DIVISION 1 - GENERAL REQUIREMENTS
SECTION 01000
SPECIAL PROVISIONS
1. GENERAL:
1.1 DESCRIPTION OF WORK:
1.1.1 The following is a summary of work for QJVF 07-6017, Install MAF Fence Cables, located in the Minot AFB missile complex. This project may include work in a restricted area. The Project shall include, but is not limited to:
1.1.1.1 Installation of force protection anti-ram cable
fencing to include steel posts with concrete bases, concrete deadman installation, steel cable installation, chain-link fence installation and welding, earthwork and seeding.
1.1.2 The above description of work is for the purpose of general information only and is not intended to include and describe every feature or item of work or to define the scope of work.
1.2 APPLICABLE PUBLICATIONS: Publications shall be of the most current date at the Invitation For Bid date.
1.3 WORK ENVIRONMENT: The Missile Alert Facilities (MAF) is under the control of and within the vicinity of the 91st Missile Wing, Minot Air Force Base, North Dakota. The MAF is a continuously manned, secure installation.
Specific security and access regulations apply. The general work areas are shown on the drawings. All work areas are within the secured areas and require a Government inspector/escort at all times. The Contractor shall conform to all requirements of MAFB IDP 31.
1.3.1 Owner Occupancy: The site is an operational facility. Adhere to all applicable United States Air Force (USAF) regulations and procedures regarding security, site access, inspection, and safety. Continued functional use of the site by the USAF is required. The MAF control and security functions shall remain in operation.
1.3.2 Construction Operations: USAF controls the site, the 25-foot perimeter area outside the security fence, and the access road easement.
Property outside the above defined areas is not under USAF control and the Contractor shall not trespass, but shall first obtain written permission from the landowner, if necessary for equipment storage, stating the U.S. Government shall be held harmless from any damage caused by the Contractor during duty
01000-2 and non-duty hours for use of the private land. The Contractor shall be responsible for any negotiations concerning construction easement and storage of materials on private lands.
2. PRODUCTS: The products to be used in the work under this contract are described in the other sections of these specifications.
3. EXECUTION:
3.1 TRAFFIC CONTROL: The Contractor shall provide all traffic control devices within the project limits, on all haul routes and on all detour routes. When necessary, sufficient barricades and signs shall be provided to prevent traffic from entering the construction area. The Contractor will be responsible for maintaining all areas of new construction until accepted by the Government. Temporary signs shall have the back and post painted to match Federal Standard 595b, color 20040. The Contractor shall be solely responsible for furnishing, erecting, maintaining, and removing all protective barriers, signs, temporary lighting, etc., required for protection of persons and property.
3.2 HAULING MATERIALS: Materials will be hauled in vehicles equipped with pneumatic tires. Hauling of materials shall comply with state and local regulations. The Contractor shall be responsible for establishing and maintaining off-base haul routes. Dust shall be controlled to prevent creation of a nuisance in the surrounding area. Haul routes shall be restored to existing condition upon completion of the project at no additional cost to the Government.
3.3 EQUIPMENT PARKING: Space for the Contractor's equipment shall be determined at the pre-construction conference. The Government shall not be liable for the security of any of the Contractor's equipment while on site.
3.4 DRAWINGS AND SPECIFICATIONS: At least one set of drawings and specifications shall be kept at the job site by each superintendent.
3.5 AS-BUILT DRAWINGS: The Contractor shall maintain a set of red-lined full scale, as-built construction drawings marked-up to fully indicate as-built conditions. These drawings shall be maintained in a current condition at all times until completion of the work and shall be available for review by Government personnel at all times. The location as dimensioned from permanent features, general description, type of material, and approximate depth below finished grade of all new and existing exterior underground utilities encountered shall be indicated. All variations from the contract drawings for the required coordination between trades shall be indicated. As-built construction drawings shall be furnished to the Contracting Officer for use during the final inspection. The as-built drawings shall be submitted to the Contracting Officer in accordance with Section 01300: SUBMITTALS.

3.6 WORK CONDUCT, CORRELATION, EXECUTION, ETC.:
3.6.1 Work Performance: Contractor shall conduct all work, including materials distribution in an orderly manner, with minimum disturbance and inconvenience to traffic operations. Contractor shall confine and limit his personnel to only those areas required for work performance. All work shall be performed in a neat, orderly fashion, with extreme care exercised to avoid damage to all property in and around project areas. Any damage caused by the Contractor shall be replaced, repaired, or restored at no cost to the Government. Upon completion, all work and equipment storage areas shall be cleaned of all evidence of Contractor's debris accumulations.
Contractor's proposed work schedule shall be coordinated with the Contracting Officer or his designated representative 30 days prior to the start of any work. All work areas shall be barricaded properly for day and nighttime vehicular safety warning.
