Environmental Compliance. Offerors are reminded of the environmental requirements contained in the solicitation to comply with all applicable federal, state, and local environmental statutes and regulations. In addition to the scrutiny of civil environmental regluatory and enforcement agencies, environmental compliance incidental to Air Force activities or on Air Force property is subject to Air Force scrutiny. The Air Force routinely investigates environmental violations and cooperates fully with civil authorities to secure remedies and discourage future violations. Failure to comply with environmental statutes and regulations can subject the contractor to criminal and civil penalties and/or contractual sanctions including, but not limited to, termination, suspension, and debarment, and adverse past performance assessment. Contractors can obtain specific information regarding environmental compliance mandates in 11 WG/CC Memo "Andrews AFB Environmental Standards" dated 19 Oct 2006. Additional information can be obtained by contacting the base environmental flight.

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Technical Price
(1) EVALUATION PROCEDURES.
(a) Technical Capability Factor Assessment: The offeror’s proposal shall, as a minimum, address each of the following factors, as they apply to the Performance Work Statement (PWS). During evaluations of each proposal, the Government will assign each factor shown below a rating and a written narrative reflecting the factor’s strengths and weaknesses. Failure to receive an “acceptable” rating in any of the factors will deem the overall rating to be “unacceptable”.
Technical Capability Factor(s): Education and Experience
The following technical evaluation factors will be evaluated and rated according to the chart listed below:
Acceptable Offeror has provided documented evidence of being able to understand and satisfy the requirements, thereby meeting the minimum standards.
Unacceptable Offeror does not meet the requirement or failed to respond to requirement. Deficiencies require major revisions. Probability of satisfactory performance is unlikely.
Factor 1 - Education and Experience: The offeror shall possess a baccalaureate degree from a accredited college or university (ideally with 15-30 semester hours in testing and measurement, counseling and guidance, or a related discipline) AND one year of office or professional work experience, preferably in an academic/educational environment, are strongly preferred. In the absence of a 4 year degree, a minimum of 3 years academic and/or military test administrator experience is required. Knowledge of/experience with standardized educational and military testing programs is essential, as is proficiency with standard AF-approved software including Windows NT, Microsoft Word, Excel, Access and PowerPoint. In addition, must have a working knowledge/experience of the Air Force Automated Education Management System (AFAEMS) to maintain individual student records. The proposal shall include details to comply with the PWS.
Factor 2 - Price:
(1) This factor will evaluate the cost proposal to determine price analysis, price reasonableness, and price reaslism of the proposed total evaluated price.
(2) An offeror’s proposed price will be determined by multiplying the quantities identified in the Price Schedule by the proposed unit price for each contract line item number (CLIN) to confirm the extended amount for each CLIN. The base period and option years will be totaled to determine the overall estimated price to be evaluated. All responsible offers that conform to the solicitation requirements will be ranked according to price
(3) Offerors are specifically advised that, under this evaluation method, the government may determine that an offer is unacceptable if the prices are unbalanced between initial and each option year. Prices are unbalanced if they are significantly overstated or understated in relation to the actual cost of the work. This may be ground for eliminating a proposal from competition either on the basis that the offeror does not understand the requirement or the offeror has made an unrealistic proposal. By signing its offer, the offeror certifies that each price stated on each CLIN includes an appropriate apportionment of all costs, direct and indirect, overhead, and profit. Review of the offeror price data will consist of an analysis to determine the following:
(i) Price Analysis. All cost and financial information required by the RFP and amendment (s) there to have been submitted. One or more of the following techniques may be used to perform price analysis.
(A) Comparison of proposed prices received in response to the solicitation.
(B) Comparison if prior proposed prices and contract prices with current proposed prices received for the same or similar end items.
(C) Comparison with competitive published price lists, published market prices of commodities, similar indexes, and discount or rebate arrangements.
(D) Comparison of proposed prices with Independent Government Estimates (IGE).
(ii) Each proposal will be evaluated to determine whether the government considers the proposed price to be reasonable. The government will evaluate price in relation to commercial or market price lists, IGCE, or any other information used as a basis or comparison.
(iii) Each proposal will be evaluated to determine whether the government considers the proposed price to be realistic and if they are compatible with the scope of effort, are not unbalanced, and are neither excessive nor insufficient for the effort to be accomplished. An unrealistically low price, submitted either initially or subsequently, may be grounds for eliminating a proposal from competition either on the basis that the offeror does not understand the requirement, or has made an improvident proposal.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (AUG 2009) ALTERNATE I (APR 2002)
An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov.
