The 375th Contracting Squadron (PKB2) at Scott AFB, IL is contemplating an award for Chapel Services for Scott AFB.

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This is a commercial purchase using Federal Acquisition Regulation (FAR) Part 12 and Part 13.5 procedures. The following information, as required per FAR 12.603(c)(2) applies:

(i) The solicitation reference number is FA440721Q0100; it is being issued as a Request for Quotation (RFQ).

(ii) The solicitation document, incorporated provisions, and clauses are those in effect through the Federal Acquisition Circular 2021-05 effective 10 Mar 2021.

(iii) This acquisition is being solicited as a 100% Small Business Set Aside via SAM.gov under North American Industry Classification System (NAICS) code 813110. The small business size standard is $8 Million. The Product Service Code (PSC) for this acquisition will be G002.

(iv) Contract Line Item Number(s) CLINS:

0001 –Scott AFB Chapel Services, 5 Year Ordering Period, PoP 1 August 2021 – 31 July 2027

(v) Description of requirements:

The Contractor shall provide all services in accordance with the attached Performance Work Statement (PWS) dated 10 June 2021, to include any other labor personnel, equipment, tools, materials, supervision, and transportation. The anticipated contract type is an Indefinite Delivery Indefinite Quantity (IDIQ) contract with an anticipated initial Task Order to be placed with the Base award.

No site visit will be held for this solicitation.

(vi) The provision at 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition with the following addenda.

2. Offerors shall respond to this Request for Quote (RFQ) with their Pricing on Attachment

1, Technical Approach documents, Past Performance documentation (using Attachment 2 if applicable), and Subcontractor Consent Letter(s) Attachment 3 (if applicable), and return the attached “NATIONAL DEFENSE AUTHORIZATION ACT SECTION 889 CERT Solicitation” with their response. All quotation documents must be submitted as either Microsoft WORD, Microsoft EXCEL, and/or Adobe.pdf files, no other files will be accepted. Offeror’s Technical Approach will not exceed 6 pages. Past Performance documentation, Pricing, and Subcontractor Consent Letters shall not count against this page limitation. Offerors Past Performance documentation shall be limited to CPARS and Attachment 2 – Past Performance Questionnaires (PPQ). Offerors need only submit Attachment 3 if subcontractor consent is required.

3. To assure timely and equitable evaluation of quotes, offerors must follow the instructions contained herein. This section specified the format and content that offerors shall use in this RFQ. The intent is not to restrict the offerors in the manner in which they will perform their work but rather to ensure a certain degree of uniformity in the format of the responses for evaluation purposes. Offerors are required to meet all solicitation requirements, including terms and conditions and technical requirements, in addition to those identified as evaluation factors or subfactors. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.

4. Offerors must complete and return the attached “NATIONAL DEFENSE AUTHORIZATION ACT SECTION 889 CERT Solicitation” with their response.

(vii) The provision at 52.212-2, Evaluation—Commercial Items (Oct 2014), applies to this acquisition with this addenda.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Price, Technical Acceptability, and Past Performance. Offers shall be ranked by Price and then the lowest evaluated for Technical Acceptability and Past Performance. Technical Acceptability will be determined on a Satisfactory/Unsatisfactory basis. Past Performance will be determined on a Satisfactory/Unsatisfactory basis. The offeror who is determined to be Satisfactory in both Technical Acceptability and Past Performance with the lowest priced offer will receive the award. Price will be evaluated in aggregate (base plus all options).

(b) The Government may award without conducting Interchanges with the offerors.

However, the Government reserves the right to conduct Interchanges. The

Government may determine one or a few Offerors have the highest potential to provide the best value to the Government. Once the Offeror(s) is identified, the Government may hold Interchanges with only that one (or fewer than all Offerors) to address any remaining issues and settle the final terms of the quote. These issues may be technical, price, past performance, or deal with contract documentation. If the Interchanges do not result in an awardable quote, the Government may continue Interchanges with the next most favorably positioned Offeror(s) for the same purpose, and continue until award is made.

(c) Specific Instructions

Part I – Price

(1) The offeror shall submit a firm-fixed-price for each Chapel Services position on Attachment 1.

Part II – Technical Approach

The offeror shall submit the following subfactors:

(1) Management approach (including approach to staffing) that will lead to the successful accomplishment of the requirement, fill positions in a timely manner and maintain a personnel support structure with the requisite skills and expertise to perform tasks in accordance with the PWS. The offeror shall clearly outline the hiring process and turn-over process.

(2) Personnel qualification package for each position to demonstrate presently in-house or the ability to acquire the kinds of personnel that meet the personnel qualifications outlined in the PWS.

The offeror shall combine all Technical Approach documents into one Adobe.pdf format and clearly label and file each position. No other file format will be accepted.

Part III – Past Performance

(1) Offerors may submit CPARS records and/or Attachment 2 (Past Performance Questionnaire) for submission of the quotation.

