Minneapolis Park & Recreation Board Prevailing Wage Division 00 Section 00 73 43 - 1 of 2

SECTION 00 73 43 – PREVAILING WAGE

Prevailing Wage & Labor Compliance for MPRB Construction Projects Contract Compliance with the City of Minneapolis monitors and enforces prevailing wage rate requirements to ensure workers are paid fairly and appropriately. Below is an overview of enforcement of prevailing wage as it relates to Construction Projects for the Minneapolis Park and Recreation Board (MPRB). The Prevailing Wage Form must be signed and provided at the time of bid, or the Bid will be considered unresponsive. MPRB requires prevailing wage rates on all projects unless otherwise indicated.

Required by Ordinance Chapter 6 – Contracts of Improvements of the MPRB of Ordinances requires all invitations or requests for proposals and all contracts entered into where, pursuant to ordinance or statute, a formal written contract or performance bond is required to which the MPRB is a party, for the construction, alteration and/or repair of park buildings, park lands or parkways and which requires or involves the employment of mechanics and/or laborers shall contain a provision stating that all federal labor standards and prevailing wage provisions applicable to federal contracts in accordance with the federal Davis Bacon and related acts are applicable to this contract as if fully set forth herein and all contractors and subcontractors shall fully comply with such provisions regardless of any contractual relationship which may be alleged to exist between the contractor or subcontractor and their respective employees. (Pk. Bd. Ord. No. 84-102, § 2, 7-11-84)

Title 2, Chapter 24 of the Minneapolis Code of Ordinances requires the payment of prevailing wage on City construction projects. Contract Compliance monitors and enforces prevailing wages on all projects over $50,000.

Monthly Compliance Contractors awarded a project over $50,000 are required to register their project in LCP Tracker, and to submit weekly payroll reports.

Contract Compliance monitors labor compliance and prevailing wages through audits of payrolls submitted through LCP Tracker, onsite reviews, and third-party complaints. They will investigate and resolve underpayments related to fringes, overtime, and misclassification of workers (to name a few). They will also ensure that apprentices are registered with the State, paid according to their pay and benefit scale, and are used within the State approved ratio.

Monthly Compliance Reports Contract Compliance generates reports outlining contractors’ compliance with all requirements. These reports are provided to contractors and City Procurement/MPRB to keep open lines of communication with all parties.

Non-Compliance Contract Compliance will assess non-compliance penalties as applicable; the most common is withholding payment to a contractor. A Non-Compliance Report covering the allegation(s), investigation and determination may also be provided to relevant parties.

Underpayments and Withholding of Payments When an employee on a project is not paid according to the prevailing wage and labor compliance laws, Contract Compliance will investigate and determine the back pay that is owed. The contractor must ensure prompt payment to the employee. If the contractor is not the general contractor, the general contractor is required to pay the employee. If the payment is not made, Contract Compliance will request - through the MPRB - that the City holds the amount of dispute during the next pay application. Should a contractor remain non-compliant, the City may debar it from future contracts, terminate its current contract, and hold it and its surety liable for the cost to complete any remaining work.

Closeout Contract Compliance will confirm with the contractor and MPRB Project Manager that all work is complete and that all payrolls have been submitted and any complaints resolved.

In addition to the certificates and other evidences of compliance which are required under these specifications and under Minneapolis Code of Ordinances, Section 24.240, it shall be required that the person or company representative submitting a bid for this contract shall certify in writing that both they and their Subcontractors shall comply with the wage and labor standard provision of Minneapolis Code of Ordinances, Section 24.200 through 24.260 as amended. Failure to comply with this ordinance shall mean the City may, by written notice to the Contractor, terminate the Contractor's right to proceed with the work and the Contractor and his Sureties shall be liable to the City for any excess cost occasioned to the City for the completion of the work.

By submitting this bid, it is understood and agreed that if it is accepted, in whole or in part, as designated, that any work done by the Contractor or by the Contractor's agent or Subcontractor under a contract with the City of Minneapolis or Minneapolis Park and Recreation Board shall be done in conformity with provisions of Minneapolis Code of Ordinances, Chapter 24, Section

NARRATIVE REPORT

1.0 INTRODUCTION

The following is the preliminary report of the asbestos survey conducted in the building located at 1720 Marshall Street NE in Minneapolis, MN. Todd Giorgi, of LEGEND TECHNICAL SERVICES, INC.

(LEGEND) performed the survey work on May 5, 2026.

LEGEND’s services included the following:

• Identify material suspected of containing asbestos within the building.

