.423) (hereinafter referred to as “the Act”) as implemented in the FAR. Any unmarked proprietary information will be considered releasable under the restrictions of the Freedom of Information Act.
L-2 ACCESS TO BIDDERS LIBRARY
L-2.1 Regulations, manuals, drawings, Technical Orders, or other publications referenced in the solicitation will not be issued with the solicitation. All documents referenced in the PWS are available on FedBizOpps.
L-3 FORMAL COMMUNICATIONS. Any formal communication such as requests for clarification, discussions, and information concerning this solicitation should be submitted in writing (via email) to the POCs at the address below:

L-4 PRE-PROPOSAL CONFERENCE. The Government will host a pre-proposal conference to explain the requirements of this solicitation and respond to questions raised by Offerors. The conference will be held in ACC
AMIC on 17-19 November 2015. A time schedule, agenda, and proposal reservation instructions will be posted to Fedbizops.
L-5 SUBMISSION OF PROPOSALS
L-5.1 The original and copies shall be sent or hand delivered to the issuing office listed in Block 7 of the Standard Form (SF) 33; Solicitation, Offer and Award; on or before 2:00 PM EDT on 6 Jan 16 for the Past Performance Volume and 2:00 PM EDT on 6 Jan 16 for the Technical and Price Volumes. If proposals are hand delivered, Offerors shall send an email to ACCAMIC.T38.Recompete@us.af.mil to schedule delivery prior to the required submission date and time. Please mark all packages as follows:

L-5.2 Offerors are cautioned to strictly comply with all instructions within this solicitation to ensure submission of a complete proposal. Failure to furnish a complete proposal, at the time of proposal submission, may result in the proposal being unacceptable to the Government and not considered for award.
L-5.3 Offeror shall provide the following contact information for their proposal volumes:
L-5.3.1 Names, titles, addresses, telephone and facsimile numbers, email addresses of persons authorized to negotiate on the Offeror’s behalf with the Government in connection with this solicitation.
L-5.3.2 Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent’s authority.
L-6 DISPOSITION OF PROPOSALS. In compliance with FAR Subpart 4.8, the Government will retain one (1) copy of all unsuccessful proposals. Extra copies of unsuccessful proposals will be destroyed. No destruction certificate will be provided.
L-7 PROPOSAL PREPARATION INSTRUCTIONS
L-7.1 The instructions below prescribe the format of proposals, and describe the approach for the development and presentation of the proposed data. The proposal shall include all of the information requested in the specific instructions. Failure to include all information requested may adversely affect the evaluation.
L-7.2 Offerors are required to meet all solicitation requirements, to be eligible for award. The Government may incorporate into this contract, by reference or full text, portions of the successful Offeror’ s proposal submitted in response to this solicitation as revised and supplemented through the final proposal revision.
L-7.3 A proposal that is orderly and sufficiently documented will enable the Government to easily understand and perform a thorough and fair evaluation. The Government may incorporate into this contract, by reference or full text, portions of the successful Offeror’ s proposal submitted in response to this solicitation as revised and supplemented through the final proposal revision.
L-7.4 Proposal Volumes. A complete proposal consists of the three (3) separate and distinct volumes:
Volume I – Technical Capability Volume II – Past Performance Volume III - Price
L-7.5 Proposal Format.
L-7.5.1 Page Format. Specific guidance regarding format and content is discussed in the following paragraphs. All pages provided by the Offeror in excess of the stated limitations will not be evaluated. The proposal content shall be formatted as follows:
a. Text: Single-spaced and printed on single-sided paper, no duplex printing
b. Font Size: Microsoft Office Word, Times New Roman, 12 point font
c. Font Size for charts, tables, graphs and figures shall be no smaller than Microsoft Office Word, Times New Roman, 10 point font
d. Margins: One Inch (1”) left, right, top and bottom
e. Paper Size: 8½” x 11” with a background color of white or ivory stock only. Fold-outs shall not exceed 11” x 17” and shall count as two (2) pages.
f. Page Numbering: Sequential (i.e., 1 through 100)
L-7.5.2 What Counts as a Page. A page shall be an 8 ½” x 11” sheet of paper. Fold-outs shall not exceed 11” x 17” and shall count as two (2) pages. Fold-outs shall be kept at a minimum, and shall be used only where a table or other graphic cannot be accommodated by a single 8 ½” x 11” page. All material shall be contained within the page limit identified for each volume, and all appendices, charts, graphs, diagrams, tables, photographs, drawings, etc., are included in the page count, with exception of items stated in L-7.5.3.
