About this file

This document contains two Executive Orders issued by Ohio Governor Mike DeWine. Executive Order 2019-12D, signed on March 4, 2019, governs the expenditure of public funds for offshore services, prohibiting state agencies from entering into contracts for services provided outside the United States. Executive Order 2022-02D, signed on March 3, 2022, responds to Russia's war on Ukraine by directing state agencies, boards, commissions, educational institutions, and pension funds to divest from Russian institutions and companies.

The orders require all agency procurement officers to include standard language in contracts that reflects the prohibition on offshore and Russian services. Specifically, service providers must affirm understanding of the order's requirements, disclose business locations, and identify all subcontractors. The 2022 order mandates divesting from Russian institutions, terminating existing contracts, and refraining from new investments or contracts with Russian companies. Exceptions are made for services necessary to attract jobs to Ohio, support academic missions of Ohio's public colleges and universities, and in emergency situations as determined by the Director of Administrative Services.
