IV. Statutory authority permitting Other than Full and Open Competition.
10 USC 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(ii), required by FAR 6.303-2(b)(4).
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
A. The original Canberra System was competed in September 2013 using simplified acquisition procedures under FAR 13.5.
Market research showed six possible competitors; however, only four responded to the Request For Quote (RFQ) FA2521-13-Q-B049. Of these, only three were found technically acceptable: Canberra, Advanced Measurement Technology, Inc., and To Serve Consulting. Canberra was determined to be the lowest price technically acceptable offeror and was awarded Contract FA2521-13-P-0093 at a price of $1,966,125.78. AFTAC already utilizes multiple other Canberra systems, and their software and hardware are not compatible with other vendors' products.
B. The laboratory currently uses 22 Canberra HPGe systems purchased in September 2013 under contract FA2521-13-P-0093 . The systems under this proposed procurement must be compatible with those systems for the following reasons:
1) The division has spent on training for Canberra's Alpha, Alpha + Beta, and Gamma (HPGe) radiation detector equipment operation over the past year under contract FA2521-14-P-0043 to ensure the current staff's technical competency. Approximately of that cost was specifically on Canberra Gamma (HPGe) training that is directly applicable to HPGe systems; the remaining training costs were for Canberra's Alpha and Alpha + Beta detection systems. Changing vendors would require the complete re-training of pertinent staff at an estimated additional cost of approximately
2) The aforementioned training included approximately 1,000 hours over nine months. New training from a different vendor is expected to require the same expenditure of hours over a similar time period. Accordingly, the procurement of Canberra HPGe systems would save the Air Force the unnecessary expense associated with the estimated 1,000 hours of training and would prevent an estimated nine-month delay in implementation of a new analysis system.
This will be a brand name solicitation in order to ensure uniformity of equipment and parts. The procurement of any other brand would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and would result in unacceptable delays in fulfilling the Air Force's requirement. These are follow-on supplies of highly specialized equipment for the DoD and retooling to another company would result in substantial costs and delays.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
A Sources Sought was posted on the Federal Business Opportunities (FBO) and General Services Administration (GSA) web pages and zero responses were received. Both sources sought used the North American Industry Classification System (NAICS) Code proposed of 334516. The size standard for this NAICS is 500 employees.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer believes the anticipated price will be fair and reasonable based upon a previous contract, competition, and vendor price lists, if available. The Contracting Officer will determine the price fair and reasonable IAW FAR
12.209 and 13.106-3(a)(2)(i) through (vii).
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
A Sources Sought was conducted by 45 CONS on FBO from 24 December 2014 to 12 January 2015 and zero responses were received. A Sources Sought was also conducted by 45 CONS via GSA e-Buy from 24 December 2014 to 12 January 2015 and zero responses were received. Per a telephone conversation with the manufacturer (Canberra Industries Inc., , two sources of supply were identified: Canberra Industries Inc. and Federal Resources Supply Company.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
None
X. List of sources, if any, that expressed interest in the acquisition.
The two sources listed below have expressed interest in the acquisition and the Contracting Officer anticipates both sources would respond to a solicitation.
Manufacturer: Canberra Industries, Inc., 800 Research PKWY, Meriden CT 06450-7169, CAGE code 24114, DUNS 017592135.
Canberra Industries, Inc. is listed in SAM as a large business. Point of contact: Joan Nickerson, Worldwide Sales Support Manager. NAICS code 334516 is listed in SAM for this company. There are no active or inactive exclusions in SAM for this company.
Reseller: Federal Resources Supply Company doing business as Federal Resources, 235-G Log Canoe Circle, Stevensville MD 21666-2165, CAGE code 1Q3Z9, and this is a small business. There are no active or inactive exclusions in SAM for this company.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
This brand name requirement is a follow-on procurement for eight highly specialized HPGe systems to augment the existing 22 HPGe systems purchased last year via full and open competition. No other HPGe detection systems have been identified that are compatible or working to become compatible with the existing Canberra systems. An award to any other vendors would result in the same competition barriers and incur substantial duplication of equipment and training costs to the
Government that is not expected to be recovered through competition and cause unacceptable delays in fulfilling the agency's requirements - see section V of this document. For any future overhaul or full replacements procurements, consideration will be given to compatibility, sustainment, logistics, and competition barrier issues.