L-7.5.3 Pages Not Included in Page Count. The organizational chart, acronym list, cross reference matrix, and overview section (for exceptions to solicitation) will not be included in the page count. Covers for volumes, tables of contents, indices, title pages, and section dividers/tables will not be included in the page count if they are inserted solely to provide ease to the reader in locating parts/sections of the proposal. They will be counted if they contain any other information, e.g., diagrams, extraneous data, etc. Pages marked “This page intentionally left blank” and without any additional information will not be counted.
L-7.5.4 Electronic Copies. Electronic copies of all proposal information for each volume shall be submitted on CD ROM or CD-R using Microsoft Office 2003 through 2007 or Portable Document Format (PDF) using Acrobat Adobe 9.0. Offerors shall NOT submit any document in PDF that cannot be electronically searched. Offerors may use JPEG images for charts or screen shots. Volume III Price – Schedule B/T-38 AMP Contract CLIN Spreadsheet shall be submitted in Microsoft Excel 2003 through 2007 formats. Offerors shall name files in an unambiguous manner, using plain language text, which facilitates the evaluator’s ease of accessing the files for evaluation, using standard naming conventions (e.g., Offeror name-volume name.doc for MS Word, Offeror name-volume name.xls for MS Excel, Offeror name-volume name.PDF for Portable Document Format, etc.). Each volume shall be in a single searchable file, with copy/paste capability, and stored in a folder that corresponds to the proposal volume it represents. Offerors shall insert the file name in the header of each document. All disks shall be virus checked prior to submission. Replacement disks (CD ROM/CD-R) shall be required to update the final proposal resulting from any discussions, should they occur. It is the Offeror’ s responsibility to ensure that electronic copies and hard copies are an exact match. If there is a discrepancy between the paper and electronic copies, the paper copy will take precedence and be used for evaluations.
L-7.5.5 Copies and Page Limit. Information submitted shall not exceed the page limits stated below for each volume. Additionally, electronic copies of all of the proposal information for each volume are required. Evaluators will only read up to the maximum number of pages specified in the table below. If the page limit is exceeded, the pages in excess of the limit will be removed from the applicable volume and will not be considered as part of the evaluation. One copy of each Volume shall be marked “Original”. Copy requirements, page limitations, and submission dates for each volume are as follows:

L-7.5.6 Each Volume I, II and III shall be written on a stand-alone basis and should be clear and complete.
Information required for proposal evaluation, which is not found in its designated Volume, will be assumed to have been omitted from the proposal.
L-8 EXCEPTIONS
L-8.1 The Government intends to award without discussions; therefore, Offerors are advised that taking exception to any requirements specified in this solicitation may result in the Government finding the proposal non-responsive.
Clarification of Government requirements shall be handled by submitting questions/recommendations prior to submission of proposals. If Offerors still find it necessary to take exception to any of the requirements specified in this solicitation, clearly identify each exception in the overview section of the appropriate volume along with a complete explanation of why the exception was taken and the resulting benefit to the Government. An overview section is only required if the Offeror takes exception to any requirement in the solicitation (the overview section will not be included in the proposal page limitation described above). While Offerors may propose exceptions to the solicitation requirements, the Government is not obligated to accept such offers. Any change to the requirement as a result of accepting an exception shall be reflected in an amendment and within the resultant contract.
L-8.2 In the event the Offeror takes no exception to the stated requirements, a statement to this effect shall be included at the front of the subject volume.
