About this file

This is a Data Use Agreement (DUA) attachment to a Request for Qualifications (RFQ No. 3202600207) between the Texas Workforce Commission (TWC) and potential contractors for the Vocational Rehabilitation Impartial Hearing Officers position. The DUA establishes the terms and conditions governing contractor access to, use, maintenance, and disclosure of confidential information, including unemployment compensation records, vocational rehabilitation services records, education records, federal tax information, personal identifying information, sensitive personal information, and Social Security Administration data. The agreement becomes effective upon contract execution and continues through contract termination, with specific obligations for contractors to implement appropriate procedural, administrative, physical, and technical safeguards to protect confidential information. Contractors must designate Privacy and Information Security Officials, maintain updated lists of authorized users with demonstrated need-to-know access, complete cybersecurity training certified by Texas Cyber Command, and comply with security standards based on NIST Special Publication 800-53, Revision 5.

The contractor bears all financial responsibility for breach investigation, mitigation, notification, and remediation efforts. Breach notification to TWC must occur within one consecutive clock hour for federal system information (Federal Tax Information and Social Security Administration data) or within twelve chronological hours for all other confidential information, with initial notification directed to ciso@twc.texas.gov and privacy.office@twc.texas.gov. Contractors must provide comprehensive breach details including affected individual identification, risk assessments, mitigation strategies, and regular status updates at minimum every three business days. The agreement requires contractors to maintain cyber liability, data breach, and crime theft insurance at sufficient limits naming the State of Texas as additional named insured. Contractor obligations survive contract termination regarding confidentiality and authorized-purpose-only use of information. TWC retains the right to conduct inspections of contractor facilities, systems, and records to monitor compliance, and contractors must indemnify and defend TWC against all losses, liabilities, and expenses arising from DUA violations or breach-related incidents.