3.6.2 Storage: Material storage and on-site equipment storage may be allowed, but will be determined at the pre-construction conference. If on-site equipment storage is deemed necessary at the pre-construction conference, all equipment shall be moved to Contractor’s staging area at the close of each day’s operations. If Contractor should have equipment located on-site, it shall be removed, and staging area restored to its original condition within 14 days after completion of work.
3.7 QUALITY CONTROL: The Contractor shall provide a Quality Control Inspector who is familiar with all phases of operation. This individual shall be named and qualifications stated in the Quality Control Plan. The Quality Control Inspector's responsibility shall be to make constant quality control inspections of all phases of the operation, in order to assure constant compliance with the contract specifications. A Quality Control Plan shall be submitted to the Contracting Officer prior to the start of any work.
3.8 PERMITS AND WORK CLEARANCES:
3.8.1 AF Form 103: The Contractor shall obtain from the Contracting Officer's Technical Representative a copy of the AF Form 103, "Base Civil Engineering Clearance Request,” prior to the start of work.
3.8.2 AF Form 592: When any welding, cutting, brazing or use of any open flame device is to be used, an AF Form 592 permit must be obtained from the Base Fire Department (Building 896, 896 Flightline Drive) prior to beginning such work. During such work, a fully charged and operable fire extinguisher, appropriate for the task, shall be provided by the Contractor.
3.9 DEWATERING: If water is encountered, the Contractor shall be responsible for dewatering the site. Soils affected by the water shall be dried to a workable moisture prior to work proceeding. If the area cannot be
01000-4 stabilized by drying, the Contractor shall replace unsuitable soils with select fill.
3.10 SAFETY: Contractor will comply with all OSHA/NEC requirements and MAFB Instruction 32-2001, Responsibilities of Base Personnel to Eliminate or Control Fire Hazards.
3.10.1 The Contractor shall submit, within ten (10) working days prior to commencement of work, to the Contracting Officer, in writing, the name of the designated on-site person responsible for ensuring that all safety and accident prevention provisions of this SOW are implemented and enforced.
The Contractor shall ensure that all Contractor personnel receive safety training and briefings and that all safety inspections, practices, and procedures are complied with.
3.10.2 The Contractor shall indoctrinate each employee to ensure clear understanding of the following subject areas including, but not limited to:
3.10.2.1 The purpose of the accident prevention program
(i.e., to minimize hazards and prevent injuries).
3.10.2.2 A review of the hazards inherent in the work
environment and the precautions to be taken.
3.10.2.4 Location of first aid and other emergency
facilities. (The Contractor shall maintain a complete first aid kit on site at all times).
3.10.2.5 A detailed description of what to do in case of
injury, fire, or identification of a safety hazard.
3.10.2.6 Required safety equipment and its location on site.
Safety equipment includes but is not limited to earplugs, goggles, face shields, safety harness/lanyards, protective clothing, and hard-hats. All personnel will wear safety equipment when required by the Contractor, Contracting Officer, or Government inspector/escort.
3.10.2.7 Review of daily cleanup procedures.
3.10.2.8 Location of company safety rules (posted or
handout).
3.10.2.9 Identification of the Contractor employees
responsible for safety/accident prevention.
3.10.3 In addition to normal safety practices, the Contractor will comply with the following requirements:

3.10.3.1 The safety of Contractor personnel on-site is the
responsibility of the Contractor.
3.10.3.2 The Contractor and on-site superintendent shall
attend an Air Force safety briefing conducted at the pre-construction meeting and comply with all safety procedures. Contractor shall brief individuals of hazards that are present. The contractor shall also ensure that all MAF Air Force Personnel on site are protected from all potential hazards with the placement of appropriate barriers, warning markers, tape, signs etc. All electrical circuits shall be tagged off prior to working on circuits.
3.10.3.3 All personnel shall comply with Air Force on-site
safety procedures and additional procedures as directed by the Contracting Officer or his designated representative when the Contractor's safety person is not immediately available.
3.10.3.4 Equipment shall be placed so as not to impede normal traffic in and out of the work area, or to interfere with emergency exit from work area and off-site.
3.10.3.5 Approved emergency flashlights shall be provided by
the Contractor and shall be available in the crew's work area at all times.
3.10.3.6 All vehicles shall be in safe operating condition.
Vehicles and equipment not complying shall not be allowed on site.
3.10.4 First Aid and Medical Requirements:
3.10.4.1 The Contractor shall comply with base accident
response requirements. These requirements are provided in a safety briefing by base personnel at the pre-construction conference. The Contractor shall keep these requirements on file at the working site for inspection by Air Force personnel.
3.10.4.2 The Contracting Officer or his designated
representative shall coordinate emergency medical, ambulance, or airlift requirements.
