Justification and Approval (J&A) for Other Than Full and Open Competition

I. Contracting Activity.

US Air Force 5th Contracting Squadron 165 Missile Ave Minot AFB, ND 58705

II. Nature and/or description of the action being processed.

This acquisition is to obtain, by use of other than full and open competition, Missile Alert Facility (MAF) elevator upgrades and testing to provide reliable and safe access in and out of the Launch Control Centers (LCCs) and Launch Control Equipment Buildings (LCEBs) for civilian and active duty personnel of Minot AFB, ND. The upgrades and testing will be accomplished for each of the 15 MAFs. The requirement will be to award a new contract to accomplish the upgrades.

Ill. Description of supplies/services required to meet agency needs.

Supply/install updated controller, control equipment, safety rails for the top of the car, new hoist cables, and 5-year safety load test, all designed and built specifically for the existing 15 MAF elevators. The upgrade will bring the 50-year old MAF elevators up to safety standards and will require testing prior to putting back into commission.

IV. Statutory authority permitting Other than Full and Open Competition.

Acquisition by other than full and open competition is provided under the authority of I 0 U.S.C. 2304( c )(I) and 41 U .S.C.

253(c)(l), FAR l l.105(a)(l), FAR 6.302-l(c), Application for Brand-Name Description. No other brand of supplies or services will satisfy agency requirements at this time.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

All items listed in Civil Engineering Manuals (CEMs) and technical requirement documents are to be brand name as the item has been tested or qualified for nuclear hardness, or where it is controlled as part of the weapon system.

MAF Elevators are Category II Real Property/Real Property Installed Equipment (RP/RPIE). CEM 35R-1-581-2 lists the Otis Elevator parts that are required to meet the brand name specifications. The elevator parts requires configuration control at each of the 15 MAFs. The existing elevators are in-place and the requirement is for Otis specific controller updates and control equipment parts. The Missile Engineering Squadron (MES) will validate/document all brand name requirements for all Intercontinental Ballistic Missile {ICBM) RP/RPIE modifications to maintain hardness and configuration control. Any proposed changes are subject to command-level Central Engineering Control (CEC). The remainder of the parts required in the Performance Work Statement (PWS) not listed as brand name and services to complete the install will be full and open competition, unrestricted.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

This requirement was reviewed by both the Contracting Officer and the user to ensure that all possibilities for competition were considered early in the acquisition cycle. This requirement will be posted through Federal Business Opportunities for competition, this is only a partial brand name acquisition for certain parts. A majority of the project is full and open.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The CO will make the determination of fair and reasonable pricing based on competitive pricing of elevator companies and parts from Otis distributors pricing. Therefore, confidence exists that at least three quotes can be obtained.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Consideration was given to setting this contract aside for small businesses but ultimately rejected as it would exclude large businesses that have easy access to the parts needed, the ability to provide replacements for parts that are no longer being

Justification and Approval (J&A) for Other Than Full and Open Competition manufactured, and have the manpower to accomplish the requirement within the alloted time frame. It is estimated that each one of the 15 elevator modernizations can take up to seven weeks to complete with average manpower. This will require multiple teams to complete the requirement within 1 year. Otis is a large business as reflected in their System for

Award Management (SAM) account. Federal Business Opportunities was searched for Air Force related purchases. The only one found was for a 5-year inspection on their MAF Elevators, no upgrades were accomplished.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

The estimated cost per elevator to upgrade and comply with safety compared to the cost to purchase a new elevator is estimated much lower. Replacement cost would therefore not be cost effective. The MAF elevators do not get used as frequently as commercial elevators and therefore the car of the elevators is in good condition. Only certain parts for this acquisition will be brand name due to the necessity to meet hardness requirements in the nuclear environment, everything else will be fully competitive.

X. List of sources, if any, that expressed interest in the acquisition.

The Contracting Officer has determined through market research that there are many potential elevator companies that would be fully capable of fulfilling this requirement.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

In the future, the government anticipates utilizing fair and open competition for vendors capable of providing services to accomplish the 5-year testing and other routine safety inspections. These should be able to be competed among other elevator companies as they will not require brand name part replacements/upgrades.

The Strategically Sourced Vertical Transportation Equipment Maintenance, Repair, & Inspection Services standardized PWS was not used. The standardized PWS paragraphs 2.1 and 2.3 specifically state that the services and supplies being requested for the Minot AFB particular upgrade are not covered under the Strategically Sourced mandatory use PWS. They are considered modernizations/construction/ancillary components of the elevator system.

XII. Certification by the Contracting Officer.

As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.
