Attachment 3 Addendums to FAR 52.212-1 and FAR 52.212-2 Request for Proposal: FA2823-15-R-4012 Roller-Drum Chopping, Eglin AFB, FL 32542
Addendum to FAR 52.212-1 - Instructions to Offerors -- Commercial Items (Apr 2014)
A. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all requirements, including terms and conditions, representations and certifications and technical requirements. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the combined synopsis/solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of two (2) separately bound parts, Volume I – Technical Information and Volume II – Price Proposal.
In proposal volumes, follow the quantity and page limits as follows:
Section Copies Page Limits
Volume I – Technical Information Original 10 page limit
Volume II – Price Proposal
Offeror Cover Page Original 1 page limit
Bid Schedule (Attachment 5) Original 1 page limit
Offeror Representations & Certifications Original No page limit
SF 30 amendments issued, if any Original No page limit
The paper files will be checked to determine the number of pages and compliance with proposal instructions. Those pages in excess of the limit will be removed from the back of the volumes and returned by the Procuring Contracting Officer (PCO) to ensure they are not evaluated. The Government will not keep any pages in excess of the limit. If Evaluation Notices (EN’s) are required, page limits may be placed on any responses. Any page limits for responses to ENs will be identified in the letter forwarding the ENs to you. Excess pages submitted in response to EN’s will also be removed in the same manner by the PCO.
B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer’s opinion adequate price competition exists, no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.
C. Specific Instructions:
1. Volume I – TECHNICAL PROPOSAL – Submit Original Proposal
(a) Technical information shall not make reference to price data. It will be evaluated strictly on technical merit utilizing a pass/fail determination. Attachment 4 is NOT to be returned with proposals. It is provided so the offeror understands what will be evaluated during source selection process. All responses should address the items notated on Attachment 4.
(b) Technical Requirements:
| Factor 1: Management Capability |
| Factor 2: Requirement Specific Abilities |
2. Volume II – PRICE PROPOSAL – Submit Original Proposal
(a) Submit an offeror informational cover page that clearly identifies the firm’s point of contact, phone number, and E-mail address for this combined synopsis/solicitation.
(b) Complete Attachment 5– Bid Schedule and sign. In doing so, the offeror accedes to the contract terms and conditions as written in the Combined Synopsis/Solicitation (COMBO) and Statement of Work (SOW).
(c) Insert proposed unit prices in for each Contract Line Item Number (CLIN) including all option periods in the Bid Schedule. The Contract will have four option periods and one optional six month extension. The proposed prices for all CLINs will be added together to determine the Total Evaluated Price (TEP).
(d) Complete the necessary fill-ins and certifications in Clause FAR 52.212-3 Offeror Representations and Certifications – Commercial Items (Mar 2015). This clause shall be returned in its entirety with your price proposal. The offeror’s System for Award Management (SAM) Representations and Certifications record must be current, accurate and complete. For additional information, reference https://www.sam.gov/.
(e) All amendments issued must be signed to acknowledge the amendment and submitted with the Proposal. Submit Original.
D. Relationship Between Addendums to 52.212-1 – Instructions to Offerors – Commercial Items and 52.212-2 Evaluation – Commercial Items
Your attention is directed to the functional relationship between Addendum FAR 52.212-1 Instructions to Offerors – Commercial Items and Addendum 52.212-2 Evaluation – Commercial Items of this combined synopsis/solicitation. Addendum FAR 52.212-1 Instructions to Offerors – Commercial Items provides information for the purpose of organizing the proposal and is not intended to be all-inclusive. Addendum FAR 52.212-2 Evaluation – Commercial Items describes evaluation factors for award, to include the evaluation procedures for responsiveness to the combined synopsis/solicitation, ranking of the price proposal, and evaluation of technical proposal. Since the Government evaluation of proposals will cover areas identified in Evaluation – Commercial Items, proposals should address all such areas of evaluation. PROPOSALS THAT DO NOT CONTAIN THE INFORMATION REQUESTED BY THIS PROVISION ARE SUBJECT TO REJECTION.
E. Pages exceeding the page limitations set forth in this Clause will not be read or evaluated, and will be removed from the proposal (in a manner previously described in paragraph A of this contract clause).
F. Format for all proposal Volumes shall be as follows:
1. Proposals shall be neat, indexed (cross-indexed as appropriate) and assembled in an orderly manner. Hard cover binders are not desired or required.