3.10.4.3 All accidents (employee injuries and vehicle, building, equipment or property damage, etc.), regardless of severity, shall be reported immediately to the Contracting Officer or his designated representative. The Contracting Officer will notify the proper authority per Air Force regulations.
3.10.4.4 Emergency Operations: The Contractor shall provide, within ten (10) working days after award, a list of key Contractor personnel and telephone numbers to the Contracting Officer to affect early notification
01000-6 of any emergency that arises (during non-working hours) due to an incident related to this contract. It is the responsibility of the Contractor to:
3.10.4.4.1 Notify the Government inspector/escort of
any emergency situation. The Government inspector/escort will follow local emergency procedures.
3.10.4.4.2 Ensure that all Contractor personnel are
evacuated from the site and accounted for.
3.10.4.4.3 Assist in administering first aid, as
required, and evacuate injured personnel.
3.10.4.4 Obtain emergency services as required.
3.10.4.4.5 Avoid movement of, and alterations to, any possible evidence of the cause of an emergency, incident, or accident.
Removal of injured personnel or the need to prevent further damage takes precedence over this requirement.
3.11 SECURITY REQUIREMENTS:
3.11.1 Entry and Site Regulations:
3.11.1.1 Entry: In order to gain entry onto a facility, Contractor personnel and mission essential Contractor owned/leased vehicles must be listed on an Entry Authority List (EAL), identified by Government inspector/escort personnel, and physically escorted on site by authorized Government inspector/personnel. No privately owned vehicles (POVs) will be permitted on MAFs.
3.11.1.2 Twenty (20) working days prior to the initial
commencement of work, the Contractor must submit to the Contracting Officer a summarized list of employees and mission essential Contractor owned/leased vehicles along with a legible photocopy of each employee’s government issued credential photo ID. The lists and photocopies will be used to prepare the Contractor’s EAL referenced above. Foremen, supervisors and superintendents must be identified as such on the Contractor’s list of employee information.
3.11.1.2.1 The Contractor’s summarized list of
employee information must show each employee’s full name exactly as it appears on the credentialed photo ID submitted; date of birth (DOB); full Social Security Account Number (SSAN); citizenship; the government issuing agency name and control number exactly as it appears on the credentialed ID submitted. U.S. government issued credential photo IDs must have a picture of the individual, individual’s DOB and a control number. Acceptable government issued credentialed photo IDs are U.S. Federal passport or passport card, or
01000-7 state, commonwealth, territory, protectorate, District of Columbia, U.S.
sovereign insular area or tribal organization recognized by the U.S.
Department of the Interior cards.
3.11.1.2.2 The Contractor’s summarized list of
vehicle information must include vehicle make; vehicle model; vehicle year;
vehicle primary color; vehicle license plate state of issue and number.
Vehicles include mission essential company owned/leased vehicles driven out to the MAF and brought onsite for use, i.e. pick-up trucks, cars, vans, lineman’s trucks, dump trucks, etc. All equipment (i.e. skid-steers, Bobcats, forklifts, loaders/backhoes/lifts, trenchers, air compressors, welders, etc.), materials, and hand-carried items (i.e. power tools and hand tools) brought out to the site on a trailer are not required to be listed on the EAL. A piece of equipment driven on-site rather than on a trailer needs to be listed on the EAL. No privately owned vehicles will be permitted on MAFs.
3.11.1.2.3 Each employee must have their identity
proofed and their access vetted through the National Crime Information Center database and the Security Forces Information Management System using their name, DOB, and SSAN. The employees DOBs and SSANs will only be used for this proofing and vetting process and are not used on the EAL used in the field for access.
3.11.1.2.4 Deletions to the EAL may be made without
preparing a new EAL summarized list, but must be requested by the Contractor in writing. For additions of personnel or changes to the EAL, a new EAL employee summarized list and a legible photocopy of each employee’s credentialed photo ID must be submitted by the Contractor, in writing, twenty
(20) working days prior to the additions or changes required effective date.
3.11.1.3 Upon arrival at the MAF, Contractor personnel will
contact the Flight Security Controller (FSC) using the gate intercom telephone and inform the FSC of their presence at the security gate. Contractor personnel must remain outside of the security fence and in or near their vehicle until the arrival of the Government inspector/escort.
3.11.1.4 Upon arrival, the Government inspector/escort will
identify and search all Contractor personnel. All Contractor personnel will provide the Government inspector/escort with the government issued credentialed photo ID as listed above, stating the employee’s full name, issuing agency and control number. This government issued credentialed photo ID shall be the same one listed on the EAL. The Contractor’s vehicles will be checked/searched prior to site entry. Only Contractor owned/rented vehicles and equipment needed to support mission activities (accomplish the contracted work) on site shall be permitted on the MAF. Rental vehicles used for official duties are permitted operation on site with proof of the rental receipt. No privately owned vehicles (POVs) will be permitted on site.

