About this file

This is an evaluation criteria scorecard for the Massachusetts Department of Higher Education's Optional Retirement Plan (ORP) Attorney solicitation (COMMBUYS Document #BD-26-1088-RGT01-RGT01-125051). The Department seeks a qualified legal services vendor to provide counsel to the Massachusetts Optional Retirement Plan as Plan Administrator. The evaluation scorecard was updated on May 7, 2026, and establishes a structured assessment framework for reviewing bidder proposals against defined qualifications and experience metrics. The document does not specify response dates, due dates, site visits, bidder conferences, award dates, or contract term details.

The evaluation criteria consist of two required qualifications and four additional scoring categories, each weighted at 25 points for a maximum of 100 points total. Required qualifications mandate that bidders demonstrate significant retirement plan legal services experience with State Government Higher Education Agencies for at least 10 years and carry Lawyers Professional Liability Insurance. Additional evaluation criteria award points based on years of experience (2 to 5 points), whether the firm drafts ORP documents (0 to 5 points), and the volume of ORP documents drafted in the past five years (0 to 5 points). The scorecard applies a standardized scoring rubric ranging from Non-Responsive (0 points) to Outstanding (5 points). The Department notes compliance with OSA policy supporting Small Businesses where applicable, may consider prior bidder experience and public information, and prohibits disbarred bidders from submitting proposals.