Provide a list of no more than three (3), of the most relevant contracts performed for Federal agencies and commercial customers within the last three (3) years from the issuance date of this solicitation, that are similar in scope, complexity and dollar amount to the Chapel Services as stated in the PWS of this solicitation. Furnishing the following information for each contract listed:

(A) Company/Name of Offeror

(B) Type of Service (Title of Project)

(C) Contracting Agency/Customer and Address

(D) Period of Performance

(E) Contract number or equivalent identifier – if none, type “No contract number or identifier”

(F) Contract Amount

(G) Verified, up-to-date name, address, email address, and telephone number of a point of contact (POC) – the Contracting Officer or equivalent personnel of contracting agency/customer.

(H) Remarks – comments regarding compliance with contract terms and conditions.

(2) If an offeror has no past performance history of relevance, the offeror must state affirmatively it possesses no past performance history of relevance. Offerors possessing no past performance history will be viewed as neutral and rated satisfactory.

(3) Subcontractor Concent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the quotation a letter (Attachment 3) from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor.

(viii) 52.212-3 Offeror Representations and Certifications-Commercial Items.

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision. FAR 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (Aug 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.

(a) Definitions. As used in this provision—

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.

Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(d) Representation. The Offeror represents that—

(1) It □ will, □ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds “will” in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that—

It □ does, □ does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds “does” in paragraph (d)(2) of this section.

(e) Disclosures.

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded “will” in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment—

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number;

and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services—

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded “does” in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment—

DFARS 252.209-7999 Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction under any Federal Law Fiscal Year 2016 Appropriations.

See Class Deviation 2012-O0004, Prohibition Against Contracting With Corporations That Have an Unpaid Delinquent Tax Liability or a Felony Conviction under Federal Law, dated January 23, 2012. Contracting officers shall include this provision in all solicitations that will use funds made available by Division A of the Consolidated Appropriations Act, 2012, including solicitations for acquisition of commercial items under FAR part 12, and shall apply the restrictions included in the deviation. This deviation is effective beginning January 23, 2012, and remains in effect until incorporated in the FAR or DFARS or otherwise rescinded.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. 52.216-19 Order Limitations.

Order Limitations (Oct 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,500.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor-

(1) Any order for a single item in excess of $200,000.00;

(2) Any order for a combination of items in excess of $300,000.00; or

(3) A series of orders from the same ordering office within one (1) days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within three (3) days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

COMBATING RACE AND SEX STEREOTYPING

(DEVIATION 2021-O0001) (NOV 2020)

(a) Definitions. As used in this clause— “Race or sex scapegoating” means assigning fault, blame, or bias to a race or sex, or to members of a race or sex because of their race or sex.

“Race or sex stereotyping” means ascribing character traits, values, moral and ethical codes, privileges, status, or beliefs to a race or sex, or to an individual because of his or her race or sex.

(b) Exemptions. The exemptions that apply to Executive Order (E.O.) 11246 (see FAR 22.807) also apply to E.O. 13950 and the requirements of this clause.

(c) Compliance with E.O. 13950, Combating Race and Sex Stereotyping. Unless exempted under paragraph (b) of this clause, the Contractor shall not use any workplace training that inculcates in its employees any form of race or sex stereotyping or any form of race or sex scapegoating, including the concepts that—

(1) One race or sex is inherently superior to another race or sex;

(2) An individual, by virtue of his or her race or sex, is inherently racist, sexist, or oppressive, whether consciously or unconsciously;

(3) An individual should be discriminated against or receive adverse treatment solely or partly because of his or her race or sex;

(4) Members of one race or sex cannot and should not attempt to treat others without respect to race or sex;

(5) An individual’s moral character is necessarily determined by his or her race or sex;

The Contractor shall send, to each labor union or representative of workers with which it has a collective bargaining agreement or other contract or understanding, the notice provided below advising the labor union or workers’ representative of the Contractor’s commitments under this clause, and post copies of the notice in conspicuous places available to employees and applicants for employment.

(e) Noncompliance. In the event it is determined that the Contractor is not in compliance with this clause or any rule, regulation, or order of the Secretary of Labor, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor may be declared ineligible for further Government contracts, under the procedures authorized in E.O. 11246, as amended. In addition, sanctions may be imposed and remedies invoked against the Contractor as provided in E.O. 11246, as amended; in the rules, regulations, and orders of the Secretary of Labor; or as otherwise provided by law.

(f) Subcontracts. (1) The Contractor shall include the substance of this clause, including this paragraph (f), in all subcontracts that exceed $10,000 and are not exempted by the rules, regulations, or orders of the Secretary of Labor issued under E.O. 11246, as amended, so that these terms and conditions will be binding upon each subcontractor.

(2) The Contractor shall take such action with respect to any subcontract as the Director of OFCCP may direct as a means of enforcing these terms and conditions, including sanctions for noncompliance, provided, that if the Contractor becomes involved in, or is threatened with, litigation with a subcontractor as a result of such direction, the Contractor may request the United States to enter into the litigation to protect the interests of the United States.

AFFARS 5352.201-9101, OMBUDSMAN (OCT 2019)

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
