About this file

This is Amendment Two to a Request for Proposal (RFP) issued by the Kansas Department of Agriculture for the establishment and operation of a BVLOS (Beyond Visual Line of Sight) Unmanned Aircraft Systems Test Range. The amendment, dated October 22, 2025, addresses four clarifying questions raised by potential respondents regarding the original RFP requirements. The closing date for bid submissions is November 5, 2025. The procurement is managed by Lee Askew, Procurement Officer, at 785.296.7107 or lee.askew@ks.gov. The amendment requires that a signed copy be submitted with all bid responses and clarifies key requirements related to FAA approval status, work plan development, financial statement submission, and reference documentation from subcontractors.

The primary clarifications provided through this amendment include: (1) successful bidders may either currently operate and maintain an FAA-approved test range or demonstrate competency and capability to do so within the current state fiscal year, removing the requirement to establish a new range from inception; (2) cost information shall not be included in the technical proposal's detailed work plan but rather be noted on the cost sheet as part of the overall project cost; (3) financial statements are not required for this project, though information regarding private capital commitment may be beneficial for legislative justification; and (4) vendors may list entities that have purchased similar items or services from the vendor or its subcontractors within the last five years as references, rather than only direct purchases from the primary bidder.

Question

Answer

1. The RFP indicates that respondents “...shall demonstrate that they are approved to operate and maintain a BVLOS Test Range by the Federal Aviation Administration (FAA) for the commercialization and testing of UAS equipment and technology for agricultural applications in the state of Kansas.” However, the stated purpose of this RFP is to establish an FAA approved BVLOS Test Range in the State of Kansas. Request that the RFP rephrase the requirement as follows:

Respondents shall demonstrate that they are approved to operate and maintain a UAS Test Range by the Federal Aviation Administration (FAA) for the commercialization and testing of UAS equipment and technology for agricultural applications in the state of Kansas.

The intent of this language was that the successful bidder could either operate and maintain a test range or demonstrate that they are competent and capable of doing so within a short timeframe (the current state fiscal year). The agency does not want to sacrifice the goal of ‘operating and maintaining’ an FAA approved test range due to an overly long an capital-intensive process to ‘establish’ an FAA approved test range.

2. As part of the 4.2 Requirements, the RFP has requested a detailed work plan that identifies methodologies and steps to fulfill the required specifications list for technology and equipment purchases, including costs. This deliverable is required as part of the Technical Proposal. This conflicts with section 4.4, which states: “Costs can only be stated in the respondent’s Cost Proposal, or in Section 5 (Cost Sheet)”. Please clarify that cost information shall not be included in the detailed work plan submitted as part of the Technical Proposal.

The ”including costs” language will be replaced with “The costs of these items will be notated on the cost sheet as part of the overall cost of project”

Question

Answer

3. Section 2.4 states that the narrative SHALL include the items listed in (a) through (f).

However, 2.4 (f) states “Financial statements MAY be required”. Please clarify whether financial statements are required, and if they are required, what form of financial statement is required.

Financial Statements are not required for this project. I believe that 2.4(d) should provide most of the information we need regarding how many resources are committed to the project by the successful vendor. However, I expect that any successful vendor is committing significant private capital to this project and that information would be useful in explaining to the Legislature why the state is making such a significant investment.

4. Section 2.7 states that three references shall be provided by entities that have purchased similarities or services from the bidder in the last five (5) years. Request that this requirement be modified as follows: provide three references who have received or purchased similar items or services from the bidder or its subcontractors, in the last five (5) years.

2.7. will not be edited. However, for this specific RFP, the State of Kansas will allow vendors to “list entities that have purchased similar items or services from the vendor or their subcontractors.”