Collect samples of the materials suspected of containing asbestos from inside and outside the building which were not previously sampled or not enough samples were collected of miscellaneous materials during the 2013 survey to prove they do not contain asbestos due to the new Minnesota Pollution Control Agency and Minnesota Department of Health interpretations of the regulations.

• Analyze bulk samples collected during the survey for asbestos content using polarized light microscopy (PLM).

• Prepare a final report which includes the locations, and types of asbestos containing materials

(ACM) found in the building.

2.0 SAMPLING METHODOLOGY

A walk-through survey of the building was performed. Samples of materials suspected of containing asbestos were collected during the survey for analysis. Materials were analyzed in LEGEND’s laboratory for asbestos content.

2.1 Analytical Procedure

Analysis for the presence of asbestos fibers in bulk samples is performed using polarized light microscopy (PLM) and dispersion staining techniques. The analysis was performed using an Olympus BHSP microscope at 40-200X magnification in accordance with current U.S.

Environmental Protection Agency (USEPA) protocols, 40 CFR Appendix E to Subpart E of Part 763, “Interim Method of the Determination of Asbestos in Bulk Insulation Samples” and “Method for the Determination of Asbestos in Bulk Building Materials,” 1993 (EPA 600/R-93-116).

Our laboratory is accredited by the National Institute for Standards and Technology (NIST). Our National Voluntary Laboratory Accreditation Program (National Voluntary Laboratory Accreditation Program (NVLAP)) Number is 102081. The laboratory proficiency records, certifications, and quality assurance manual are available upon request.

An asbestos containing material is defined as any material containing greater than one percent asbestos as analyzed by PLM techniques according to current Minnesota Department of Health and Minnesota Pollution Control Agency regulations.

3.0 RESULTS

A total of one hundred forty-three (43) bulk samples were collected of suspect ACM from the building which were not previously samples in the 2013 survey. Of the forty-three (43) samples, seven (7) were found to be asbestos containing.

LEGEND No. 2602046 July 23, 2026

The following material was sampled and found to be asbestos containing which was not previously identified during the original survey:

• Electrical buss line insulators found on the floor throughout the upper level. There are approximately 26 electrical buss lines in the upper level floor. Each buss line has 4 to 6 asbestos containing insulators.

The following asbestos containing materials were also found during the original 2013 survey and are still present in the building:

• Window glazing on the windows in the lower level garage area and 17 windows in the upper level garage area.

• 12” x 12” Floor tile in the upper level office area. There is approximately one thousand seven hundred (1,700) square feet of asbestos containing floor tile in the upper level office area. Much of the tile is loose or stacked in piles throughout the area.

• Paneling adhesive (black) found in the upper level office area. There is approximately one thousand two hundred (1,200) square feet of paneling with asbestos containing adhesive on the upper level.

• Paneling adhesive (black) in the lower level southwest and middle west room. There is approximately one thousand five hundred (1,500) square feet of paneling with the asbestos containing adhesive on the lower level.

• 12” x 12” Floor tile in the lower level southwest room and middle west room. There is approximately one thousand three hundred fifty (1,350) square feet of asbestos containing floor tile on the lower level.

• Floor tile adhesive in the upper level restrooms. There is approximately two hundred eighty (280) square feet of asbestos containing adhesive in the restrooms.

• Roof flashing on the perimeter of the roof as well as around all mechanical curbs on the roof. There is approximately one thousand one hundred fifty (1,150) linear feet of the asbestos containing roof flashing present on the building.

The following is a list of the building materials which were previously assumed to contain asbestos or not enough samples were collected to prove the materials did not contain asbestos that were sampled and found to be non-asbestos containing:

• Building expansion joint caulk

• Window caulk

• 12” x 12” Floor tile (orange)

• 12” x 12” Floor tile (gray)

• Floor tile adhesive (tan)

• Floor tile adhesive (black)

• Drywall and associated taping compound

• Paneling adhesive (tan & yellow)

• Foam insulation adhesive

• Window glazing (interior windows)

• Base cove adhesive

• Built-up roofing

• Roof insulation (fiberboard)

• Roof insulation (foam) & associated backing paper

• Stair tread adhesive

• Electrical panel insulators (black & gray)

Refer to the appendices for additional bulk sample information.

4.0 REGULATED WASTES

The following is a list of regulated waste that was observed during the site visit and must be removed and disposed of or recycled prior to building demolition:

• Fluorescent bulbs = 325

• Ballasts = 225

• Oil filled door closers = 5

• Fire extinguishers = 7

• HID bulbs = 36

• Water heater = 1
