A Small Business Enterprise bid preference applies to both Group A and Group B for certified small businesses, though this preference does not affect the contract price. Bidders must demonstrate that they are regularly engaged in providing the goods described and must submit two reference letters from customers verifying their experience and capability. For Group A items identified as "Brand Name or Equal," bidders may propose equivalent products if they meet specified salient characteristics and include supporting documentation; the County reserves the right to request samples at no cost. 2.3 COUNTY OPTION TO RENEW
The County shall have the option to renew the Contract for an additional 60-month period.
Continuation of the Contract beyond the initial term and any option to renew subsequently exercised is a County prerogative and not a right of the Awarded Bidder(s). Such prerogative will be exercised by the County only when continuation of the Contract is clearly in the best interest of the County.

The Bidder shall provide all the information, documents, and attachments listed above to be considered for award. All information, documents, and/or attachments listed above are due with the Bid by the solicitation’s end time and date. The County may, at its sole discretion and in its best interest, allow the Bidder to complete, supplement or supply the required information, documents, and attachments during the bid evaluation period. Failure to provide all the required information, documents, and attachments with the Bid or if requested by the County during the Bid evaluation period, may result in the Bidder being declared non-responsive or non-responsible.
During the bid evaluation period, the County’s Strategic Procurement Department will review the information, documents, and attachments submitted by the Bidder. The County may request additional information from the Bidder and from available sources to completely evaluate the Bidder’s submittal and ascertain that the Bidder meets the stipulated requirements. The County shall be the sole judge of a Bidder’s ability to perform under a resulting Contract. Failure to meet the stipulated requirements or to demonstrate ability to perform under a resulting Contract, as determined by the County, may result in the Bidder being declared non-responsible.
During a resulting Contract, the Bidder has an obligation to advise the County of any changes, intended or otherwise, to the evidence given in compliance with the requirements in this Solicitation.
2.6 PRICES
The Bidder's prices shall be inclusive of all costs, delivery, charges, and fees. Additional charges of any kind will not be accepted.
2.7 PRICE ADJUSTMENTS
The initial contract prices shall remain fixed and firm for a period of no less than twelve (12) months from the solicitation’s end date. Thereafter, the County may review contract pricing at any time during the contract term to determine if pricing remains consistent with current market conditions. If market conditions indicate a change in the total cost of materials or services, whether upwards or downwards, the County reserves the right to negotiate a price adjustment in its best interest.
The Awarded Bidder may be required to provide supporting documentation for an upward movement in market conditions. The County shall have the right to negotiate any price increases.
Any price adjustments authorized by the County shall be formalized by a Contract Modification, originated, and published by the Strategic Procurement Department. Under no circumstances should an Awarded Bidder invoice the County a price that is higher than the price authorized through the contract award or an approved Contract Modification.

If a sample is required, the County will notify the Bidder in writing and will specify the delivery address and the deadline for submission of the sample. Each sample shall be submitted as stipulated in the County’s notice and shall be clearly labeled with the Bidder's name, Solicitation number, Solicitation title, Manufacturer and Brand Names, and Make and Model number (if applicable). If a Bidder fails to submit the sample as stipulated, its bid for the item may be declared non-responsive or non-responsible. Any sample submitted shall create an express warranty that the whole of the goods and/or Services to be provided by the Bidder during a resulting Contract shall conform to the sample submitted.
The County will evaluate “Equal” items based on the information furnished by the Bidder, information identified in the Bid and reasonably available to the Contracting Officer, and/or samples provided by the Bidder. The Awarded Bidder(s) shall make deliveries of ordered items in accordance with the time indicated on the Purchase Order issued by the County. All deliveries shall be made in accordance with good commercial practice and all required delivery time frames shall be adhered to by the Awarded Bidder(s), except in such cases of Force Majeure. In cases where a delivery will be delayed, the Awarded Bidder(s) must notify the County, via email, of the delay in advance of the original delivery date so that a revised delivery date can be scheduled, or other accommodation can be made.
Should the Awarded Bidder(s) fail to deliver on the number of days stated per delivery terms, the County reserves the right to cancel the order on a default basis at no cost to the County. If the order is terminated, it is hereby understood and agreed that the County has the authority to purchase the goods by other means and to charge the incumbent bidder with any re-procurement costs. If the Awarded Bidder fails to honor these re- procurement costs, the County may terminate the contract for default. Repeated failure to deliver order(s) may also result in default and contract termination.
Any returned items containing the County logo shall be destroyed. In cases where uniform items are ordered for a particular individual, all items for that person shall be bagged or boxed collectively and labeled with the individual’s name.

Based on this assessment, the Awarded Bidder will determine the required refurbishment actions and provide all necessary labor, replacement parts, and materials to return each helmet to full operational condition. If the helmet is not certifiable, the helmet will not require any refurbishment services. In these instances, the Awarded Bidder shall return the helmet to the County.
The Awarded Bidder shall also be responsible for providing/obtaining re-certification status for each helmet they provide refurbishment services for. The Awarded Bidder shall provide documentation, demonstrating proof of visual inspection and confirmation that refurbishment services were completed.
MDFR will not be responsible for supplying refurbishment parts unless otherwise specified in writing.
Any replacement parts needed for repairs shall be reimbursed to the Awarded Bidder as a pass-thru cost without any additional mark-up in addition to any labor costs. Prior to conducting any repairs, the Awarded Bidder shall provide MDFR with quote for the repairs and labor costs for review and approval.