L-9 INSTRUCTIONS FOR VOLUME I, TECHNICAL CAPABILITY (FACTOR 1)
L-9.1 To facilitate evaluation, the Technical Volume shall be specific, detailed, and complete to clearly and fully demonstrate the offeror has a thorough understanding of the T-38 AMP PWS requirements. This volume of the proposal shall consist of two parts: technical and risk. The offeror shall provide a clear and concise description of how the offeror plans to meet or exceed the requirements of the RFP, specifically identifying any innovations or efficiencies that would result in cost reductions, cost avoidance, or qualitative improvements resulting in a benefit to the Government in relation to the PWS and the technical evaluation subfactors. Statements that an offeror understands, can, or will comply with the PWS (including referenced AF publications, Technical Data, etc.);
statements paraphrasing the PWS or parts thereof (including applicable AF publications, Technical Orders, etc.); and phrases such as “standard procedures will be employed” or “well known techniques will be used” or “work will continue as it has in the past” will be considered unacceptable. The proposal shall also cross-reference any offeror identified risk(s) to each subfactor. Provide your risk rating (high, moderate, low) for each risk area and justification for the rating. Describe the approach to minimize the impact of these risks on the overall success of the effort and how the risk(s) will be managed/mitigated. Specifically identify any performance standards and metrics you have established in each risk area and explain how performance standards will be used to manage risk. Identify any price impact associated with the proposed approach/identified risks, and cross-reference price impacts to the Price Volume. Offerors should note that data submitted prior to the proposal submission will not be considered in the Government’s evaluation; therefore, such data should not be relied upon or incorporated in the Technical Volume of the proposal by reference. The Technical Volume shall not contain any pricing data.
L-9.2 Technical Factor Cross-Reference Matrix (Attachment 4). As part of each Offeror’s proposal, a separate cross-reference matrix shall be completed and submitted with the Technical Volume. All referenced paragraphs include all subsequent subparagraphs (for example, 5.0 includes 5.1, 5.2, 5.2.1, etc.). Offeror shall fill in the columns related to their proposal. This is only a tool to assist in the proposal preparation process. Offerors are ultimately responsible for ensuring that their proposal fully addresses all areas and that all requested information is completed in accordance with Sections L - Instructions, Conditions and Notices to Offerrors or Respondents and Section M – Evaluation Factors for Award of this solicitation. Offerors shall complete the last column of this matrix with paragraph number references from the Technical Volume. Offerors may provide additional references to the other columns as deemed necessary.
L-9.3 Glossary of Abbreviations and Acronyms. An abbreviation/acronym list shall be provided as an attachment within the Technical Volume.
L-9.4 Executive Summary. An Executive Summary, not to exceed three (3) pages (pages will not count toward page limit), shall be submitted within the Technical Volume to summarize the most important components of the Technical Capability Volume I.
L-9.5 Technical Subfactors.
L-9.5.1 Subfactor A: Program Management.
L-9.5.1.1 Management and Integration
i. Describe and/or illustrate your integrated management approach to provide an organizational structure that consists of an appropriate leadership hierarchy, manning levels by position, skill sets by position, utilization of personnel to include specific plans for cross-utilization, assigned roles and responsibilities, lines of authority, and cohesive functional relationships to meet provided workload data and execute all PWS requirements.
ii. Provide your communication approach with effective lines of communication, reporting, progress checkpoints, and interfaces between management, technical staff, subcontractors/teaming partners, and the Government to ensure continuity and mission success.
iii. Describe your system(s) for scheduling of tasks and system of controls to provide quality/timely services or products that safely fulfill mission requirements
L-9.5.1.2 Human Resources
i. Provide your integrated approach for hiring, training, and retaining qualified management and technical personnel by job category/position.
ii. Provide specific training approach to ensure any required initial, qualification, proficiency, certification, and recurring training actions are taken to provide a qualified workforce with no interruption in service.
iii. Provide your plan for creating and maintaining a work environment that creates incentive for employee performance and innovation.
L-9.5.1.3 Quality Management System
i. Provide documentation of AS9100 and/or AS9110 registration/certification.
ii. Provide your approach to effectively integrate all aspects of your Quality Management System (QMS) into corporate management, maintenance, and routine business processes to accomplish PWS and Appendix G requirements.