3.11.1.5 If Contractor personnel are not listed on the EAL, or those who are listed cannot provide proper identification, they will not be permitted on the site. Delays caused by lack of proper EAL data or proper identification shall be at no cost to the Government.
3.11.1.6 Restricted Area. The work to be performed is in a
restricted area. Therefore, the Contractor shall conform to all requirements of MAFB IDP 31. Workers will be required to have an escort with them at all times. The Contractor shall allow 60 minutes each day for personnel to process on and off the work site that will not be considered delay time. All site access delays must be reported by the Contractor, in writing, to the Contracting Officer within 24 hours of occurrence. All Government-caused work stoppages must be documented by Government personnel at the time of occurrence and reported by the Contractor, in writing, to the Contracting Officer within 24 hours of occurrence.
3.11.2 Security: The Contractor shall:
3.11.2.1 Protect all Government property.
3.11.2.2 Comply with base physical security regulations and
procedures.
3.11.2.3 The Government inspector/escort will be responsible
for on-site security.
3.11.2.3.1 While work is in progress, the Contractor
may be required to remove his personnel due to Alert status, real or exercise.
3.11.2.4 During all on-site work, the Contractor personnel
will be accompanied and continuously monitored by one (1) Government inspector/escort. Failure to remain within the area being monitored is a serious breach of security and safety regulations. The Contractor will take all necessary action to ensure compliance. The Contracting Officer reserves the right to deny entry to/or take action with any Contractor personnel who refuse to conform to security and/or safety regulations. Delays resulting from such entry denial shall not result in any cost to the Government or schedule delay.
3.12 WINTER EXCLUSION: The winter exclusion shall be from 15 November through 15 April. The access road and/or on-site area shall be surfaced with new or existing gravel and open to traffic during the winter exclusion.
3.13 GOVERNMENT-CAUSED DELAYS:
3.13.1 Unscheduled Work Delays: In event of a missile movement or required generation, the Contractor will be required to vacate the area of all personnel, equipment, and materials for an indefinite period. The on-site
01000-9 supervisor shall notify the Contract Administrator within 24 hours of the delay.
3.14 PERFORMANCE OF WORK:
3.14.1 Provisions shall be made daily to allow refuse removal from base facilities.
3.14.2 Any and all damage caused by the Contractor, directly or indirectly because of performance of this contract, will be fixed to the like condition prior to construction. The Contractor will inform the Contracting Officer prior to the final inspection of any and all such damages and repairs.
3.15 WORK SCHEDULE: Working hours for the Contractor will normally be between the hours of 7:30 a.m. and 6:00 p.m., excluding Fridays, Saturdays, Sundays and federal holidays. If the Contractor desires to work during periods other than above, additional Government inspection forces may be required. The Contractor must make his/her request to the Contracting Officer three days in advance of his/her intention to work during other periods to allow assignment of additional inspection forces. If such force is reasonably available, the Contracting Officer may authorize the Contractor to perform work during periods other than normal duty hours/days. However, if inspectors are required to perform in excess of their normal duty hours/days solely for the benefit of the Contractor, the actual cost of inspection at overtime rates will be charged to the Contractor. These adjustments to the contract price may be made periodically as directed by the Contracting Officer.
3.16 GOVERNMENT ACCESS: The Government shall have access to borrow pits, stockpiles, and testing facilities for inspection and sampling.
3.17 UTILITIES: Water and electricity required by the Contractor for the completion of the contract will be provided by the Government.
3.18 UTILITY OUTAGES:
3.18.1 Any utility outages (gas, electricity, and water) requested by Contractor shall be submitted in writing no less than fifteen (15) calendar days prior to the proposed outage.
3.18.2 The Government reserves the right to reschedule the
Contractor’s proposed outage if deemed necessary.
3.18.3 In the event utility outages cannot be performed on any facility due to critical operation impact, the utility outages, and any related work shall be performed on non-duty hours.

3.19 EXCESS MATERIALS: All materials resulting from demolition shall become the property of the Contractor unless specified otherwise or as determined by the Contracting Officer.
3.19.1 Materials determined to be Government property shall be deposited by the Contractor as directed by the Contracting Officer.
3.19.2 Materials not wanted by the Government and all Contractor-generated rubbish shall be disposed of by the Contractor off-site at his own expense, and in compliance with applicable environmental codes and regulations of governing authorities.
3.20 CLOSEOUT PROCEDURES:
3.20.1 When the Contractor considers the work to have reached final completion, submit written certification that the contract documents have been reviewed, the work has been inspected, and that the work is complete in accordance with the contract documents and ready for final inspection.
