FY11 COCESS Q&A #2

Q1Paragraph 1.6.6 of the Statement of Work (SOW) states that "the contractor shall provide immediate reimbursement/credit on all items returned within thirty (30) calendar days of issue." The COCESS regularly provides special order items that can not be easily returned without incurring a restocking fee. Immediate credit should only be for stocked items, as nonstock items may be subject to a vendor’s restocking fee. We suggest that immediate credit should only be required for stocked items, and that the credit provided should be less any vendor's restocking fee if the return is not the fault of the contractor. We request that this sentence be changed to state that "the contractor shall provide immediate reimbursement/credit on all stocked items returned within thirty (30) calendar days of issue."
A1Paragraph 1.6.6, fourth sentence of the SOW has been amended to the following: "The contractor shall provide immediate reimbursement/credit, minus applicable restocking fees identified in the item specific merchandise return policy, on all items returned within thirty (30) calendar days of issue."
Q2Paragraph 5.15 specifies the use of On-Line Price and Item Catalogs to establish an arm's length, 3rd party pricing comparator for Price Listed Items. Historically, the government has mandated that these catalogs be sourced through a third party source disinterested in the sale of a particular product. Catalogs that have historically been utilized have been from vendors such as Trade Service Corporation and Material Express. May a contractor utilize a catalog published by itself or its own parent company?
A2The language in paragraph 5.15 of the SOW is clear. As long as the catalog is not exclusively created for the Government, there shouldn't be a problem with a contractor utilizing a catalog published by "itself or its own parent company." The key point is it must be a catalog that a nongovnerment customer would use to price/purchase the identical item (see sentence 4 of paragraph 5.15). If the prospective contractor creates the catalog for the purpose of bidding on the contract, it is not acceptable.
Q3Paragraph 1.10.4 requires the contractor to immediately pick up items within a 75 mile radius when directed by the Contracting Officer or designee. A virtually identical paragraph exists within the current COCESS contract, and the Contracting Office has ruled that it only applies to Urgent/Emergency requests. We request that this paragraph be updated to clearly state that this requirement will apply to urgent and emergency requirements only.