L-9.5.2 Subfactor B: Operations & Maintenance
L-9.5.2.1 Centralized Repair Facility (CRF) Management.
i. Provide your approach and specific rationale for effective use of manpower, specific processes and procedures to control, manage and prioritize:
a. Aircraft inspection workload to meet service summary average fleet time metric.
b. CRF engine and fuels workload and maintenance recovery team (MRT) requirements for all aircraft broken off-station and aircraft beyond operating location (OL) maintenance capabilities IAW PWS requirements.
c. Specific methods and any innovations to maximize CRF efficiencies and ensure fleet health.
L-9.5.2.2 Aircraft Availability Management.
i. Provide your approach to effectively integrate processes and procedures to maintain both the fleet and each OL aircraft availability service summary metrics as prescribed in the PWS. Provide specific methods and any innovations to increase aircraft availability rates.
L-9.5.2.3 Contractor’s Flight and Ground Operations Plan.
i. Provide your integrated approach and plan to establish and enforce safe flying operations IAW AFI 10-220 IP Chapter 4. Provide a plan for effective pilot training, qualification, and documentation process. Describe seamless integration of flight operations plan with PWS. Provide your pilot staffing plan to ensure sufficient qualified Functional Check Flights (FCF) pilots to support FCF and aircraft ferry requirements to meet service summary aircraft availability.
L-9.5.3 Subfactor C: Transition
L-9.5.3.1 Transition Plan. Provide a transition plan for establishing required management processes that will result in continuity of mission support and contract performance and efficiently transitioning resources and personnel onto the contract. At a minimum, include the following:
i. Provide milestone chart that reflects transition tasks to execute your proposed approach during transition.
Include an explanation for transitioning the incumbent's program management functions and resources into your approach.
ii. Provide organizational structure that includes appropriate number of personnel, qualifications, functional assignments to effectively accomplish transition tasks.
iii. Provide approach to hire incumbent personnel and/or fill incumbent vacancies with trained/qualified personnel to perform contract tasks and responsibilities at contract start.
iv. Provide approach and processes to acquire and integrate open actions (work orders, requisitions etc.) at contract start to ensure continuity and timely completion of open items.
v. Approach for interfacing with the incumbent contractor in support of transition tasks.
vi. Approach for ensuring adequate vehicles are on-site and fully operational in accordance with PWS for contract start.
L-10 INSTRUCTIONS FOR VOLUME II, PAST PERFORMANCE (FACTOR 2)
L-10.1 Contents. Offerors shall submit a Past Performance Volume containing the following:

L-10.1.1 Summary. Describe the roles of the references submitted for the offeror, subcontractors, teaming partners, and/or joint venture partners in relation to proposed past performance information IAW paragraph L-10.1.2. Include any Award Fee and/or Incentive Fee periods, Award Fee and/or Incentive Fee percentage earned, Award Fee and/or Incentive Fee grading criteria and grading scale, if applicable. Include a detailed explanation of how each PPI meets the relevancy criteria defined in paragraph M-2.3.3. Also include an explanation of how the combination of all submitted references meets the relevancy criteria.
L-10.1.2 Past Performance Information (PPI) Reference Sheets (Section L: Attachment 1). Submit separate PPIs on contracts that are recent and considered most relevant in demonstrating the ability to perform the proposed effort. This information is required on the offeror, subcontractors, teaming partners, and/or joint venture partners that will perform major or critical portions of the effort. Submit a minimum of three (3) and a maximum of six (6) references; three (3) of the references provided should be on the offeror (prime), if available. The remaining three
(3) references may be provided for subcontractors, teaming partners, and/or joint venture partners considered critical to successful performance of the requirement. If the PPI reference is an overarching Indefinite Delivery/Indefinite Quantity (ID/IQ) or Blanket Purchase Agreement (BPA), the Government will only assess performance at the ID/IQ level and not performance on each individual underlying task/delivery order. If offerors would like assessment of an individual task/call/delivery/purchase order, the offeror shall submit that as a separate PPI reference.