3.20.2 Provide the Contracting Officer with a requested date for final inspection, in writing, not less than 2 working days prior to the proposed date of final inspection. The Contracting Officer will coordinate with the members of the inspection party and establish the final inspection date. If construction deficiencies are identified, a request for reinspection must be given upon correction of the deficiencies.

SECTION 01300
SUBMITTALS
1.1 PROCEDURES:
1.1.1 The Contractor shall be required to submit items listed in the Submittal Schedule at the end of this section to the Contracting Officer for approval.
1.1.2 Transmit each item under AF 3000, Material Approval Submittal form. Identify contract number, project number, and Contractor. Identify section and paragraph reference for each item submitted with the AF 3000.
Submit three copies unless otherwise required elsewhere in the specification.
1.1.3 Unless specifically stated otherwise elsewhere in this
specification, each submittal shall be approved by the Contracting Officer prior to incorporation of materials into the work.
1.1.4 Approvals of submittals which do not conform to the contract shall not be construed as a change to the contract.
1.2 MANUFACTURER'S DATA AND SAMPLES: Where manufacturer's data and samples are required, submit in accordance with procedures identified in 1.1 above.
1.2.1 Manufacturer's Certification: Submit a statement from the product manufacturer that proposed products meet the specified standards and other salient characteristics identified as requirements in the specification.
1.3 TEST DATA: Test results shall be dated and signed by the agency performing the test.
1.4 MISCELLANEOUS SUBMITTALS: Submittals which are none of the above types shall meet the specific requirements identified in the referenced paragraph of the Specification Section identified in the schedule.
1.5 SUBMITTAL SCHEDULE: The following is a list of required submittals for this Contract and deadlines for their submittal.

SECTION 01400
QUALITY CONTROL
1.1 SUMMARY:
1.1.1 The requirements of this Section apply to, and are a component part of, each section of the specifications.
1.2 SUBMITTALS: The following shall be submitted in accordance with Section 01300 SUBMITTALS:
1.2.1 Quality Assurance Plan: The Quality Assurance Plan shall address the following:
1.2.1.1 Description of the authority, responsibilities and
coordinating procedures of on-site/off-site quality assurance personnel, including those QA personnel not under direct control of the Contractor.
1.2.1.2 A list of personnel designated by the Contractor to
accomplish the work required by the contract.
1.2.1.3 Contractor’s operational plan for accomplishing and
reviewing work controls, certifications, and documentation of quality control operations, inspections, and test records, including those for subcontractors.
1.2.1.4 Description of on-site personnel training.
1.2.1.5 Certifications of personnel, procedures, processes, and equipment.
1.2.1.6 Nondestructive testing requirements.
1.2.1.7 Identification of independent certifying and testing
laboratories.
1.2.2 Records
1.2.2.1 Contractor shall include all quality control data;
factory tests or manufacturer’s certifications, quality control coordinating actions; records of quality control training/certifications as well as
01400-2 welding, field tests and other similar tests. Quality Control records must be available for examination by the Contracting Officer.
1.2.2.2 Contractor shall furnish legible copies of the test
and inspection records to the Contracting Officer.
1.2.2.3 A narrative description of an inspection system which provides for compliance with the quality requirements and technical criteria of the contract shall be submitted for approval within 14 calendar days after notice to proceed.
1.2.2.4 A monthly performance report that summarizes the
quality operations shall be submitted. Contractor shall identify inspections made, tests performed, nonconformances, corrective actions taken, status of plans/procedures being developed, and status of open items/problems in work.
1.2.2.5 Letters of Authority or Delegation, outlining the
authority and responsibilities of quality control personnel, shall be submitted along with a copy of the letter of delegation to the Contracting Officer that defines delegated duties and responsibilities.
1.3 QUALITY ASSURANCE
1.3.1 Qualifications
1.3.1.1 Contractor shall submit Quality Representative
Qualifications to the Contracting Officer for approval. Quality Representative may be assigned to more than one contract provided that the assigned contracts are located at the same site.
1.3.1.2 When approval or certifications of special processes, operating personnel, and special equipment or procedures is required by the specifications, approvals or certifications shall be obtained prior to starting the work.
1.3.2 Quality Control Requirements: Contractor shall provide a quality control program encompassing selection of construction materials and sources; suppliers; subcontractors; on-site and off-site fabrication of Contractor-furnished assemblies; on-site and off-site assembly; erection; work procedures; workmanship; inspection; and testing.
1.3.2.1 QC Manager: Contractor shall designate an individual
within the on-site organizations whose responsibility is the day-to-day on-site management and direction of the Quality Program. The Quality Program manager will report to the Contractor’s management and have the necessary authority to discharge contractual responsibilities.

