About this file
This is a Security and Privacy Inquiry Form (Form 5) issued by the Texas Workforce Commission (TWC) as part of Request for Qualifications (RFQ) No. 3202600207 for Vocational Rehabilitation Impartial Hearing Officers (IHOs). The form establishes mandatory security and privacy standards that all IHO contractors must meet to handle sensitive personal information (SPI) and protected health information (PHI) belonging to Vocational Rehabilitation customers and Business Enterprises of Texas participants. Respondents are required to complete the form by confirming compliance with basic secure data practices and submitting signed certification. The form includes instructions specifically tailored for individual contractors, acknowledging that most enterprise-level questions may not apply and allowing respondents to use "N/A - Individual Contractor" where appropriate.
The form addresses seven mandatory sections covering device security and encryption, data transmission and communication, record retention and disposal, enterprise and cloud architecture (optional for individual contractors), security policies and incident response, and certification. Key requirements include password protection and full disk encryption on all work devices, secure encrypted email or file transfer capabilities, compliance with state record retention periods with secure deletion methods, and immediate notification to TWC's Chief Information Security Officer within twelve hours of any data breach. Individual contractors must provide a brief written statement (two to three sentences) explaining their personal data security practices, while enterprise vendors must attach formal IT security policies. All respondents must sign the form certifying the accuracy and completeness of provided information and acknowledging that maintaining these security standards is a continuous contractual obligation under any resulting TWC contract.

Request for Qualifications (RFQ) Form 5 – Security and Privacy Inquiry
3202600207 Vocational Rehabilitation Impartial Hearing Officers
PURPOSE & INSTRUCTIONS
The Texas Workforce Commission (TWC) is committed to protecting sensitive personal, medical, and case-related data. As an Impartial Hearing Officer (IHO), you will receive, store, and process highly confidential information, including Sensitive Personal Information (SPI) and Protected Health Information (PHI) belonging to Vocational Rehabilitation (VR) customers and Business Enterprises of Texas (BET) participants.
This Security and Privacy Inquiry Form is a standardized agency document required for all contractors who handle SPI and other confidential TWC data, including IHOs who will receive confidential medical and case records.
Instructions for Individual Contractors:
Because this is standardized enterprise IT form, the vast majority of the questions may not apply to an IHO. Respondents are encouraged to use "N/A – Individual Contractor" for any questions that do not apply.
When completing this form, please use the following guidance:
• Enterprise/Cloud Architecture (e.g., FedRAMP, IaaS, PaaS, Data Centers, Boundary/Data Flow Diagrams): If you do not use enterprise-level cloud hosting or commercial data centers, simply write "N/A" in these sections. You do not need to create boundary or data flow diagrams.
• Written Policies: You are not expected to have a comprehensive corporate IT manual. If you do not have formal written data policies, you may simply provide a brief written statement explaining how you ensure the privacy and security of confidential client files on your devices.