L-10.1.2.1 PPI reference sheets will be treated as source selection information in accordance with FAR Part 2.101 and 3.104.
L-10.1.3 Subcontractor/Joint-Venture/Teaming Partner Consent Letter (Section L: Attachment 2). PPI references concerning subcontractor, joint-venture or teaming partners cannot be disclosed to a private party without the subcontractor’s or teaming partner’s consent. Because a Prime contractor is a private party, the Government will need consent before disclosing subcontractor/joint-venture/teaming partner PPI reference information to the Prime during exchanges. Completed consent letters shall be submitted as part of the Past Performance Volume for all subcontractors, teaming partners, and/or joint venture partners considered critical to successful performance of the requirement, whether or not a PPI is submitted on the subcontractor/joint-venture/teaming partner.
L-10.1.4 Authorization Letter. In order to validate a prime Offeror’ s past performance as a subcontractor on a submitted PPI contract reference, Offerors are required to provide written authorization for the Government to contact the prime contractor on the contract referenced in the submitted PPI.
L-10.1.5 Organizational Structure Change History. Many companies have acquired, have been acquired by, or have otherwise merged with other companies, and/or reorganized their divisions, business groups, subsidiary companies, etc. In many cases, these changes have taken place during the time of performance of relevant efforts or between conclusion of recent past efforts and this source selection. As a result, it is sometimes difficult to determine what past performance is relevant to this acquisition. To facilitate the Government’s past performance evaluation, Offerors shall include in this proposal volume a detailed “roadmap” describing all such organizational changes (if applicable), to include specific names of “sister”, predecessor, or subsidiary companies with their applicable CAGE codes and DUNS numbers, and dates of organizational changes.
L-10.2 Recency Determination. Each PPI reference submitted shall have demonstrated performance (minimum of 12 months) during the last three years preceding the T-38 AMP final solicitation issuance date. This includes contracts that were awarded prior to this period, but still had performance (minimum of 12 months) during the last three (3) years.
L-10.3 Relevant Contracts. Offerors shall submit PPI references on contracts they consider relevant demonstrating their ability to perform the T-38 AMP requirement in accordance with (IAW) the PWS. Offerors are required to explain how/why the referenced contracts are relevant IAW the relevancy definitions at M-2.3.3. The Government is not bound by the Offeror’ s opinion of relevancy.
L-10.4 Past Performance Questionnaires (PPQ) (Section L: Attachment 3). If an offeror is submitting a PPI reference that does not have a formally documented Contractor Performance Assessment Report (CPAR), the Government shall use the attached PPQ as a tool for conducting telephonic or email interviews. Additionally, the Government may also use the attached PPQ as a tool in collecting past performance data on additional sources the Government finds on a particular offeror (see L-10.5). The PPQ is provided as a point of information to offerors and is for Government use only. In the event a PPQ is used, it will be treated as source selection information in accordance with FAR Part 2.101 and 3.104.
L-10.5 Other Sources. The Government may utilize references other than those identified by Offerors in evaluation of an Offeror’s past performance. This includes past performance of the prime and any subcontractors, teaming partners, and/or joint venture partners considered critical to successful performance of the requirement. While the Government may elect to consider data obtained from other sources, the burden of providing accurate and complete, recent and relevant PPI that demonstrates the ability to perform this requirement rests with each Offeror.
L-10.6 Responsibility Determination. Even though the assessment of past performance is separate and distinct from the Determination of Responsibility required by FAR Part 9.1, PPI references contained herein may be used to support the Determination of Responsibility for the successful Offeror.