1.3.2.1.1 Alternate QC Manager: Contractor shall also
designate an alternate for the QC Manager to serve in the event of the designated QC Manager’s absence. The period of absence may not exceed two weeks at one time, and not more than 30 workdays during a calendar year. The qualification requirements for the Alternate QC Manager shall be the same as for the QC Manager.
1.3.2.2 Records, drawings, submittals, and equipment must be
identified by referencing the Contract Number; Contract Specification Section;
Drawing Sheet Number; Submittal Document Number; and Contract Change Number.
1.3.2.3 Procurement: Contractor is responsible for
controlling procurement sources and those of his subcontractors to ensure that each purchase meets quality requirements.
1.3.2.4 Receiving Inspection System: Contractor shall
maintain a site receiving inspection system that ensures procured materials and equipment are inspected and tested. Receiving inspection records must accompany each procurement delivery to the construction site. Contractor shall maintain records of site receiving inspections. Defects, discrepancies, dispositions, and waivers shall be shown within the records.
1.3.2.5 Nonconforming Articles and Material Control:
Nonconformance discovered by the Contractor, subcontractors, suppliers or Government quality representatives shall be controlled to prevent their use and to correct deficient operations.
1.3.2.5.1 A “nonconformance” report shall be
prepared for each instance comprising: A unique and traceable number, identification of the nonconforming article or material, a description of the nonconformance and the applicable requirement, cause or reason for the nonconformance, remedial actions taken or recommended, and disposition of the nonconforming article or material.
1.3.2.5.2 Each nonconforming article shall be
identified and marked for removal from the work area.
1.3.2.6 Fabrication, Process, and Work Control: Contractor
shall establish in-process inspections to ensure compliance with quality requirements in contract specifications and drawings.
1.3.2.7 Quality Control Records: Quality control records
shall be maintained at a central on-site location. Maintenance of quality control records does not relieve the Contractor from submitting samples, test data, detail drawings, material certificates, or other information required by each section in the specification. Contractor shall ensure each record is
01400-4 identified and traceable to specific requirements in the specifications and drawings.
1.3.3 Quality Inspections
1.3.3.1 Government Inspections: Work performed under this
contract will be subject to inspection by the Contracting Officer and/or his designated Representative. Changes to the specifications or drawings will not be allowed without written authorization of the Contracting Officer. When the Contracting Officer Representative determines that inspected work needs to be corrected, the Contracting Officer Representative will be allowed 24 hours to complete re-inspection of the corrected work.
1.3.3.1.1 Contractor shall notify Contracting
Officer or his Representative in writing 3 hours prior to encasing any of the work so that work may be inspected. Failure to notify the Contracting Officer before encasement occurs will require the work be uncovered at no additional cost to the Government.
1.3.3.1.2 Contractor’s program is subject to
continuous evaluation, review, and verification by the Contracting Officer.
Contractor will be notified in writing of any noncompliance and will be given 3 working days to correct identified deficiencies.
1.3.3.2 Contractor’s Quality Inspections: Contractor shall
implement an inspection system that documents and indicates quality control through records of inspections, tests, and procedures, including a system of scheduled or random audits to ensure task completion. The following items shall be included in the Contractor’s Quality Assurance System:
1.3.3.2.1 A single Contractor’s representative
responsible for on-site communication and operation of the inspection program.
1.3.3.2.2 A receiving inspection system documenting
inspections for each procurement.
1.3.3.2.3 Documentation for handling and disposing
of nonconforming components and materials.
1.3.3.2.4 Inspection records for each specific
section of the specifications and drawings.
1.3.3.2.5 Identification of test(s) to be performed, test procedures, records and independent organizations use.
1.3.3.2.6 Documentation and maintenance
certification or re-certification of procedures.

1.3.3.2.7 Calibration of gages, tools, measuring
instruments and independent laboratories used.
1.3.4 Field Services
1.3.4.1 Responsibility for Inspection and Testing:
Contractor is responsible for all inspections and tests, and the accompanying documentation for each inspection and test. Contractor may utilize independent inspection and testing laboratories or services as approved by the Contracting Officer. Contractor is also responsible for tests of construction materials utilizing the services of an approved independent testing laboratory.
1.3.4.2 Inspection and test records: Contractor shall
provide on-site records of each inspection and test performed throughout the life of the contract including, but not limited to, factual evidence that the required inspections or tests have been performed, including type and number of inspections or tests involved, identification of operators and inspectors, result of inspections or tests, nature of defects, causes for rejection, proposed remedial action, and corrective actions taken. Inspection records, test procedures, test results, and associated forms shall be verified by and provided to the Contracting Officer.
1.4 HANDLING AND STORAGE
1.4.1 Contractor shall provide controls, procedures and
documentation with each shipment that meet requirements of each section of the specifications. Documentation shall consist of that required by the contract along with specifications required to identify, store, preserve, operate, and maintain the items shipped.
