About this file
This is a Questions and Answers document for federal contract solicitation FA466126Q0073 for Snap-on Tool Kits. The acquisition is a 100% Total Small Business Set-Aside, with FAR 52.219-6 included in the solicitation. An exception to the SBA Nonmanufacturer Rule applies under RFO 19.104-3(e)(1), meaning small-business resellers are fully authorized to furnish the requested brand-name Snap-on products without requiring a waiver. Offerors must quote the exact part numbers listed in the Government tool lists as written, including subsidiary brand items such as Blue-Point and ATI products, which are confirmed as Snap-on subsidiaries.
The delivery address for freight pricing is 925 Ave E-1, Building 520, Dyess AFB, TX 79605. The Government will not disclose the estimated dollar value range but intends to apply DFARS 252.225-7001 (Buy American and Balance of Payments Program—Basic) to this requirement rather than the Trade Agreements clause, since the Small Business Set-Aside status exempts it from Trade Agreements applicability. Three line items identified in the tool lists originate from non-designated countries: CLIN 0001, P/N WBSS5CAL (Vietnam); CLIN 0001, P/N AC5C (China); and CLIN 0002, P/N JHWR-42A (China), all confirmed as Snap-on subsidiaries. A correction was made to CLIN 0001 to reflect part number KRA4107FWGE rather than KRA4107FPZR to match the tools list.

1. SAM.gov identifies this as a Total Small Business Set-Aside, and the solicitation includes FAR 52.219-6, while the RFQ cover page states “Type of Set-Aside: None (*Mandatory Source).” Please confirm whether this acquisition is a 100% Total Small Business Set-Aside.
• 100% Total Small Business Set-Aside is selected in the RFQ.
2. Because the requirement mandates Snap-on brand products, please confirm whether an SBA Nonmanufacturer Rule waiver or other applicable exception has been obtained so that a qualifying small-business reseller may furnish Snap-on-manufactured products.

Is this acquisition above the simplified acquisition threshold, and does the Government intend to apply the Buy American statute (DFARS 252.225-7001) or the Trade Agreements clause (DFARS 252.225-7021) to this requirement? The distinction is material to our quote: under Buy American a non-domestic end product is evaluated with a price factor, while under Trade Agreements a product of a non-designated country is ineligible for award. non-domestic end product is evaluated with a price factor, while under Trade Agreements a product of a non-designated country is ineligible for award.
This acquisition shall be made IAW RFO Part 12 procedures. The government will not state the estimated dollar value range. However, because this requirement is a total Small Business Set-Aside, the Trade Agreements clause does not apply.