L-11 INSTRUCTIONS FOR VOLUME III, PRICE (FACTOR 3)
L-11.1 Pricing
L-11.1.1 The Offeror shall provide all Schedule B information (Schedule of Supplies and Services (CLINS)) in the attached excel spreadsheet (see RFP Attachment 5, Schedule B/T-38 AMP Contract CLINs). This spreadsheet will be used to populate the Schedule B CLINs in the SF33 upon award. The Offeror shall insert the price elements (unit price and extended amount for each of the Fixed Price (FP) contract line item numbers (CLINS), for each period of performance: Transition, Base Year, and all Option Years (to include 6-month extension)). For ease of administration, Offerors shall round all unit prices of proposed FP CLINS to whole dollar amounts before they are multiplied by the quantity. The unit price multiplied by the number of units shall equal the extended price of each CLIN. If submitted unit prices are not rounded to the nearest dollar, the Government will round the unit prices to whole dollar amounts at the time of contract award. If the decimal is followed by 5, 6, 7, 8, or 9, the price will be rounded up to the nearest whole dollar. If the decimal is followed by 0, 1, 2, 3, or 4, the price will be rounded down to the nearest whole dollar. The Cost-Reimbursable (CR) CLINS (Government Directed Travel and Materials & Supplies (to include Maintenance on Government Furnished Vehicles)) include an Estimated Not to Exceed (NTE) amount that has been pre-established for each of these CR CLINs. Offerors shall propose fully burdened rates (FBR), expressed as a percentage, in the Schedule B/T-38 AMP Contract CLINs spreadsheet that will be applied to each of the pre-established NTE amounts, for the Offerors proposed CR CLIN price. Offerors shall not change the pre-established NTE amounts for the CLINs.
L-11.1.2
L-11.1.3 Other than Certified Cost and Pricing Data. Certified cost or pricing data is not required. However, other than certified cost and pricing data is required. This data should explain the methodology used in developing proposed CLIN prices. The data includes, at a minimum, breakdown (by CLIN) of labor (labor category, number of positions and productive hours), breakout of Other Direct Costs (ODCs), indirect rates, and subcontract costs. The data may be submitted in a format selected by the offeror. This information shall be submitted in Microsoft Excel 2003 through 2007 formats and the excel information can be supplemented with a Microsoft Word document as needed.
L-11.1.4 Service Contract Labor Standards. Offerors shall comply with clause 52.222-43 for their price proposal with regard to employees covered by the Service Contract Labor Standards. Proposed option year prices shall not include allowances for any contingency to cover increased wage or benefits costs for which contract price adjustment is provided by clause 52.222-43.
L-11.1.5 Small Business Subcontracting Plan (Large Business Prime Contractors Only).
Provide a Small Business Subcontracting Plan that complies with FAR Part 19, Small Business Programs, and its supplements. Identify the percentage of intended business with each of the following small business socioeconomic categories: Veteran-Owned Small Business, Service-Disabled Veteran-Owned Small Business, HUB-Zone Small Business, Small Disadvantaged Business, and Women-Owned Small Business. All small business subcontracting goals shall be expressed in terms of percentage of subcontracted dollars. Pursuant to DFARS 215.305(a)(2), provide evidence to the extent to which the offeror’s evaluated past performance (submitted PPIs) demonstrates compliance with FAR 52.219-8, Utilization of Small Business Concerns and FAR 52.219-9, Small Business Subcontracting Plan. The Subcontracting Plan will be evaluated as part of the responsibility determination for each Offeror.
L-11.2 Proposal Documentation. In addition to the pricing information requested above, Volume III shall also contain the following documents:
L-11.2.1 Section A. Complete in its entirety the “Offeror” portion of the SF 33; an official having the authority to bind your company contractually must sign the SF 33 IAW FAR 4.102. In doing so, the Offeror accedes to the contract terms and conditions as written in the RFP Sections A through K. These sections constitute the model contract. One copy of the SF 33 must bear an original signature.
L-11.2.2 Sections C Through K. Complete the necessary fill-ins and certifications, and provide any information requested in Sections C through K. For Sections C through I, the Offeror shall submit only those pages that require a fill-in. For Section K, complete Representations, Certifications and Other Statements of Offerors, or provide a copy of completed Online Representations and Certifications (ORCA) located at https://www.sam.gov.
L-11.2.3 Amendments See paragraph L-1.5.