1.5 SEQUENCING AND SCHEDULING:
1.5.1 Contractor shall notify Government at least 24 hours prior to scheduled inspections and tests.
1.5.2 Contractor shall provide notice to the Government not less than 7 calendar days prior to contract work starting at the site. When Contractor suspends work for 7 calendar days or longer prior to completion of work, the Contractor shall notify the Contracting Officer. No work shall resume without notification of the Contracting Officer.
2. PRODUCTS: Not Used.

SECTION 01431
ENVIRONMENTAL PROTECTION
1.1 The Contractor shall perform all work in such manner as to minimize the polluting of air, water, or land, and shall, within reasonable limits, control noise and the disposal of solid waste materials, as well as other pollutants. Recycling of construction and demolition debris is required when economically advantageous.
1.2 IMPLEMENTATION: Within 20 calendar days after Notice to Proceed and prior to commencement of the work at the site, the Contractor shall:
1.2.1 Detail their proposal for implementing the requirements for environmental pollution control specified herein. Submit in accordance with the submittal table.
1.3 SUBMITTALS: In accordance with Section 01300: Submittals, the Contractor shall submit the following.

2. EXECUTION:
2.1 REFERENCES: The publications listed below form a part of this specification to the extent referenced. All references listed in these specifications are intended to be the current version or edition, unless

2.2 PRECONSTRUCTION SURVEY: Prior to start of any on-site construction activities, the Contractor shall make a condition survey after which the Contractor shall record on a layout plan the condition of trees, shrubs and grassed areas immediately adjacent to the site of the work and adjacent to his assigned storage area and access route as applicable. Submit in accordance with the submittal table.
2.3 PERMITS AND FEES: No separate payment will be made for work covered under this section. The Contractor shall be responsible for payment of fees associated with environmental permits, application, and/or notices obtained by the Contractor. All costs associated with this section shall be included in the contract price. The Contractor shall be responsible for payment of all fines/fees for violation or non-compliance with Federal, State, Regional and local laws and regulations.
2.3.1 The Contractor shall be responsible for obtaining and complying with all environmental permits and commitments required by Federal, State, regional, and local environmental laws and regulations.

2.4 PROTECTION OF LAND AREAS: Except for work areas, storage areas, or access routes specifically assigned for the use of the Contractor under this contract, the land areas outside the limits of permanent work performed under this contract shall be preserved in their present condition. The Contractor shall confine his construction activities to areas defined for work on the plans or specifically assigned for his use. Storage and related areas and access routes required temporarily by the Contractor in the performance of the work will be assigned by the Contracting Officer.
2.5 PROTECTION OF TREES AND SHRUBS: Except for trees or shrubs marked on the plans to be removed, the Contractor shall not deface, injure or destroy trees or shrubs, nor remove or cut them without special authority. No ropes, cables, or guys shall be fastened to or attached to any existing nearby trees for anchorage.
2.5.1 Tree Protective Structures: Where, in the opinion of the Contracting Officer, trees may possibly be defaced, bruised, injured, or otherwise damaged by the Contractor's equipment or by his other operations, he may direct the Contractor to provide temporary protection of such trees by placing boards, planks, or poles around them.
2.5.2 Restoration of Damaged Trees: Any tree scarred or damaged by the Contractor's equipment or operations shall be restored as nearly as possible to its original condition at the Contractor's expense. All scars made on trees not designated on the plans to be removed by construction operations shall be coated as soon as possible with an approved tree wound dressing. Trees that are to remain, either within or outside established clearing limits, that are damaged by the Contractor so as to be beyond saving in the opinion of the Contracting Officer shall be immediately removed, if so directed, and replaced with a nursery-grown tree of the same species and size.
2.5.3 Herbicide: Herbicide use will be restricted to those areas directed to be sprayed by the Contracting Representative. Herbicide shall not be sprayed when wind speeds are greater than 10 mph or when there is likelihood of runoff due to rain. Herbicide shall contain a visible dye for tracking application area. Contractor shall submit catalog data and MSDS for any herbicide proposed prior to use on the site.
2.6 WATER RESOURCES AND STORM WATER DISCHARGE: The Contractor shall monitor construction activities to prevent pollution of surface and ground waters. Toxic or hazardous chemicals shall not be applied to soil or vegetation unless otherwise indicated. The Contractor shall monitor all water areas affected by construction activities.
2.6.1 NPDES Storm Water Program General Construction Permit
2.6.1.1 CONSTRUCTION ACTIVITY LESS THAN ONE ACRE:

2.6.1.1.1 For construction activity that disturbs less than
1 acre of land the Contractor shall implement Best Management Practices (BMPs) outlined in Section D, Erosion and Sediment Controls.