2. Page Set-Up/Font Size/Lines on Page. Only 8 ½ x 11 inch, portrait format pages are acceptable for text-oriented material. Landscape (8 ½ x 11 inch) pages are permitted for charts or graphs. Foldout pages are limited to 11 x 17 inch and may be portrait or landscape (limit 5). Text font must be Times New Roman (with no “narrow” font versions acceptable). Font size must be 12 point with proportional spacing permitted. Type size for figures and tables must be no smaller than 8-point with proportional spacing permitted. Text may be wrapped around figures and tables. Margins on all four (4) edges of each page will be at least 1 inch. Include: RFP number, Volume and/or subdirectory title and page number in the margin on the upper right of all pages. Single spacing may be used for figures and tables. Company name and proprietary information notices must be placed on top and/or bottom margins. Use single column formatting only; multi-column formatting is not allowed. Graphics are allowed in either color or black & white with an 8-point minimum on embedded text except where data is only being used as a sample and readability is not intended. Proposals must not be supplemented by a package or supplemented by reference documents. Elaborate formats, bindings or color presentations are not desired or required.
3. Page Definition. A page is defined as one face of a sheet of paper containing information.
4. Page Numbering. Pages in each volume must be numbered sequentially and consecutively. The cover page, table of contents, list(s) of tables and drawings, and blank pages are excluded from the page count.
G. Deviations. Deviations from these instructions will be reviewed by the Contracting Officer to ensure that no contractor receives a competitive advantage. Deviations resulting in a competitive advantage for an offeror will result in the proposal being determined noncompliant with the RFP requirements. Offerors unconditionally assume the risk that a clear quantitative deviation will be deemed qualitatively advantageous to the offeror and determined noncompliant with the RFP.
H. Disposition of Unsuccessful Proposals. The Government will retain one copy of all unsuccessful proposals. The Government will destroy extra copies of unsuccessful proposals.
I. Proposal Delivery. Offerors are advised that delays can be experienced entering the installation when proposals are hand carried to the base. See clause AFFARS 5352.242-9000 Contractor Access to Air Force Installations for specific requirements to access this installation. Proposals may be submitted in hard-copy (paper) format with one (1) original and two (2) copies. In addition please ensure one (1) copy is placed on a CD-ROM/DVD. Flash drives are unacceptable. Proposals must be hand delivered or mailed to arrive at the following address by the required dates:

Addendum FAR 52.212-2 Evaluation – Commercial Items
EVALUATION OF PROPOSALS
1. This is a competitive Best Value acquisition utilizing Lowest Price Technically Acceptable (LPTA) basis IAW FAR 15.101-2. This procurement will be conducted as a Total Small Business Set-Aside. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
a. Price
b. Technical Acceptability
2. Offerors shall propose on all items. Any offer that fails to cite a price for each item or fails to make an entry that indicates service will be provided at no charge may be rejected as nonconforming to this combined synopsis/solicitation.
3. Only Firm-Fixed-Price (FFP) offers will be evaluated. An offer using a sliding price scale or subject to escalation based on any contingency will not be accepted.
4. The evaluation process will proceed as follows:
a. Price: The proposed prices for all CLINs (including Options) will be added together to determine the Total Evaluated Price (TEP) and ranked from lowest TEP to highest TEP. Price will be evaluated for reasonableness subject to the processes described. Reasonableness will be determined based on prices submitted by the competition, current market conditions, and comparison to the Government estimate, if applicable. The Government may determine that an offer is unacceptable if the prices (including options) are materially unbalanced. Materially unbalanced prices risk rejection. Evaluation of options shall not obligate the Government to exercise the option(s).
b. Technical Acceptability: The lowest offeror will then be accessed as Technically Acceptable or Unacceptable based on the following technical qualifications:
| i. | Management Capability |
| ii. | Requirement Specific Abilities |
If the first lowest Total Evaluated Price (TEP) offer is determined to be technically acceptable that offer represents the Best Value for the Government and the evaluation process stops at this point. Award will be made to that offeror without further consideration of any other offers. If the first lowest TEP offer is not deemed technically acceptable, the next lowest offer will be evaluated until an offer is deemed technically acceptable. The Government reserves the right to seek information on higher priced offerors if none of the lower priced offerors receive a Technically Acceptable rating.
5. Offerors are cautioned to submit sufficient information and in the format specified in Addendum FAR 52.212-1 Instructions to Offerors – Commercial Items. Offeror’s may be asked to clarify certain aspects of their proposal.
6. Offerors are cautioned to follow the detailed instructions fully and carefully, as the Government reserves the right to make an award based on initial offers received, without discussion of such offers. The offeror's initial proposal should reflect their best effort.
7. If the Procuring Contracting Officer (PCO) determines that discussions are necessary, Offerors may be required to participate in telephone discussions or in face-to-face discussions at the Operational Contracting Division, 308 West D Avenue, Suite 130, Bldg. 260, Eglin AFB FL.