L-11.2.4 Adequate Accounting System. Offeror shall identify the cognizant Defense Contract Audit Agency (DCAA) and Defense Contract Management Agency (DCMA) field offices that have oversight to the Offeror’ s organization. Provide information concerning the adequacy of your accounting system pertaining to accumulation of costs for the cost reimbursable CLINS. If DCAA has already determined the offeror’ s accounting system adequate, the Offeror shall provide the referenced DCAA audit report number and report date. In addition, provide the most recent review date of your estimating system and identify any deficiencies identified by DCAA and the resolution of the deficiencies. If an offeror has never dealt with DCAA, Offerors shall review the website at www.dcaa.mil and identify the cognizant DCAA office. Offerors shall also provide any information that pertains to a recent DCMA or DCAA financial capability assessment. Offeror shall provide evidence of indirect rates and factors used in the price schedule have been audited/approved by DCAA.
L-11.2.5 Financial Statements. The offeror shall provide information regarding the general financial condition of the firm and specific plans for financing the proposed contract for use in the Government determining the apparent low offeror’ s responsibility IAW FAR 9.104-1. The Financial Statements requested will only be used to establish if the company is responsible and will not be used to evaluate the offeror’ s price. The offeror shall provide their previous three (3) fiscal year-end financial statements (income and balance sheet) to include notes to the statements.
Also include documentation to show capability to access credit markets if necessary.
L-11.3 Department of Labor Equal Employment Opportunity (EEO) Clearance. In accordance with FAR Part 22.805, requires the Contracting Officer request pre-award clearance for each proposed contract and for each proposed first-tier subcontract of $10 million or more from the appropriate Office of Federal Contract Compliance Programs (OFCCP) regional office. Offerors shall the provide the CO a copy of the OFCCP’s National Pre-award Registry (http://www.dol-esa.gov/preaward/pa_reg.html) database registration for Government verification as part of the proposal submission for contracts and subcontracts of $10 million or more. If no record exists in the database, the Contracting Officer will request pre-award clearance.

L-11.4 CHANGES RESULTING FROM DISCUSSIONS. In the event any adjustment of price becomes necessary to reflect changes resulting from discussions, if discussions are held, a complete traceable trail shall be provided to show how the changes took place.
L-12 DEBRIEFING OF OFFERORS. Debriefings are conducted with the goal of identifying to unsuccessful Offerors where changes can be made to improve proposals for future acquisitions. Any Offeror may request a debriefing by providing a written request to the Contracting Officer. Debriefings shall be conducted in accordance with FAR 15.505 for pre-award debriefings and FAR 15.506 for post-award debriefings.

M-1 BASIS FOR CONTRACT AWARD
M-1.1 This competitive best value source selection will be conducted IAW Federal Acquisition Regulation (FAR) Part 15, Contracting by Negotiation, Department of Defense (DOD) Source Selection Procedures and Air Force Federal Acquisition Regulation (AFFARS) Mandatory Procedures (MP) 5315.3 for Source Selection using the Tradeoff source selection process. Award will be made to the offeror who is deemed responsible in accordance with FAR Part 9 and whose proposal conforms to the solicitation’s requirements and is judged, through an integrated assessment of the specific evaluation criteria, to represent the best value to the Government.
M-1.2 Factor ratings and assessments will focus on each proposal’s strengths, deficiencies, weaknesses, performance confidence and price. This may result in an award being made to a higher rated, higher priced offeror where the decision is consistent with the evaluation factors and the Source Selection Authority (SSA) determines that the technical superiority and/or superior past performance of the higher priced offeror outweighs the price difference. The SSA bases the source selection decision on an integrated assessment of the evaluation factors and subfactors. While the Government evaluation team and the SSA will strive for maximum objectivity, the source selection process, by its nature, is subjective; therefore, professional judgment is implicit throughout the entire process.
M-1.3 The Government contemplates award of one contract resulting from this solicitation under NAICS code 488190, Other Support Activities for Air Transportation. However, the Government reserves the right not to award a contract, depending on the quality of the proposal(s) submitted and the availability of funds.