2.6.1.2 WETLANDS, EROSION AND SEDIMENT CONTROLS:
2.6.1.2.1 WETLANDS: The Contractor shall not enter, disturb, destroy, place fill into, or allow discharge of contaminants into any wetlands except as specifically authorized herein. The Contractor shall be responsible for the protection of wetlands on Minot AFB property.
Authorization to enter specific wetlands identified shall not relieve the Contractor from any obligation to protect other wetlands within, adjacent to, or in the vicinity of the construction site and associated boundaries. Maps showing locations of wetlands within Minot AFB can be obtained from 5
CES/CEIE.
2.6.1.2.2 The Contractor shall be responsible for providing
erosion and sediment control measures in accordance with Federal, State and local laws. This applies in all cases, even for construction activity that disturbs less than an acre of soil. The erosion and sediment controls selected and maintained by the Contractor shall be such that water quality standards are not violated as a result of the Contractor’s construction activities. The area of bare soil exposed at any one time by construction operations should be kept to a minimum. The Contractor shall construct or install temporary and permanent erosion and sediment control best management practices (BMPs). BMPs may include, but not be limited to, vegetation cover, stream bank stabilization, slope stabilization, silt fences, construction of terraces, interceptor channels, sediment traps, inlet and outfall protection, diversion channels, and sedimentation basins. The Contractor’s best management practices shall also be in accordance with the Base National Pollutant Discharge Elimination System (NPDES) Storm Water Pollution Prevention Plan (SWPPP) which may be reviewed at the Minot AFB Environmental Management Office. Any temporary measures shall be removed after the area has been stabilized.
2.6.2 For discharge of ground water, the Contractor shall obtain a State permit specific for pumping and discharging ground water prior to surface discharging in accordance with the requirements of the State Storm Water Discharges From Construction Sites permit. Refer to the NDDH web site.
2.6.3 PROTECTION OF WATER RESOURCES: The Contractor shall control the disposal of fuels, oils, concrete, calcium chloride, acids or harmful materials, both on and off the Government premises and shall comply with applicable federal, state, county and municipal laws concerning pollution of rivers, streams, and wetlands while performing work under this contract.
Special measures shall be taken to prevent chemicals, fuels, oils, greases, concrete, herbicides, and insecticides from entering public waters. Water used in on-site material processing, concrete curing, foundation and concrete cleanup, and other waste waters shall not be allowed to reenter a stream if an increase in the turbidity of the stream could result therefrom.

2.6.3.1 DEWATERING OF GROUNDWATER: For temporary dewatering of groundwater encountered during construction, the Contractor shall land apply all water generated at the locations indicated on drawings in accordance with Paragraph: LAND APPLICATION.
2.6.3.1.1 LAND APPLICATION: Land application shall follow
state requirements; however, no permit will be necessary. "Land application" implies that the Contractor shall discharge water at a rate which allows the water to percolate into the soil. No sheeting action, soil erosion, discharge into storm sewers, defined drainage areas, or discharge into the "waters of the State" shall occur. The Contractor shall contact the State of North Dakota, Division of Water Quality and Permit Program, to discuss the water quality parameters for chemical contaminants (such as chlorine), oil, grease, and total suspended solids and shall ensure that all water intended for land application will meet the state requirements.
2.6.4 EROSION AND SEDIMENT CONTROL: The Contractor shall be
responsible for providing erosion and sediment control measures in accordance with local, state, and federal regulations. The erosion and sediment controls selected and maintained by the Contractor shall be such that local, state, and federal water quality standards are not violated as a result of the Contractor's construction activities. The area of bare soil exposed at any one time by construction operations should be held to a minimum. For areas subject to erosion including, but not limited to, steep slopes, soils spreading areas, and stockpile areas, the Contractor shall disturb as little vegetation as possible, minimize the period of time that the soil is exposed, prevent surface water runoff from flowing across disturbed areas, stabilize disturbed soils as soon as possible, and provide adequate drainage for the increased runoff. Sedimentation/erosion control features may include, but not be limited to, vegetation cover, stream bank stabilization, slope stabilization, construction of terraces, interceptor channels, sediment traps, inlet and outfall protection, diversion channels, and sedimentation basins.
Runoff management practices should be employed in areas where the potential for storm water contamination exists that cannot be addressed by a prevention or source reduction measure. Runoff management procedures may include vegetative swales, reuse of collected storm water, infiltration devices, and detention/sedimentation basins. Any erosion and sediment control measures which are damaged or found to be ineffective shall be remedied by the Contractor at no additional cost to the Government. Any areas damaged by erosion shall be repaired by the Contractor at no additional cost to the Government.
2.6.5 SPILL PREVENTION AND RESPONSE PLAN: The Contractor shall include a Spill Prevention and Response Plan in the Implementation Proposal.
The plan shall describe the Contractor's procedures for preventing and responding to spills of hazardous materials.
